The assignee who\nreceives the assignment by the owner possesses the same rights regarding the\ncopyright as that of the owner. <strong><em>General or partial limits can be imposed by\nthe owner<\/em><\/strong> to the assignee to share mutual benefits in the copyrights. However,\nthe selling of the copyrighted work and granting the right to publish the work does\nnot amount to an assignment of copyright, its mere a publishing right. <\/p>\n\n\n\n<p>No assignments will be applicable where the work did not\nexist at the time of assignment of copyright. In the case of <strong><em>assignment\nof copyright for future shall take into effect when the work comes into\nexistence.<\/em><\/strong> When the assignee receives the copyrights, he shall be treated\nas the owner of the copyright. The legal representative in case of death of the\nassignee shall be entitled to the benefits of the assignment of copyright. <\/p>\n\n\n\n<ul><li>The literature work or a musical work used in a cinematography film or in a sound recording <strong><em>will entitle the owner of copyright to receive the royalties which cannot be waived off after assignment. <\/em><\/strong><\/li><li>Also, the right of receiving royalties cannot be waived off in the case where the author of literary work or a person of musical work does not perform in sound recording or cinematography film themselves.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Section_19-_Mode_of_Assignment_of_Copyright\"><\/span>Section 19- Mode of Assignment of Copyright<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The mode of the assignment of copyright under section 19 of the act can be done on the following conditions:<\/em><\/strong><\/p>\n\n\n\n<ul><li>The assignment of the copyright for any work can be assigned to an assignee <strong><em>in writing and duly signed by the assignor<\/em><\/strong> or by his agent. <\/li><li>The assignment of copyright shall specify the rights assigned, also <strong><em>mention the duration and territorial extent <\/em><\/strong>of the assignment.<\/li><li>The assignment of the copyright <strong><em>can be revised, extended or terminated<\/em><\/strong> on terms mutually agreed by the parties. <\/li><li>The assignment must <strong><em>contain a considerable payable amount paid to the author<\/em><\/strong> or his legal heirs during the assignment of copyright<\/li><li>If the assignee does not exercise his rights of the assignment of copyright <strong><em>within one year from the date of the assignment<\/em><\/strong>, then such rights shall be deemed to lapse. <\/li><li>If not specifically mention then assignment of copyright will <strong><em>last up to five years<\/em><\/strong>. <\/li><li>If not specifically mention then assignment of copyright will <strong><em>extend to the whole of India.<\/em><\/strong><\/li><li>Any <strong><em>work which is contrary to the terms and conditions<\/em><\/strong> of the assignment of copyright in the field where the author works <strong><em>shall be void.<\/em><\/strong> <\/li><\/ul>\n\n\n\n<p class=\"text-left\"><b>Read our article<\/b>:<mark style=\"background: #fffd03 !important\"><a href=\"https:\/\/corpbiz.io\/learning\/apply-for-online-trademark-registration-in-india\/\">How Can You Apply For Online Trademark Registration in India?<\/a><\/mark><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Section_19A-_Disputes_with_Respect_to_Assignment_of_Copyright\"><\/span>Section 19A- Disputes with Respect to Assignment of Copyright <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Appellate Board on receiving the complaint <strong><em>under\nsection 19(A)<\/em><\/strong> of the act on behalf of the party will conduct an inquiry\nas necessary. If the other party fails to comply with the terms and conditions mention\nat the time of assignment, then the Appellate Board can do the following:<\/p>\n\n\n\n<ul><li>Revoke the assignment <\/li><li>Recovery of any royalty payable<\/li><\/ul>\n\n\n\n<div class=\"shadow1\"><strong>Note:<\/strong>The Appellate Board shall make final orders within 6 months from the date of receiving of the complaint. In case of delay, the reasons shall be recorded by the Appellate Board for the same.(Given under section 19A (3) of the Copyright Act 1957).<\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Section_30-_Licensing_of_Copyright\"><\/span>Section 30- Licensing of Copyright <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The owner having copyright of an existing work or also for future\nwork may <strong><em>grant any interest in the copyright through a licence.<\/em><\/strong> The\nlicense can be granted by the <strong><em>owner in writing and duly signed by him<\/em><\/strong>\nor by an authorised agent. In the case of a licence relating to copyright for\nany future work, the licence shall take effect only when the work comes into\nexistence. The legal representative in the absence of any provision shall be\nentitled to the benefits of the license.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Section 30(A) Application <\/h3>\n\n\n\n<p>The provisions that were applicable in section 19 with\nnecessary adaptations and modifications in relation to the assignment of\ncopyright, in the same manner, will be applicable in the case of the license\ngiven by the owner. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The owner of copyright work can generate wealth by sharing his work with others for mutual benefits.
