class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The provisions of the said Act shall\napply to collective marks exposed to the provisions cited in Chapter 8.\nConcerning such a mark, the reference cited in clause (zb) of sub-section (1)\nof section 2 to distinguishing the offerings, i.e., goods and services of one\nindividual from others shall be interpreted as a reference to distinguishing\nthe products or services of members of a group of the individual which is the\nowner of the mark from those of others.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Sections_relating_to_Collective_Marks_under_Trademark_Act_1999\"><\/span>Sections\nrelating to Collective Marks under Trademark Act, 1999<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The legal provisions regarding the collective mark are cited under Chapter 8 of <strong>Trademark Act, 1999<\/strong><sup><a href=\"https:\/\/www.indiacode.nic.in\/handle\/123456789\/1993?locale=en\"><strong>[1]<\/strong><\/a><\/sup>.\u00a0 The said chapter entails the following sections that govern every aspect of such marks. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Section 62 <\/h3>\n\n\n\n<p>It seeks to oppose the misleading nature\nof marks. According to this section, the collective mark should not be\nmisleading as to significance or character. Further, it states that the\ncollective mark would stand unfit for registration;<\/p>\n\n\n\n<ul><li>If it is likely to create\nconfusion within the public domain or; If it projects itself other than a\ncollective mark <\/li><\/ul>\n\n\n\n<p>Applicants seeking trademark protection are liable to authenticate their proposed mark through material evidence. The non-fulfillment of the above conditions shall lead to the cancellation of <a href=\"https:\/\/corpbiz.io\/trademark-registration\"><strong>trademark registration<\/strong><\/a>. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Section 63 <\/h3>\n\n\n\n<p>Section 63 provides the applicant with a requirement of submitting\nregulations administering the use of collective marks along with the application.<\/p>\n\n\n\n<p><strong><em>The said regulations must specify the\nfollowing;<\/em><\/strong><strong><em><\/em><\/strong><\/p>\n\n\n\n<ul><li>A person is authorized to\nuse the mark<\/li><li>Conditions about\nassociation&#8217;s membership<\/li><li>Conditions\nabout use of the mark, including any sanctions for misusing the same<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Section 64<\/h3>\n\n\n\n<p>Section 64 deals with the acceptance of\nthe application by the Registrar either conditionally or unconditionally. As\nper this section, the Registrar can accept the application either\nunconditionally or subject to such stipulates, including amendments of the said\nregulations. Likewise, the Registrar can refuse to accept the application in\ncase of non-adherence to prescribed conditions. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Section 65<\/h3>\n\n\n\n<p>Section 65 provides for the public\ninspection of the regulations referred to in sub-section (I) of Section 63.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Section 66<\/h3>\n\n\n\n<p>Section 66 lays down the conditions for\nthe amendment of regulations. The said section provides that any regulations\nreferred to in sub-section (I) of Section 63 shall not come to effect unless\nthe amended regulations are duly filed with the Registrar and approved and\npublished by him\/her pursuant to Section 64.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Section 67<\/h3>\n\n\n\n<p>In the legal proceeding for infringement\nfiled by the mark owner as plaintiff, the court shall consider any loss\nencountered or likely to be encountered by mark owner and may give such\ndirections as to extend to which the mark owner shall proceeds of any monetary\nremedy on behalf of such mark owners.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Section 68<\/h3>\n\n\n\n<p>Section 68 sets out the additional\ngrounds about the removal of collective mark registration. The Registrar may\nalso remove the registration of a collective mark from the register on the\nfollowing grounds:<\/p>\n\n\n\n<ul><li>Inappropriate\nutilization of marks by owner has triggered confusion among the masses; or<\/li><li>Failure\non the part of mark owner on account of observing or maintaining the regulations\ngoverning the use of the mark<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fundamental_criteria_for_Securing_Trademark_Registration_for_Collective_mark\"><\/span>Fundamental\ncriteria for Securing Trademark Registration for Collective mark<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A collective mark shall not be eligible\nfor registration if it has an element that causes confusion among the masses or\nit is deceptively similar to any other marks in India.<\/p>\n\n\n\n<p>Thus, applicants are required to\nfacilitate certain documents that solidify the legitimacy of their marks. The\nsaid document must ensure;<\/p>\n\n\n\n<ul><li><strong><em>The\nmark in question is unique and does not resemble existing marks. <\/em><\/strong><\/li><li><strong><em>That\nthe proposed mark is free from any element that may trigger confusion among the\nmasses<\/em><\/strong><\/li><\/ul>\n\n\n\n<p>Anything contrary to these conditions\nshall lead to the cancellation of trademark registration.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Checklist_requirements_for_collective_marks_registration_in_India\"><\/span>Checklist\nrequirements for collective marks registration in India <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Describe what the business offers<\/em><\/strong><\/p>\n\n\n\n<p>Trademark must serve as a source\nidentifier for a business. A collective mark fulfills the same purpose and\nindicates areas served by the particular business.<\/p>\n\n\n\n<p><strong><em>Basis of use <\/em><\/strong><\/p>\n\n\n\n<p>It is imperative to clarify whether the\ntrademark that is being registered is for &#8216;use in commerce&#8217; or &#8216;intent to use.\nThe status of the application shall differ based on this. Apparently,\ncollective marks not in use or not utilized for commercial purposes shall be\nmarket under &#8216;intent to use.
