Depending on the form of business, the trade name is registered under different Acts.<\/p>\n\n\n\n<p>However, all categories\nof Trademarks are registered under the Trademark Act. Any trade name is\neligible for registration expect in case of LLPs and companies.&nbsp; In company &amp; LLP, ministries do not\nauthorize the identical name. <\/p>\n\n\n\n<p>Ministry also avoids registering the trade name for LLP and\ncompany which is identical to a registered trademark. The registration period\nis also not same. The authority registered the trade name within 2 to 3 week;\nwhereas Trademark registration takes around 6 months or more. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Legal Protection&nbsp;<\/h3>\n\n\n\n<p>To protect a brand name, one has to opt for Trademark\nregistration. It renders legal protection for unlawful use of the brand name. &nbsp;It allows the owner to take advantage of legal\nproceeding in case any dispute related ownership of the assets that bear\ntrademark logo. <\/p>\n\n\n\n<p>It\u2019s important to note that trade name without a trademark\nprotection is vulnerable to infringement i.e. anybody can use without the\nconsent of the owner. The concept of \u201clegal\npresumption of ownership\u201d doesn\u2019t work here- meaning in case of dispute the\nburden of proof is on the owner rather than the person who allegedly using the\ntrade name. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Asset Creation<\/h3>\n\n\n\n<p>The trade name refers to name of a company or an entity. However, the trademark remains valid for not more than 10 years. If it is not renewed within the prescribed timeframe then one may dissolve all the rights under the Trademark Act.
