EPR regulations guarantee that manufacturers and\nproducers take responsibility to reduce waste generated by their products. <\/p>\n\n\n\n<p>When a product completes its\nutility, the manufacturer needs to collect the waste generated by the product.\nIt can be done by supporting the collection of waste that is generated after\nthe consumption of their products or through encouraging eco-friendly recycling\nof such products.&nbsp; <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_provides_EPRs\"><\/span>Who provides EPRs?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>EPRs are given by the Central\nPollution Control Board to the manufacturers of e-waste, plastic waste and\npolymer waste and to bulk users of these wastes. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"EPR_implementation_in_India\"><\/span>EPR implementation in\nIndia<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The e-waste (Management)\nRules, 2016, the plastic waste management rules 2016 and the solid waste\nmanagement rules can be compared with India\u2019s first EPR based legislation, the\nbatteries (Management and Handling) Regulations 2001 with respect to extended\nproducer obligation idea. However, the batteries (Management and Handling)\nRegulations failed, hence EPR process was implemented, connecting the informal\ncollecting system to the formal recycling and eliminating informal recycling\nunits.&nbsp;&nbsp; <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Applicability_of_EPR_e-waste_Authorization\"><\/span>Applicability of EPR\n(e-waste) Authorization <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><em><strong>The EPR authorization applies to the following:<\/strong><\/em><\/p>\n\n\n\n<ul><li>Producers\nof electrical and electronic equipment\/plastic;<\/li><li>Bulk\nconsumers of electrical and electronic equipment;<\/li><li>Importers\nof electrical and electronic equipment;<\/li><li>Dismantlers\nand collection centre of electrical and electronic equipment.<\/li><\/ul>\n\n\n\n<p><em><strong>Electrical and electronic equipment includes the following:<\/strong><\/em><\/p>\n\n\n\n<ul><li>IT and\ncommunication equipment;<\/li><li>Consumer\nelectrical and electronics like TVs, Washing Machine, ACs including fluorescent\nand other mercury containing lamps.<\/li><\/ul>\n\n\n\n<p>According to the notice by the\nCentral Pollution Control Board, all producers of electronic and electrical\nequipment under the e-waste management rules 2016 need to get EPR authorization\nfrom the Central Pollution Control Board. <\/p>\n\n\n\n<p>The authorization is necessary\nto make sure that end of life electronic EEE generated by the producers\u2019\nproduct is given to authorised dismantlers or recyclers.&nbsp; <\/p>\n\n\n\n<p><strong>Bulk consumers<\/strong> means the\nmajority of consumers of electrical and electronic devices like the central\ngovernment or govt. Agencies, public sector companies, educational\ninstitutions, international organizations and agencies, partnerships and public\nor private companies that are registered under the Factories Act and the\nCompanies Act.<\/p>\n\n\n\n<p><strong>Collection Centre<\/strong> refers to\na centre or a collection point or both established by producer individually or\nas an association for collection of e-waste to channel such waste to the\nrecycler and to fulfil the role as provided in the producers\u2019 extended\nproducers responsibility authorization and have facilities in compliance with\nthe CPCB guidelines, including the collection centre made by the dismantler or\nrecycler which must form a part of their authorization provided by the State\nPCB where the facilities are located<\/p>\n\n\n\n<p><strong>Dealer<\/strong> refers any individual or\ncompany purchasing or obtaining electrical and electronic equipment and its\ncomponents\/consumables\/parts or spare parts from producers for sale.<\/p>\n\n\n\n<p><strong>E-retailer<\/strong> refers to\na person or a business organization that uses the internet, telephone,\nelectronic network to sell its goods.<\/p>\n\n\n\n<p><strong>Manufacturer<\/strong> refers to\nan individual or organization or business specified in the Companies Act or\nbusiness mentioned in the Factories Act or SMEs as defined under the MSMED Act\nhaving electrical and electronic equipment manufacturing facilities. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_significance_of_obtaining_EPR_e-waste_Authorization\"><\/span>What is the significance\nof obtaining EPR (e-waste) Authorization?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>EPR is seen as a strategy of tackling planned obsolescence as it incentivises producers financially to design for recycling. Currently, governments are shouldering the issue of disposal of waste and are spending huge amounts of money on collection and removal of waste. However, these plans don&#8217;t work well as <strong><em>government<\/em><\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Government\"><strong><em>[1]<\/em><\/strong><\/a><\/sup> lack financial resources. Putting the responsibility for product disposal on manufacturers can help government.<\/p>\n\n\n\n<p>The benefit of EPR is that\nwhen the policy puts pressure on countries that export e-waste, it becomes more\neffective. E-waste regulation causes infrastructure to deal with the waste or\nadopt new ways for producers to create items. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_to_obtain_EPR_e-waste_Authorization\"><\/span>How to obtain EPR\n(e-waste) Authorization?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><em><strong>In order to obtain this authorization, the following procedure can be followed:<\/strong><\/em><\/p>\n\n\n\n<p>The producers, Importers, Manufacturers and Brand owners\napply online at Central pollution control board. The applicant\nis required to review all documents before filing by using the online portal,\nstate pollution control board web portal, and sending physical copies of the\napplication in <strong><em>Form-I<\/em><\/strong> along with required documents. The applicant needs to\nexamine all required documents before the filing. <\/p>\n\n\n\n<p>Within 25 days after receiving an\napplication, the Central Pollution Control Board (CPCB) or a state pollution control board may verify\nand investigate the provided information. After checking the submitted document\nand being satisfied with the extended producers responsibility plan, the\nCentral Pollution Control Board or the State Pollution Control Board will grant\nthe authorization. The extended Producers Responsibility authorization shall be\nvalid for Five years.<\/p>\n\n\n\n<p><strong>Document required-<\/strong><\/p>\n\n\n\n<p><em><strong>The following documents will be required:<\/strong><\/em><\/p>\n\n\n\n<ul><li>KYC of company signatory<\/li><li>KYC\nof Authorized signatory<\/li><li>IEC Code<\/li><li>Web site domain<\/li><li>Toll free No.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Cancellation_of_the_EPR_e-waste_Authorization\"><\/span>Cancellation of the EPR\n(e-waste) Authorization<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The following points may be noted:<\/em><\/strong><\/p>\n\n\n\n<ul><li>According\nto rule 13 (ix) of the e-waste rules, the central pollution control board can\ncancel or suspend EPR authorization if a producer fails to comply with the\nprovisions of the E (P) Act or e-waste (management) rules 2016 during the\nperiod of authorization. <\/li><li>In case a\nproducer is found to be violating authorization provisions, a notice will be\nissued by the central pollution control board in 25 days;<\/li><li>An\nopportunity will be provided to hear such producer prior to considering the\ncase for cancellation or suspension of EPR authorization;<\/li><li>&nbsp;The decision on cancellation or suspension\nwill be intimated within 10 days of hearing. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Proper waste management is critical to preserve human lives and environment. There is no denying of the fact that improper waste management can make this planet difficult for living. Hence the government authorises individuals and entities to manage the proper management of wastes in this country.
