of the old 70\u2019s soundtrack, which were become\nthe instant hit among the masses.&nbsp;Be it in any verse or language, these\nremixes somewhat remind the audiences about the original motion picture but\nwith a tint of popular versions. But, although these remakes of the old movie,\nthey are still treated to be a new movie as they constitute a different set of\ngenres as the casting individual- i.e. producer, filmmaker, actors are entirely\ndifferent.&nbsp;<\/p>\n\n\n\n<p>As we are aware\nthat the moment anything is created, it comes under the Copyright regime whether\nyou opt for the registration or not. In such a scenario, will creating remixes,\nmashups, compilations constitute infringement.<\/p>\n\n\n\n<p>Primarily, for a work to be treated as a copyrightable work, it ought to comply with the two fundamental conditions. These are also important for those intending to copyright a Remix song. <\/p>\n\n\n\n<ul><li><strong><em>It should adhere to the originality,\n&amp;,&nbsp;<\/em><\/strong><\/li><li><strong><em>It should be manifested in any tangible\nform because ideas stand ineligible for copyright protection.&nbsp;<\/em><\/strong><\/li><\/ul>\n\n\n\n<p>When any new kind of soundtrack or video composition is recreated, the owner gets exclusive rights over his\/her work. This allows the owner to further recreate, reproduce, or communicate his\/her work to the masses.&nbsp;In the recent past, a new wavelength of mash up, and copyright a Remix has taken its place in the music fraternity.&nbsp;<\/p>\n\n\n\n<p><strong><em>Turning\ninfringing material to official remixes is a risky affair but often rewarding\nif you can collect a strong enough pitch to secure the owing level.&nbsp;<\/em><\/strong><\/p>\n\n\n\n<p>Recording of a\nsoundtrack entails creativity &amp; intellectuals of the musical team &amp;\nonce ready, it is converted into a desirable number of copies to sell in the\nmarket. The given\nrights are linked with the copyright of such works.&nbsp;<\/p>\n\n\n\n<p><em><strong>In the case of&nbsp;literary, musical, or dramatic work, not being a computer program:&nbsp;<\/strong><\/em><\/p>\n\n\n\n<ul><li>To reproduce the work in a materialistic way &amp; store it in any digital medium.<\/li><li>To share copies of work publicly which are present in the market<\/li><li>Moreover, to share &amp; perform the work publicly&nbsp;<\/li><li>To create or recreate any filmmaking work or sound recording&nbsp;<\/li><li>Furthermore, to make any kind of abridgments or translation.&nbsp;<\/li><li>To make any modification in the work.&nbsp;<\/li><\/ul>\n\n\n\n<p><strong><em>What about\nthe sound recording?&nbsp;<\/em><\/strong><\/p>\n\n\n\n<ul><li>To create any other sound recording- mashups, remix, compilation, etc, concerning that,<\/li><li>To hire, produce, or sell copies of the soundtrack&nbsp;<\/li><li>To distribute the work publicly,&nbsp;<\/li><\/ul>\n\n\n\n<p>The infringement would come to effect if such a remake is done without the owner\u2019s consent. Copyright a Remix song under these circumstances would become impractical. In general, the entrepreneurs will contact the original owner through copyright collective management or societies, and then will forward a notification to them stating their intention to remake\/reproduce the soundtrack in return for royalty as consideration. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Types_of_Rights_available_for_Musical_Work\"><\/span>Types of Rights available for\nMusical Work<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As cited above, once the owner  successfully copyright a Remix song or other work of arts, he\/she got vested with  exclusive rights which enables him\/her to reproduce or distribute the work, to perform publicly via digital audio transmission, to make derivative work &amp; publish them.&nbsp;<\/p>\n\n\n\n<p>As a copyright\nholder of the work, the Act grants the right to record, sell, distribute its\ncopies of music in various ways like a digital download, compact Disc, etc,\nand\/or re-create something unique, creative from your pre-existing work &amp;\npublish it in a different part of the cities.&nbsp;<\/p>\n\n\n\n<p>At one place, it\npermits you to create unique works from pre-existing ideas but on the contrary,\nit also limits you from leveraging any work, which is not yours legally.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1. Reproduction right:<\/h3>\n\n\n\n<p>It implies that\nthe creator has a right to make copies of his work and store them in any\ndesirable format. In case someone is not legally permitted to make copies of\nwork then such an act will be punishable as per the Act. For example: Making\ncopies of the musical work or a sound recording in CD, electronic format,\nincluded in a motion picture, etc.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Synchronization Right<\/h3>\n\n\n\n<p>Under this\nright, the performance is aligned with any pictorial representation and then\npublically shared. To sync one\u2019s work with a visual motion picture is a\ndaunting affair that seeks immense hard work as well as creativity. Thus, the\napproval of the creator is required in such scenarios.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Personal use\nimplies playing the soundtrack in places where there is no element of money.\nBut for commercial performances like playing the soundtrack in hotels, radio,\nTV, cinema lure considerable royalty or license fee that goes straight to the\ncreator.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_about_music_streaming_in_clubs_and_restaurants_Does_it_attract_infringement\"><\/span>What about music streaming in\nclubs and restaurants: Does it attract infringement? <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A person has the\nlegal consent to create a new remix from the copyright version but they cannot\nstream the same in the club with proper consent for performance rights, it will\nbe treated as a punishable offense. In the club, DJ will not be obligated to\npay a royalty amount. If the remix music is with the real performance will\nencompass under fair use.&nbsp;<\/p>\n\n\n\n<p><strong><em>The\ncreator of the musical work is a composer, not the singer.&nbsp;<\/em><\/strong><\/p>\n\n\n\n<p>Gramophone\nCompany Vs Super Cassette Industries, In this case, the Delhi High Court came\nacross the fact the musical work is not a combination of melody or turning work\nbut every soundtrack has its structure, shape to prepare the entire notation\nfor music. After further interpretation of the section, we come across\nthe fact that if the aforementioned points are treated aptly then the act will\nnot amount to infringement of the original work under copyright\nprotection.&nbsp;<\/p>\n\n\n\n<p>There is a great\ndegree of confusion about whether such remixes can possess copyright protection\nor not. People have nil clarity between what can have an allowance &amp; what\nis not. In the digital era, it is very hard to comply with copyright laws, and\ntherefore, we frequently come across such issues.&nbsp;<\/p>\n\n\n\n<p>To keep\ninfringement out of the equation, the individual can leverage the following\nnorms cited under Section 52(1) (j).<\/p>\n\n\n\n<p><strong><em>Copyright a Remix song attracts the following conditions for the applicants. Any delay in this context could lead to a stoppage in song production.<\/li><\/ul>\n\n\n\n<p><strong>Overlooking such conditions would not allow anyone to copyright  a Remix original soundtrack in India. <\/strong><\/p>\n\n\n\n<div class=\"shadow1\"><strong>Key insights:<\/strong> But, in case an individual simply wishes to put all the soundtracks together &amp; use it in family events and has no fiscal benefits, then they can easily skip this lengthy process. <\/div>\n\n\n\n<p>The creator has\nthe right to check all the books of account pertaining to remix work. If any\nloopholes come to light concerning the royalty then the creator can lodge a\ngrievance against the producer or publisher and the copyright authority will\ntake relevant legal actions against them.&nbsp;<\/p>\n\n\n\n<p>Legal permission\nof the creator is a condition precedent. Plaintiff, on the other hand, claimed that no such permission was\naccorded to the accused, which leads to the infringement of the copyright\nlaw.&nbsp;<\/p>\n\n\n\n<p>In the case\nof&nbsp;Gramophone Company vs. Mars Recording,&nbsp;the court came out with a\njudgment that if the condition cited under Section 52(1) is followed will not\nbe recognized as infringement &amp; no requirement for rendering any kind of\nlicense or consent<\/p>\n\n\n\n<p>In&nbsp;Super\nCassette Industries Ltd vs. Bathla Cassette Industries Pvt Ltd,&nbsp;the court\ndeclared that no alternation should be done in the voice of the playback singer\nbecause the voice is the soul of every soundtrack and it is a key element of\nthe song without securing legal permission from the creator.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Copyright_Cover_Versions_as_Per_2012_Amendment\"><\/span>Copyright Cover Versions as Per\n2012 Amendment:<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Amendment done\nis 2012 brings an array of modifications in the Musician\u2019s rights; Lyricist or\nperformer etc. Section 31C of the Copyright Act provides&nbsp;a statutory\nlicense that can be secured for creating a cover version.
