The expedition approval is filed under\nrule 24C of the Patent Rules, 2003. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Parties Associate<\/h3>\n\n\n\n<p>The applicants who are eligible to file for seeking approval for expediting patent can be the inventor himself or any third party interested. Now it is the responsibility of the <em><strong>Indian patent office<\/strong><\/em><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Indian_Patent_Office\"><em><strong>[1]<\/strong><\/em><\/a><\/sup> to consider all the applications for examination in the order in which the requests are filed. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Time Limit<\/h3>\n\n\n\n<p>The\ninventor is bound to submit the application within the time limit which shall\notherwise be treated as abandoned by the applicant. He\ncan apply for the approval with the prescribed fee by electronic transmission as\ngiven in the first schedule and must be duly authenticated within the time\nperiod of 48 months from the date of filing of appplication or the&nbsp; priority date application whichever date is\nearlier.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Under\nthe&nbsp; Rule 24A of the Patent Rules, 2003<\/h3>\n\n\n\n<p>An approval request for expedite\npatent examination shall go along with a request Under Rule 24A of the Patent\nRules, 2003 for early publication except where a request for publication has\nalready been applied or the application has been published. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Conversion\nof Request<\/h3>\n\n\n\n<p>Moreover, a request for normal\nexamination can be converted into a request for patent expedite approval examination\nby paying the prescribed fee and giving the required document.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Controller\u2019s\nDuty<\/h3>\n\n\n\n<p>After the filings of the request for\nexpedite patent examination and the publication of the application, it is the\nController\u2019s duty to refer the request for approving the examination together\nwith an application to the examiner in the order of all the requests.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Patent\nOffice Examiner<\/h3>\n\n\n\n<p>Then it is requisite for the patent\noffice examiner to examine the expedite patent application and make a report of\nit within one month but not taking more than two months from the reference date\nof the application to him.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The\nController\u2019s Action<\/h3>\n\n\n\n<p>The controller can dispose-off such\nreport of the patent office examiner within the period of one month from the\ndate of receipt report and if required the Controller can issue the first\nstatement of objections within fifteen days from the date of disposal of the\nreport.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Response\nwithin Time<\/h3>\n\n\n\n<p>Now finally within 6 months from the date of the examination\nreport a reply to the first objection statement is to be filed or the reply\nshould be filed within an extended period of 3 months because the patent office\nexaminer examines in the order in which it has received the responses.<\/p>\n\n\n\n<p>Furthermore, the Controller can\ndispose-off the application of expedite patent examination within a time period\nof three months from the receipt date or the last response to the first\nexamination report or within the time period of&nbsp;\nthree months from the last date to put the application in order for\ngrant. Though, where pre-grant opposition is filed the time limit shall not apply\nin that case.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\ninventor has got the right to request or seek approval for expedite patent\nexamination. The applicant can request the Indian Patent Office for early publication\nof his application. Such a request for publishing early permits the publication\nof the patent application before the 18 months time period from the priority\ndate. The Indian Patent Office usually publishes the application within 1 month\nfrom the date of request.<\/p>\n\n\n\n<p>It is imperative to broaden the categories of applicants who can seek the approval to expedite patent examination.
