Ministry of Corporate Affairs specifies this\nForm as&nbsp;&#8220;Registration of Entities for undertaking CSR\nactivities&#8221;.&nbsp;&nbsp;<\/li>\n\n\n\n<li>Form CSR-1 shall be signed &amp; furnished digitally by the company.\nThis Form must be validated electronically by a professional like CS or a\nChartered Accountant or a Cost Accountant.<\/li>\n\n\n\n<li>All companies who are aiming to undertake CSR projects must file\nthis e-form on the MCA official website.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Common_benefits_of_securing_CSR-1_registration\"><\/span>Common benefits of securing CSR-1 registration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul>\n<li>Improved Public Image<\/li>\n\n\n\n<li>Enhanced Goodwill of NGO<\/li>\n\n\n\n<li>No hassles in undertaking CSR\nactivities<\/li>\n\n\n\n<li>Mitigate legal hurdles in securing\nfunding from corporate<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Significance_of_CSR-1_Registration\"><\/span>Significance of CSR-1 Registration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The <strong><em>Ministry of Corporate Affairs<\/em><\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Ministry_of_Corporate_Affairs\"><strong><em>[1]<\/em><\/strong><\/a><\/sup> (MCA)&nbsp;has made the e-form for CSR-1 available on its official portal &amp; made it a legal compulsion for all social avenues seeking CSR funding. As per the notification released by MCA on April 1, 2021, CSR funding is only accessible to <a href=\"https:\/\/corpbiz.io\/ngo-registration\"><strong>NGOs<\/strong><\/a> that have CSR-1 registration at their disposal.&nbsp;<\/p>\n\n\n\n<p>The norms of the 2019 amendment to Companies Act, 2013 concerning CSR were introduced on Jan 22. In light of the new norms, every agency cited under&nbsp;sub-rule (1) will have to secure CSR registration after <a href=\"https:\/\/corpbiz.io\/ngo-csr-1-filing\"><strong>filing CSR-1 Form<\/strong><\/a> on the MCA&#8217;s portal.&nbsp;<\/p>\n\n\n\n<p>The CSR programmes approved before Apr 1, 2021, shall remain\nunaffected by these sub-rules provisions.&nbsp;<\/p>\n\n\n\n<p>&nbsp;After the successful filing of the form CSR-1, the MCA portal\nshall generate the unique registration number for future reference.&nbsp;<\/p>\n\n\n\n<p>In this way, the MCA will administer a list of all implementing companies, thereby ensuring timely fulfilment of proposed undertakings. Forms &amp; Features <\/a><\/mark><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fundamental_Documents_required_for_filing_CSR-1_form\"><\/span>Fundamental Documents required for filing CSR-1 form<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul>\n<li>12A and 80G registration order copy<\/li>\n\n\n\n<li>NGO&#8217;s PAN card<\/li>\n\n\n\n<li>Contact details such as contact\nnumber and email&nbsp;<\/li>\n\n\n\n<li>Digital Signature Certificate\nand PAN of the Chairperson<\/li>\n\n\n\n<li>Details of members serving the\norganization<\/li>\n\n\n\n<li>Registration certificate of\nSection 8 entity&nbsp;<\/li>\n\n\n\n<li>Trust Deed (for agency\noperating as Trust)<\/li>\n\n\n\n<li>Memorandum for a registered\nSociety<\/li>\n<\/ul>\n\n\n\n<p><strong><em>Form CSR-1 should enclose the digital signature of the given\nindividuals:&nbsp;<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Directors serving the Section 8\nentity<\/li>\n\n\n\n<li>Any one of trustees serving the\nRegistered Trust<\/li>\n\n\n\n<li>By Secretary\/Chairperson in\ncase of Registered Society<\/li>\n\n\n\n<li>Authorized signatory in case of\na company functioning under the ambit of State Legislature or Act of Parliament<\/li>\n\n\n\n<li>A Practising professional like\nCA or CS in practice&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Types_of_NGOs_having_access_to_CSR-1_registration\"><\/span>Types of NGOs having access to CSR-1 registration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><em><strong>NGOs that are legally eligible to furnish Form CSR-1 are as follows:&nbsp;<\/strong><\/em><\/p>\n\n\n\n<ul>\n<li>An entity functioning u\/s 8 of the Act, or a registered society or\nTrust, registered u\/s 12A &amp; 80G of the IT Act, 1961, established by the\nentity, either single or along with any other entity.&nbsp;<\/li>\n\n\n\n<li>An entity functioning u\/s 8 of the Act or registered society or a\nregistered trust, working under Central Government or State Government.<\/li>\n\n\n\n<li>Any entity functioning under an Act of a State legislature or\nParliament&nbsp;<\/li>\n\n\n\n<li>An entity functioning u\/s 8 of the Act, or a registered society or a registered trust, registered u\/s <a href=\"https:\/\/corpbiz.io\/80g-and-12a-registration\" title=\"12a and 80g registration online\"><strong>12A and 80G<\/strong><\/a> of the IT Act, 1961, 7 has a proven track record of minimum three years in undertaking same activities.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Important_Points_with_respect_to_filing_of_Form_CSR-1\"><\/span>Important Points with respect to filing of Form CSR-1<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul>\n<li>CSR-1 form is supposed to be filed with the ROC w.e.f&nbsp;day of April 2021.<\/li>\n\n\n\n<li>In the case of a company being formed by a company or group of companies, a maximum of 5 CIN(s) of such entities can be enclosed in the e-form.<\/li>\n\n\n\n<li>Email ID is required to be provided in the Form, which is further validated via One Time Password (OTP).<\/li>\n\n\n\n<li>The applicant can send One Time Password only after successful Pre-scrutiny of the Form.<\/li>\n\n\n\n<li>The One Time Password shall be routed to the registered email ID against one Form. The portal facilitates ten attempts to complete such a task. Once generated, OTP shall remain in effect for 30 minutes.&nbsp;<\/li>\n\n\n\n<li>Applicants failing to fulfil the said task in the given attempt can download the new Form and complete the filing on the same day.&nbsp;<\/li>\n\n\n\n<li>Check the validity of the DIN or PAN of the key management officials such as Directors\/CEO\/ Authorized Representatives before indulging in the registration process.&nbsp;<\/li>\n\n\n\n<li>Maximum of 10 rows shall be available for providing the details of key management officials of the company.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The advent of Form CSR-1 has enabled the tax authority to ensure better probing on NGOs&#8217; funding transactions. But that doesn&#8217;t imply that it will only benefit the tax authority. The timely filing of Form CSR-1 would enable the NGOs to curtail the legal hurdles during the funding campaign.
