of\nplastics they introduce in the market through their products.<\/li><li>The brand owners should\nbe encouraged to slowly reduce the number of plastics they introduce in the\nmarket by adopting alternatives such as paper, glass, metals, etc.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>For the management of plastic waste in India, <strong>The Union Ministry of Environment, Forest, and Climate Change<\/strong><sup><a href=\"https:\/\/moef.gov.in\/en\/\"><strong>[1]<\/strong><\/a><\/sup> has released a draft EPR on October 6, 2021. Also, Non-profit Centre based in Delhi for Science and Environment has sent its propositions and recommendations to the Ministry of Environment, Forest, and Climate Change, by outlining the key achievements and issues with the draft policy on Extended Producer Responsibility of plastics. Also, the Plastic Waste Management Amendment Rule, 2021, announced by the Ministry bans specific\u00a0<strong>single-use items<\/strong>\u00a0which have\u00a0<strong>\u201cless utility and high clutter potential\u201d by 2022.<\/strong><\/p>\n\n\n\n<p>In the initial stage, the EPR for the last five years has failed to translate policy into action. The reason was the lack of responsibility from the producers and the lack of imposition from the authorities. <a href=\"https:\/\/corpbiz.io\/epr-registration\"><strong>EPR<\/strong><\/a> helps in advancing the economy and encouraging the principle of \u201cPolluter Pays\u201d where the manufacturer is responsible for the life cycle of the product. The recent suggested rules have managed to take one small step in the right direction.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Categories_of_Packaging_covered_under_Extended_Producer_Responsibility\"><\/span>Categories\nof Packaging covered under Extended Producer Responsibility-<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The producers and brand\nowners are charged with significant responsibility for the treatment\/disposal\nof plastic waste. Plastic waste covers three categories of packaging \u2013&nbsp;<\/p>\n\n\n\n<p><strong>Rigid plastic packaging<\/strong>-These kind of packaging\ninvolves the use of plastic materials such as polypropylene, High-density\npolyethylene, and polyethylene for the packaging of bottles and containers.\nThese packaging\u2019s are durable and lightweight.<\/p>\n\n\n\n<p><strong>Flexible plastic\npackaging<\/strong>-This packaging is lightweight packets or bags sealed using heat\nor pressure. Packaging like- plastic bags with Ziplock, laminated printed\npouches, travel kit bags. As it justifies its name, the flexible plastic packs\ncan be customized with ease. Also, the costs involved in these bags are low but\noffer basic protection from compression.<\/p>\n\n\n\n<p><strong>Multiple layers with\ndifferent types of plastic<\/strong><strong>&#8211;<\/strong>Multiple layer Plastics are plastics that have several thin\nsheets of materials that are attached and after attachment, it is difficult for\nanyone to separate.<\/p>\n\n\n\n<p>Also, The Ministry of\nEnvironment has specified strategies to determine the level of responsibility,\nunbending the targets in incremental steps for both producers and brand owners.\nThe Producers of plastic waste will also be permitted to deal in Extended\nProducer Responsibility certificates.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_targets_are_set_for_the_companies_to_collect_the_plastics\"><\/span>What\ntargets are set for the companies to collect the plastics?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>&nbsp;As per the rules,\nthe Companies will have to collect at least-<\/p>\n\n\n\n<ul><li><strong>In 2021-22, the target is for 35% collection of waste&nbsp;<\/strong><\/li><li><strong>In 2022-23, the target is for 70% collection of waste&nbsp;<\/strong><\/li><li><strong>By 2024, the target is for 100% collection of waste&nbsp;<\/strong><\/li><\/ul>\n\n\n\n<p>Further, From the year 2024,&nbsp;<strong>at\nleast50 % <\/strong>of the rigid plastic will have to be recycled by the companies and&nbsp;also\n<strong>30% of category 2 and 3 plastics will have to be recycled.<\/strong><\/p>\n\n\n\n<p>Every year higher targets\nare progressively set i.e.&nbsp;<strong>after 2026-27, for Category 1<\/strong>&nbsp;80 % and&nbsp;<strong>for2\nand 3 categories 60%<\/strong>&nbsp;need to be recycled.<\/p>\n\n\n\n<p>There are similar\ntargets, with slight changes, for companies that use packaging materials or\nimport them.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Essential_Steps_by_the_authority_to_improve_Extender_Producer_Responsibility-Plastics\"><\/span>Essential\nSteps by the authority to improve Extender Producer Responsibility-Plastics<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>EPR Certificates-&nbsp;<\/strong>If companies have not met out their obligations, the companies\non a Case-to-Case basis be permitted to purchase ERP certificates.<\/p>\n\n\n\n<p>Also, The CPCB will\ndevelop a procedure for such exchanges on a centralized online portal.<\/p>\n\n\n\n<p><strong>Non-Compliance:<\/strong>&nbsp;An&nbsp;<strong>environmental compensation<\/strong>&nbsp;will be\nlevied in case of non-compliances. However, the rules do not specify the amount\nof compensation.<\/p>\n\n\n\n<p><strong>Fine:&nbsp;<\/strong>If the companies that&nbsp;<strong>do not fulfill their targets or do\nnot buy many ERP credits<\/strong>&nbsp;to meet their respective target must&nbsp;<strong>pay\na fine<\/strong>.<\/p>\n\n\n\n<p><strong>Note-The amount\ncollected&nbsp;<\/strong>by the way of funds and\nfine will be transferred in an escrow account and can be&nbsp;<strong>used in\ncollection and recycling<\/strong>&nbsp;and obsolescence disposal of non-recycled\/\nobsolescence disposal of plastic packaging waste on which the environmental\ncompensation is levied.<\/p>\n\n\n\n<p><strong><em>Also, the manufacture of\na range of plastic products will be banned from July 2022.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In a nutshell, PWM rules compel producers of plastic packaging material to collect all their products and ensure that the minimum percentage as prescribed above shall be recycled and used in further supply.
