It further prohibits said\nundertakings if the license is granted by individuals other than the\nController. Keep in mind that the\nmanufacturer cannot avail a repair license to repair its own weight or measure\nas it is prohibited under the Act. <\/p>\n\n\n\n<p>Section 46 of the Legal Metrology Act 2009 sets out penal provisions for defaulters carrying out business activities without a valid license. As per the said Act, the defaulter in such a case may be subjected to a <strong>monetary penalty<\/strong><sup><a href=\"https:\/\/www.rbi.org.in\/Scripts\/BS_PressReleaseDisplay.aspx?prid=52883\"><strong>[1]<\/strong><\/a><\/sup> of up to Rs 5000 or jail term up to one year or both for a subsequent offense<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Legal Metrology Act, 2009 seeks to\nunderpin and enforce norms of weight and measures, oversee trade and commerce\nin weights, measures &amp; other goods tradable via weight, measure or number\n&amp; for matters associated therewith.
