This does not imply that the\naccuser has to be a party to the contract, but rather, he or she may opt for\nthe lawsuit if the deed is breaching their interest. <\/p>\n\n\n\n<p><strong><em>Required conditions<\/em><\/strong><\/p>\n\n\n\n<ul><li>The deed must be non-enforceable.\u00a0 <\/li><li>The deed is potentially destructive for the plaintiff<\/li><li>The case seems fit in the legal context. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"An_overview_on_Void_and_Voidable_Deeds\"><\/span>An overview on Void and\nVoidable Deeds<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>An agreement or\ninstrument that is non-enforceable from the legal standpoint shall stand\nvoidable u\/s Section 2(8) of the Indian Contract Act. A contract shall stand\nvoidable if and when:<\/p>\n\n\n\n<ul><li>Its consideration is baseless under the law.<\/li><li>It is found to be fraudulent. <\/li><li>Its manifests prejudice or has some detrimental elements. <\/li><\/ul>\n\n\n\n<p>Please note that\nthe contract shall be treated voidable if it entails the minor. <\/p>\n\n\n\n<p>An agreement\nthat is non-voidable by law, by the agreement of one or more parties but not so\nby the interest of other parties will be treated as a voidable contract. A deed\nshall stand non-enforceable if and when: <\/p>\n\n\n\n<ul><li>The agreement is drafted with illicit intention or entails misleading information. <\/li><li>Drafted by undue influence<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_concept_of_Reasonable_Apprehension\"><\/span>The concept of Reasonable\nApprehension<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Reasonable\napprehension is a part of Section 31 of the Specific Relief Act and it revolves\naround the notion of protective justice &amp;quia time. Reasonable apprehension\ndiffers case-wise as per the conditions of query or suit in particular. <\/p>\n\n\n\n<p><strong><em>Limitations<\/em><\/strong><\/p>\n\n\n\n<ul><li>Reasonable apprehension is not a right and therefore seeks a higher degree of discretion. <\/li><li>If both parties allegedly commit an equal fault, then the court might dismiss the claim as the accused is equally accountable. <\/li><li>If there exists an inadequacy of consideration<\/li><li>Cannot be filed during the lifetime of the testator. <\/li><\/ul>\n\n\n\n<p>Partial\ncancellation is only feasible when rights cited under the deed are unique, and\nin such cases, the request for compensation should be filed on priority in the\ncase.&nbsp; <\/p>\n\n\n\n<p><strong><em>Limitation<\/em><\/strong><\/p>\n\n\n\n<p>A gap of a\nperiod equal to 3 years for the deed\u2019s cancellation. <\/p>\n\n\n\n<p>As these cases\ntend to get complicated owing to heaps of legal conditions, it is good to\nleverage the services of a lawyer to find out the most precise solution. There\nhave been a lot of cases of such nature that continue to baffle the parties for\nlong and eventually reach a state where no conclusion can be drawn due to legal\ncontradiction.<\/p>\n\n\n\n<p>So it is\nadvisable to stay ahead of such anomalies by availing clarity on the case.\nConsult with your lawyer long enough to pinpoint applicable laws and weakest\nlinks in your case.&nbsp;&nbsp; <\/p>\n\n\n\n<p>Section 31 to 33 of the Specific Relief Act, 1963 laid down the conditions for cancellation of the sale deed.
