Hazardous wastes may cause damage during improper storage, transportation, treatment, or disposal operations. Improper hazardous-waste disposal often pollutes open water and hydrological water supplies as harmful water pollution. It can also be a source of dangerous land pollution.\u00a0<\/p>\n\n\n\n<p>The Authority (Ministry\nof Environment, Forest, and Climate Change) is the decisive Ministry to deal with\nthe cross-border movement of hazardous and other wastes following the\nprovisions of Hazardous Waste Management rules. For the Hazardous waste\nManagement-Import, an occupier shall follow the requisite steps-<\/p>\n\n\n\n<ul><li>Prevention,\u00a0<\/li><li>Minimization,<\/li><li>Reuse,\u00a0<\/li><li>Recycling,\u00a0<\/li><li>Recovery, utilization,\u00a0<\/li><li>Safe disposal.\u00a0<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Criteria_for_Importing_Hazardous_Waste_in_India\"><\/span>Criteria\nfor Importing Hazardous Waste in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The criteria for Hazardous Waste Management-Import are mentioned below-<\/em><\/strong><\/p>\n\n\n\n<p>The Authority may grant the permission for Import within sixty days subject to the condition that the importer has \u2013\u00a0<\/p>\n\n\n\n<p>(i) The environmentally sound facilities,\u00a0<\/p>\n\n\n\n<p>(ii) Proper arrangements\nfor treatment and disposal of wastes generated.<\/p>\n\n\n\n<p>(iii) A valid\nauthorization and consents from the State Pollution Control Board.<\/p>\n\n\n\n<p>(iv) In the case of Part\nA of Schedule III wastes, prior informed consent from the exporting country.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rules_and_Regulation_to_be_Followed_by_Importers_of_Hazardous_Waste\"><\/span>Rules and Regulation to be Followed by Importers of Hazardous Waste<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The Import of hazardous wastes from any country to India for disposal shall not be allowed.\u00a0<\/li><li>Import hazardous waste from any country shall be allowed only for recycling, recovery, reuse, and utilization. It includes co-processing.<\/li><li>Import of hazardous waste in\u00a0<strong>Part A of Schedule III<\/strong>\u00a0maybe permitted to actual users with the prior informed permission of the exporting country. It shall require the authorization of the Ministry of Environment Forest and Climate Changes.\u00a0<\/li><li>The Import of hazardous wastes in\u00a0<strong>Part B of Schedule III<\/strong>\u00a0maybe permitted to actual users with the approval of the Ministry of Environment, Forest, and Climate Changes.\u00a0<\/li><li>The Import of hazardous wastes in\u00a0<strong>Part D of Schedule III<\/strong>\u00a0will be allowed per the procedure given in rule 13 and the note below the schedule.\u00a0<\/li><li>The Import of the hazardous and other wastes specified in Schedule VI shall not be permitted.\u00a0<\/li><li>The Import of hazardous wastes not mentioned in Schedule III, but displaying the dangerous aspects mentioned in Part C of Schedule III shall require initial written approval of the <strong><em>Ministry of Environment, Forest, and Climate Change<\/em><\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Ministry_of_Environment,_Forest_and_Climate_Change\"><strong><em>[1]<\/em><\/strong><\/a><\/sup> before the waste is imported to India.\u00a0<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Requisite_Compliances_for_Hazardous_Waste_Management-Import\"><\/span>Requisite Compliances for Hazardous\nWaste Management-Import<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Real users planning to import for cross border movement of hazardous wastes shall follow the requisite compliances and steps<\/em><\/strong><\/p>\n\n\n\n<ul><li>It shall comply with the rules specified in\u00a0<strong>Part A and Part B of Schedule III<\/strong>\u00a0and\u00a0<\/li><li>It Shall apply in\u00a0<strong>Form 5<\/strong>\u00a0along with the requisite documents mentioned<\/li><li>in the Ministry of Environment, Forest, and Climate Change for the Import.<\/li><li>The actual user shall take prior well-informed consent of the exporting country regarding\u00a0<strong>Part A of Schedule III<\/strong>\u00a0waste, and\u00a0<\/li><li>At the same time, it shall send a copy of the application to the concerned Pollution Control Board of the respective state for details.<\/li><li>The acknowledgment in this respect of the Import of hazardous waste from the respective Pollution Control Board shall be submitted to the MoEFCC. It shall be submitted along with the application.\u00a0<\/li><\/ul>\n\n\n\n<div class=\"shadow1\"><strong>Note:<\/strong> In case of Import of hazardous and other wastes listed in Part D of Schedule III, the importer shall not require the approval of the Ministry of Environment, Forest, and Climate Change.<\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Licenses_Required_for_Importing_Hazardous_Waste_in_India\"><\/span>Licenses\nRequired for Importing Hazardous Waste in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In case of Hazardous\nWaste Management -Import, the importer shall furnish the requisite details as\nper Form 6 to the Customs authorities, followed with the following documents in\naddition to those listed in Schedule VIII, wherever applicable.&nbsp;<\/p>\n\n\n\n<ol><li>The <strong><em>import license from Directorate General of Foreign Trade<\/em><\/strong>, if applicable.<\/li><li>Importer who is a trader importing waste on behalf of users shall obtain one-time authorization in Form 7, and a copy of this authorization shall be attached to Form 6.\u00a0<\/li><li>In case of Import(For Part B of Schedule III) of any used electrical and electronic assemblies as mentioned under Schedule I of the E-Waste (Management and Handling) Rules, 2011, as revised from time to time, the importer needs to obtain <em><a href=\"https:\/\/corpbiz.io\/epr-authorization-for-e-waste\"><strong>EPR-authorization<\/strong><\/a><\/em> as producer under the E-Waste (Management and Handling) Rules, 2011.\u00a0<\/li><li>Also, before clearing a consignment of wastes mentioned in Part D of Schedule III, the Customs authorities shall verify the documents in column (3) of Schedule VIII.\u00a0<\/li><li>On receiving the complete application concerning Part A and Part B of Schedule III, the MoEFCC shall examine the application taking into consideration the comments and observations, if any, received from the Pollution Control Boards of the respective State.<\/li><li>The MoEFCC shall forward a copy of the approval to the respective Port and Customs authorities, Pollution Control Board (Central and State) to ensure compliance with their respective functions are given in Schedule VII.\u00a0\u00a0<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Maintenance_of_Records_and_Returns_for_Hazardous_Waste_Management-Import\"><\/span>Maintenance\nof Records and Returns for Hazardous Waste Management-Import<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The importer of the hazardous\nwastes shall maintain records of the hazardous imported by him in&nbsp;<strong>Form\n3<\/strong>, and the record so maintained shall be made available for\ninspection.&nbsp;<\/p>\n\n\n\n<p>The importer of the\nhazardous wastes shall file an annual return in&nbsp;<strong>Form 4<\/strong>&nbsp;to the\nPollution Control Board of the respective state on or before the&nbsp;<strong>30th\nday of June<\/strong>&nbsp;following the financial year to which that return\nrelates.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>To conclude, Hazardous Waste Management -Import helps prevent, Minimization, Reuse, Recycling, Recovery, utilization, and Safe disposal of waste from any country to India.
