index<\/p>\n\n\n\n<ul><li>Red\n<\/li><li>Orange<\/li><li>Green\n<\/li><li>White<\/li><\/ul>\n\n\n\n<p>All these industries are\nliable to obtain CTE and then CTO from the respective State pollution control\nboard. <\/p>\n\n\n\n<p>Furthermore, Establishment encompassed under the following rules shall simultaneously apply for the grant of consent under of <strong>Water (P&amp;CP) Act, 1974 and the Air (P&amp;CP) Act, 1981<\/strong><sup><a href=\"https:\/\/cpcb.nic.in\/water-pollution\/\"><strong>[1]<\/strong><\/a><\/sup><\/p>\n\n\n\n<ul><li>E-Waste\n(Management) Rules, 2016<\/li><li>Hazardous\nand Other Wastes (Management &amp; Transboundary Movement) Rules<\/li><li>Bio-Medical\nWaste Management Rules, 2016<\/li><li>Plastic\nWaste Management Rules, 2016<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_Role_of_Consent_to_Establish_and_Consent_to_Operate_by_SPCB\"><\/span>What is the Role of Consent to Establish\nand Consent to Operate by SPCB? <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Consent to Establish:<\/em><\/strong> CTE is required to be secured prior to the establishment of plant, industry, or process.\u00a0 The consent to establish (CTE) serves as a primary clearance. <\/p>\n\n\n\n<p><strong><em>Consent to Operate:<\/em><\/strong> Once the Plant, industry, or\nprocess is set up as per mandatory pollution control system*, the units are\nrequired to secure CTO i.e. Consent to Operate.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_to_obtain_CTE_and_CTO_from_SPCB\"><\/span>How to obtain CTE and CTO from SPCB?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>Download\nthe e-form for CTE from the SPCB portal<\/li><li>Fill\nand form and attach the documents as mentioned below <\/li><li>Furnish\nthe form&nbsp; electronically and submit the\napplicable fee<\/li><li>An\non-site inspection shall be conducted by the authority for determining whether\npollution control measures have been taken or not. The inspector shall also\nconduct the assessment of the EMS (environmental management system).&nbsp; <\/li><li>Upon\nsuccessful inspection and assessment, the grant of consent shall come to\neffect. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fundamental_documents_for_obtaining_CTE_and_CTO\"><\/span>Fundamental documents for obtaining CTE\nand CTO <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The documents required for CTE\nand CTO differ state-wise. However, most states seek the following set of\ndocuments as per the Water Act, 1974 and Air Act, 1981.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Consent to Establish (Mandatory Documentations)<\/h3>\n\n\n\n<ul><li>Site schematic along with a photograph showing the distance of Nearby residential region &amp; water body from the proposed facility (only applicable to Red and Orange category)<\/li><li>List of Directors or partners including their contact details. <\/li><li>SSI certificate and Industry department certificate.<\/li><li>Layout plan reflecting the location of the: <\/li><\/ul>\n\n\n\n<ol><li>Stacks\/Vents\/ emission points with Nos.<\/li><li>Drainage\/final disposal point for trade effluent<\/li><li>Solid waste storage\/ disposal facility<\/li><\/ol>\n\n\n\n<ul><li>Available open location within the facility for Green Belt Development(in sq. mts)<\/li><li>Building plans and machinery particulars prepared by a competent individual <\/li><li>Total built-up area<\/li><li>Project report along with particulars of the manufacturing process, with process flow schematic &amp; all stochiometric equation and sources of discharge, hazards \/ solid waste. <\/li><li>The break-up of water utilization &amp; water balance (domestic usage, process consumption, canteen, usages, boiler usage, other uses as applicable)<\/li><li>Details regarding Sewage Treatment Plant along with flow schematic.<\/li><li>Type of boiler and fuel utilized with quantity.<\/li><li>\u00a0Details relating to air pollution control measures: chimney\/stack wise for boiler &amp; process emission<\/li><li>Details relating to the availability of DG set, if any <\/li><li>List relating to raw material with quantity\/day MTD\/month<\/li><li>List of products with quantity\/day MTD\/month<\/li><li>Material safety data sheet (mandatory for the chemical industry)<\/li><li>For groundwater pumping, permission from the respective groundwater authority<\/li><li>Membership letter of common Biomedical waste treatment facility (mandatory for pharma companies and hospitals)<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Documents for Consent to Operate\/Renewal <\/h3>\n\n\n\n<ol><li>&nbsp;The break-up of water utilization &amp; water\nbalance (domestic usage, process consumption, canteen, usages, boiler usage,\nother uses as applicable)<\/li><li>Project report along with\nparticulars of the manufacturing process, with process flow schematic &amp; all\nstochiometric equation.<\/li><li>Environmental Statement\n(form-V).<\/li><li>Details relating to air\npollution control measures: chimney\/stack wise for flue gas and process\nemission.<\/li><li>Boiler, steam generating\ncertificate reflecting steam generation &amp; consumption of coal in Tonnes\/day\nduly authenticated by the boiler inspector<\/li><li>List relating to raw material\nwith quantity\/month <\/li><li>List of product and\nby-products with quantity\/month<\/li><li>Material safety data sheet\n(mandatory for the chemical industry)<\/li><li>For groundwater pumping,\npermission from the respective groundwater authority<\/li><li>Details relating to HW as per\n2016 amended rules or for entire categories with quantity, for Reprocessor\/\nRe-cycler, Generation, storage, processing (details of method), and Disposal,\nif applicable.<\/li><li>Details of the measure adopted\nby the entity for prevention of waste generated or for recycling or reuse\n(Declaration copy for the same) <\/li><li>Analysis report granted by\nMoEF accredited lab relating to wastewater, source sampling &amp; ambient air<\/li><li>Food and Drugs endorsement\ncopy (mandatory for Pharma Company)<\/li><li>Environmental Clearance, if\nrequired. <\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Validity_of_Consent_to_Establish_and_Consent_to_Operate\"><\/span>Validity of Consent to Establish and Consent to Operate<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The SPCB grants Consent to\nEstablish (CTE) for 3 to 5 years. In case the project proponent seeks an\nextension of the timeline, the applicant can apply for the same. <\/p>\n\n\n\n<p>Consent to operate (CTO)\nremains for a timeline of 5, 10, &amp; 15 years as per the Red, Orange, &amp;\nGreen categories of the industry respectively.<\/p>\n\n\n\n<p>The project\/industry proponent\naiming for renewal of CTO shall apply via OCMMS (Online Consent Management\n&amp; Monitoring System) prior to the expiration of the timeline of the\npreceding CTO granted by the respective SPCB.<\/p>\n\n\n\n<p>In some of the states, there\nis an automatic renewal facility where there is not any change on the product,\nprocess, raw material, increase in aggregate capital investment cost, and\nequipment. Production quantum and pollution load of the facility remains\nunchanged as declared in the original application form for CTO<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Exemption_for_white_category_establishments\"><\/span>Exemption for white category establishments <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The industrial\nprojects\/facilities encompassed under the white category are exempted from the\nrequirement of securing consent to establish or consent to operate under Water\n(P&amp;CP) Act, 1974 and the Air (P&amp;CP) Act, 1981&amp; any other facilities\nnot cited under Red, Orange and Green category.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Penalties_for_not_obtainingconsent_to_establish_and_CTO\"><\/span>Penalties for not obtainingconsent to establish and CTO<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>If any plant\/industrial\nfacility\/project opts to function without securing consent, the owner shall be\nsubjected to a jail term extendable to 3 months or to a monetary fine which may\nextend to Rs 10000 or to both. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>It is a daunting task for a business owner to set up a new manufacturing facility. Establishing a new project or industry seeks various approvals from different competent authorities. One of the fundamental requisites is to secure consent to establish from the respective <strong><a href=\"https:\/\/corpbiz.io\/state-pollution-control-board-spcb-noc\">State Pollution Control Board<\/a><\/strong>.
