An obvious change is not patentable. <\/li>\n\n\n\n<li>The proposed invention must be valuable and useful for patent rights. Any illegal or immoral purpose inventions will not be granted as a patent in India.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_Non-Patentable_In_India\"><\/span>What is Non-Patentable In India?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Under <strong><em>section 3 to 5 of the Indian Patent Act 1970<\/em><\/strong>,\nthe following is not inventions and non-patentable in India:<\/p>\n\n\n\n<ul>\n<li>Frivolous inventions and <strong><em>contrary to natural laws or contrary to public morality, order and law<\/em><\/strong> <\/li>\n\n\n\n<li>The invention intended to <strong><em>use for commercial exploitation<\/em><\/strong> and causes serious prejudice to plants or environment, animals and humans health&nbsp; <\/li>\n\n\n\n<li>Any <strong><em>mere discovery of a scientific principle<\/em><\/strong>, living or non-living thing already existing in nature, or, formulation of an any abstract theory<\/li>\n\n\n\n<li>Any <strong><em>mere discovery of a new form of the known substance<\/em><\/strong> or the known process of the machine or apparatus unless such discovery results in a new product or reactant. <\/li>\n\n\n\n<li>Mere a mixture resulting in the <strong><em>only aggregation of the new substance<\/em><\/strong> or process of producing such substance<\/li>\n\n\n\n<li>Mere <strong><em>duplication of the devices may be functioning differently<\/em><\/strong> from one another <\/li>\n\n\n\n<li>The <strong><em>method of doing horticulture or agriculture<\/em><\/strong><\/li>\n\n\n\n<li>The <strong><em>process of performing surgical, medicinal<\/em><\/strong>, curative, therapeutic, prophylactic diagnostic or <strong><em>other treatment for humans and animals<\/em><\/strong> <\/li>\n\n\n\n<li>The <strong><em>biological process of production or propagation of plants and animals<\/em><\/strong> in whole or any part including seeds, varieties, and species other than microorganisms<\/li>\n\n\n\n<li>A <strong><em>business method, mathematical solving<\/em><\/strong> or any computer programme<\/li>\n\n\n\n<li>A <strong><em>dramatic, literary, musical, artistic work<\/em><\/strong> which includes television productions, and cinematographic works<\/li>\n\n\n\n<li>A <strong><em>method of playing a game <\/em><\/strong>or <strong><em>scheme for performing a mental act<\/em><\/strong><\/li>\n\n\n\n<li>A presentation of information <\/li>\n\n\n\n<li>The topography of integrated circuits<\/li>\n\n\n\n<li>An <strong><em>invention which has traditional knowledge<\/em><\/strong> or duplication of components already in existence traditionally <\/li>\n<\/ul>\n\n\n\n<div class=\"shadow1\"><strong>Note:<\/strong> No patent shall be granted in respect of an invention relating to atomic energy falling within subsection (1) of section 20 of the Atomic Energy Act, 1962 (33 of 1962)<\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Benefits_to_obtain_Patent_in_India\"><\/span>Benefits to obtain Patent in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The patent in India provides encouragement in relation to new inventions and innovations. It keeps on motivating people to find and involve in making new discoveries and researches to give birth to a new innovative thing or idea to this world. Once patent a patent is granted, the person obtains the exclusive rights regarding the invention. Under <strong><em>section 73-76 of the Indian Patent Act, 1970 <\/em><\/strong>provides the details about the Patent Office in India and its establishment. The <strong><em>patent head office is in Kolkata<\/em><\/strong>, and the other offices are located in Delhi, Mumbai,<strong><em> and Chennai. <\/em><\/strong><\/p>\n\n\n\n<p class=\"text-left\"><b>Read our article<\/b>:<mark style=\"background: #fffd03 !important;\"><a href=\"https:\/\/corpbiz.io\/learning\/reasons-behind-trademark-registration-rejection\/\">Grounds for the Refusal of the Trademark Registration<\/a><\/mark><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_for_Patent_Registration_and_filing\"><\/span>Procedure for Patent Registration and filing<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The patent in India as per Patent Act 1970, <strong><em>under\nsection 6<\/em><\/strong> of the act an application is to be made by&nbsp; following (subject to the provisions of\nSection 134 of the act)<\/p>\n\n\n\n<ul>\n<li>the actual inventor <\/li>\n\n\n\n<li>assignee by the actual inventor<\/li>\n\n\n\n<li>a legal representative of the actual inventor<\/li>\n<\/ul>\n\n\n\n<p>An application can be made by any of the persons mention above either alone or jointly. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Steps_for_Patent_registration_in_India\"><\/span>Steps for Patent registration in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following is to be followed for getting patent rights in\nIndia:<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/02\/Patent-registration-in-India-Infographic-1024x683.png\" alt=\"Patent registration in India\" class=\"wp-image-2850\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/02\/Patent-registration-in-India-Infographic-1024x683.png 1024w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/02\/Patent-registration-in-India-Infographic-300x200.png 300w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/02\/Patent-registration-in-India-Infographic-768x512.png 768w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/02\/Patent-registration-in-India-Infographic.png 1200w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><figcaption class=\"wp-element-caption\">Patent registration in India<\/figcaption><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">Step 1<\/h3>\n\n\n\n<ul>\n<li>Form of application of patent in India\nprescribed <strong><em>under section 7<\/em><\/strong>&nbsp; is that\none application is to be made for the one invention only. An application for a\npatent in the <strong><em>prescribed form along with the prescribed fees should be filed<\/em><\/strong>\nin the appropriate office of the patent office.<\/li>\n\n\n\n<li>An <strong><em>international application<\/em><\/strong> filed\nunder the Patent Cooperation Treaty shall be considered under the Indian Patent\nAct if also corresponding application filed before the Controller in India <\/li>\n\n\n\n<li>An application is required to be <strong><em>filed\naccording to the territorial limits<\/em><\/strong> where the applicant or the first-mentioned\napplicant in case of joint applicants, for a patent, normally resides or has a domicile\nor has a place of business or the place from where the invention actually\noriginated. <\/li>\n\n\n\n<li>A foreign national resident abroad is <strong><em>not\nprohibited<\/em><\/strong> from making an application and obtaining a Patent in India.<\/li>\n\n\n\n<li>If the applicant for the patent in the proceeding\nis having no business places or domicile in India, then the appropriate office\nwill be according to the address of service given by the applicant in a\nproceeding.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Step 2 <\/h3>\n\n\n\n<ul>\n<li>The <strong><em>proof of the right to make a patent\napplication has to be given<\/em><\/strong> within the prescribed period after filing\nof the patent application.<\/li>\n\n\n\n<li>The <strong><em>application must have reason to believe that\nthe applicant is in possession<\/em><\/strong> of the invention and is the first and\ntrue inventor. <\/li>\n\n\n\n<li>A <strong><em>declaration is also to be made under section\n8<\/em><\/strong> of the act that no patent application s made in any other country\noutside India.&nbsp; <\/li>\n\n\n\n<li>Every application shall be <strong><em>accompanied by the provisional\nand complete specification under section 9 <\/em><\/strong>of the act. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Step 3<\/h3>\n\n\n\n<ul>\n<li><strong><em>Under section 11(A) <\/em><\/strong>&nbsp;of the Indian Patent Act 1970, the application <strong><em>shall not be ordinarily open to the public<\/em><\/strong> for a prescribed period of time or <strong><em>in case of the secrecy direction, abandoned or withdrawn <\/em><\/strong>within <strong><em>three months<\/em><\/strong> of the prescribed period. <\/li>\n\n\n\n<li>After the expiration of the prescribed period, the Controller shall publish the application.<\/li>\n\n\n\n<li>The publication of the application includes the <\/li>\n<\/ul>\n\n\n\n<ol>\n<li>Date of application and number of application<\/li>\n\n\n\n<li>Name and address of the applicant identifying the application<\/li>\n<\/ol>\n\n\n\n<ul>\n<li>The patent office <strong><em>requires a payment fee<\/em><\/strong> to make specifications and drawings on such application.<\/li>\n<\/ul>\n\n\n\n<div class=\"shadow1\"><strong>Note:<\/strong> From the date of the publication of the application till date of grant of patent in India, the applicant have privileges and rights regarding the patent for the invention. <\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Step 4<\/h3>\n\n\n\n<ul>\n<li><strong><em>Under section 11(B),<\/em><\/strong> the application of patent shall be examined when the applicant or any interested person makes a request for the examination in a prescribed manner. <\/li>\n\n\n\n<li>In case the applicant does not make any request for examination of a patent application, then it would be considered as withdrawn.<\/li>\n\n\n\n<li><strong><em>Under section 12,<\/em><\/strong> the <strong><em>Controller has to examine<\/em><\/strong> the patent application and other documents as required under the act.<\/li>\n\n\n\n<li>Then further objections if any can be raised on the lawful ground.<\/li>\n\n\n\n<li>If no objections are raised <strong><em>under section 21<\/em><\/strong> and all other documents in relation to an application are complete, then the Controller <strong><em>forwards the patent application for grant of patent<\/em><\/strong>.<strong><em> <\/em><\/strong><\/li>\n<\/ul>\n\n\n\n<div class=\"shadow1\"><strong>Note:<\/strong>The appeal is made to the High court under section 12 (2) in respect of the patent application. <\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Step 5<\/h3>\n\n\n\n<p><strong><em>Under Section 43<\/em><\/strong> of the act says that if application not\nrefused by the Controller and also the application not found in contravention\nto any of the provisions of the act, then an application for patent is now\nconverted into <strong>Grant of Patents. <\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Takeaway\"><\/span>Takeaway <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The <strong><em><a href=\"https:\/\/corpbiz.io\">Corpbiz<\/a><\/em><\/strong> has a team of professionals dealing with the cases related to <strong>IPR <\/strong>specifically dealing with copyrights, trademarks, and patent registration process and filing.
