Further, these provisions compel producers to shift their focus to a circular economy that supports the concept of reuse and recycling. The Government sets out certain targets under these rules for the accumulation of plastic and e-waste generated from the consumer\u2019s end. It\u2019s worth noting that CPCB holds the authority for the grant of <a href=\"https:\/\/corpbiz.io\/epr-registration\"><strong>EPR authorisation<\/strong><\/a> in India.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Applicability_of_EPR_Authorisation_for_E-waste_producer\"><\/span>Applicability of EPR Authorisation for E-waste producer<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According to the\nE-waste Management Rules, 2016, the producers of schedule I products are\nmandated to apply for EPR Authorisation via form 1.<\/p>\n\n\n\n<p><em><strong>Form 1 is\ndivided into five parts, namely;&nbsp;<\/strong><\/em><\/p>\n\n\n\n<ol><li>General Information<\/li><li>Estimation of E-waste Generation<\/li><li>EPR Plan*<\/li><li>Reduction of Hazardous Substances<\/li><li>List of documentation<\/li><\/ol>\n\n\n\n<p>EPR plan is a\ndocument that reflects the proposed waste accumulation targets to be achieved\nby the producers or manufacturers. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Significance_of_EPR_authorisation_under_Plastic_Waste_Management_Rules\"><\/span>Significance of EPR authorisation under Plastic Waste\nManagement Rules<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Increasing\nplastic wastes from the consumer\u2019s end is a serious concern for the Government.\nThough the local bodies contribute to waste minimisation, their efforts seem to\nbe outweighed by the rapidly increasing post-consumer plastic waste. The\nenvironmental crisis created by plastic waste is unprecedented and permanent.\nKeeping this in view, the Government has introduced EPR provisions under the\nPWM rules and the EPR targets for waste collection.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"EPR_applicability_for_PIBOs\"><\/span>EPR applicability for PIBOs&nbsp;&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>Under PWM rules, PIBOs (producers, importers, and brand owners) are obligated to set up a system with local bodies for the minimisation of plastic waste coming from the consumer\u2019s end.<\/li><li>Local bodies are liable for establishing the PWM system with the aid of PIBOs. Further, PIBOs functioning in more than two states are liable to obtain registration from CPCB, and those active in one or two states must obtain registration from respective SPCB.<\/li><li>EPR action plan has to be furnished by PIBOs for obtaining such registration. CPCB has underpinned EPR action plan format required for obtaining said consent as per norm of PWM rules) in June 2019.<\/li><li>PIBOs are obligated to meet EPR in all the States\/UTs in which they are launching their offerings. EPR target for a specific state shall be equivalent to the quantum and type of plastic being launched by them in the market in the specific State \/UT.<\/li><\/ul>\n\n\n\n<p><strong><em>The PIBOs have\nthree options according to Annexure I for EPR plan implementation for PWM&nbsp;in\nthe States\/UTs in which they are launching their products<\/em><\/strong><\/p>\n\n\n\n<ol><li>PWM via Own Distribution Channel<\/li><li>PWM via Direct engagement with ULB, i.e. Urban Local Body<\/li><li>PWM via engagement with WMA, i.e. Waste Management Agency which in turn sync with PIBOs, ULBs<\/li><\/ol>\n\n\n\n<p>But, it must be\nensured that the net quantity and types of plastic waste administered via these\noptions in a particular state\/UT fulfil the EPR targets of the respective PIBO\nfor the concerned State\/UT. Waste Management Agency, if involved, shall be registered\nwith the respective authority\/ULB. Details of such Waste Management Agencies\nshall be intimated to the concerned SPCB\/PCC by the designated state\nauthority\/ULB.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Points_relating_to_the_Applicability_of_EPR\"><\/span>Key Points relating to the Applicability of EPR<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>EPR provisions under PWM rule primarily focus on the reduction of waste created by the post-consumer single used plastic<\/li><li>It also laid down annual collection targets for PIBOs based on the production volume and system adopted.&nbsp;&nbsp;<\/li><li>EPR authorisation seeks e-waste producer to provide declaration regarding RoHS certification<\/li><li>EPR action plan reflects the tangible aspect of waste accumulation that every producer has to prepare before applying EPR authorisation.<\/li><li>The applicability of EPR has been confined to two legislations, namely EWM rules and <strong>PWM rules<\/strong><sup><a href=\"https:\/\/cpcb.nic.in\/rules-4\/\"><strong>[1]<\/strong><\/a><\/sup>.<\/li><li>The recycling, dismantling, and disposal units dealing with e-waste are exempted from EPR.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Ever-rising e-waste and post-consumer plastic wastes have created a serious environmental crisis in India. The EWM rules and PWM rules have provided a materialistic framework for waste minimisation.
