However, note that trademark application withdrawal means that you would surrender your legal rights, where other businesses can claim the same.<\/p>\n\n\n\n<p class=\"text-left\"><b>Read our article<\/b>:<mark style=\"background: #fffd03 !important\"><a href=\"https:\/\/corpbiz.io\/learning\/a-trademark-application-for-foreign-nationals-is-it-possible-in-india\/\">A Trademark Application for Foreign Nationals: Is it Possible in India?<\/a><\/mark><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Admissible_Amendments_under_the_Regime_of_Trademarks_Act_1999\"><\/span>Admissible Amendments under the\nRegime of Trademarks Act, 1999<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Below mentioned are the admissible amendments under the Trademarks Act, 1999, which are as follows:-<\/em><\/strong><\/p>\n\n\n\n<ul><li>Alteration in the name, address, or description of the registered proprietor.<\/li><li>To cancel the entry of a trademark on the Register<\/li><li>Amendment in the user data<\/li><li>Amendment in the specification of goods or services.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Persons_who_can_Follow_the_Procedure_to_Cancel_the_Trademark_Application\"><\/span>Persons who can Follow the Procedure to Cancel the Trademark Application <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>A person who is not happy with\nthe trademarked benefits can go through with the procedure to cancel the trademark\napplication. <\/li><li>A person who is engaged in the\ntrademark registration can fulfill the procedure to cancel the trademark\napplication on the grounds provided under the Trademark Act, 1999.<\/li><li>The trademark registrar can\ncancel the trademark application voluntarily if the specified brand mark is not\nregistered yet or when there is no renewal after completing 10 years of the\ntrademark.<\/li><li> As per section 58 of the Trademark Act 1999, the registered proprietor can legally get cancel the trademark application from the register. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conditions_for_Withdrawal_of_Trademark_Application\"><\/span>Conditions for Withdrawal of Trademark Application <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section 47, 50 and 57 of the Trademark Act, 1999 talks about the grounds on which individual can withdraw the trademark application, which are as follows :-<\/p>\n\n\n\n<ul><li>Trademark has no bonafide\nuse for five years from the date of its registration, and such period of five\nyears has completed.<\/li><li>A registered trademark is\nused in such a way that it misleads or makes confusion among the people.<\/li><li>The proprietor has misrepresented or failed to present any\nmaterial facts related to it in the trademark application for registration,\nwhich, if properly disclosed, would not justify such registration.<\/li><li>Any alteration or Change\nin the condition of the brand have been noticed after registration that its\nregistration is not validated.<\/li><li>When there is a\ncondition provided in the Register of Trademarks regarding any violation or\nfailure to observe it, any person can file for cancellation of registration.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Which_Authority_Cancels_the_Submitted_Trademark_Application\"><\/span>Which Authority Cancels the Submitted\nTrademark Application?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Trademark application for cancellation is submitted under whose jurisdiction a trademark registration takes place i.e. the Registrar or the Appellate board. The registrar is the appropriate authority for the trademark application for its cancellation. Simultaneously, Intellectual Property Appellate Board is the Appellate Board for Trademarks in India. Authority can cancel the trademark once they find that the applicant has fulfilled the procedure to cancel the trademark application<\/p>\n\n\n\n<p> The Trademark Appellate Boards&#8217; office is situated at five places in India, i.e., Chennai, Delhi, <em><strong>Mumbai<\/strong><\/em><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Mumbai\"><em><strong>[1]<\/strong><\/em><\/a><\/sup>, Kolkata, and Ahmadabad. The said request for cancellation is either given to the Registrar or Appellate Board. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_to_Cancel_the_Trademark_Application_under_Trademark_Act_1999\"><\/span>Procedure to Cancel  the Trademark Application under Trademark Act, 1999<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In case the applicant wants to withdraw the application for the trademark voluntarily. It has been submitted online, and the status for the same in the Indian Trademark Registry is viewed and marked online as &#8216;withdrawn&#8217; Registrar of the trademark.<\/p>\n\n\n\n<p>But sometimes the said application could also be withdrawn if the Hearing Officer or Trademark Officer has failed to accept the trademark application. Withdrawal effectively denotes that the application will not affect, and is treated as cancelled.<\/p>\n\n\n\n<ul><li>After the cancellation\napplication is made to either the Registrar or the Appellate Board, the\nauthority will send a notice to the concerned parties, i.e., the owner of\nproprietor of registered trademark. <\/li><li>The concerned parties can file\ncounter statements against the application before the Registrar.<\/li><li>A chance is given to both\nparties to defend themselves, and the burden of proof lies on them.&nbsp;<\/li><li>Both parties have the right to\nfile pieces of evidence and hearing their cases will occur.<\/li><li>After successful hearing and\nscrutinizing of the evidence furnished by both parties, the order shall be\npassed.<\/li><li>In case the Registrar makes an\norder of cancellation on the cases presented before him, he shall execute it by\nremoving the trademark from his register.<\/li><li>The order passed by the\nRegistrar can be made to the appellate before the Appellate Board.<\/li><li>If the application is before\nthe Appellate Board directly, they should follow the same procedure as that of\nCivil matters in the court.<\/li><li>Civil court procedure is\nsimilar as it is followed in the Registrar of the Trademark.<\/li><li>In case the Appellate Board\npassed an order for cancellation, then intimation for the same shall be\nconferred to the Registrar to cancel the trademark.<\/li><li>A writ petition to the High\nCourt can be filed&nbsp; against the order\npassed by the Appellate Board.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"On_what_Grounds_an_Applicant_Faces_an_Objection_for_Trademark_Application\"><\/span>On what Grounds an Applicant\nFaces an Objection for Trademark Application?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>If an applicant made a trademark application to the authority, he might face such an objection from the trademark officer when examining such application; or an opposition made by the other interested parties when the applicant trademark is advertised in Trademarks Journal for a fresh enrollment.<\/p>\n\n\n\n<ul><li>When an applicant receives a notice of\nobjection or&nbsp;opposition, it requires\nfiling a counter statement for the same before the registrar within a specified\ntime limit. <\/li><li>Opitonally, he may&nbsp; also withdraw his application voluntarily by\nusing the online withdrawal application form. <\/li><li>Once the specified time limit expired and\nthere is no such&nbsp; response given to the\nexamination report or opposition&nbsp;notice, it&#8217;s firmly believed &nbsp;that the applicant&nbsp; is not interested in carrying forward the\ntrademark&nbsp;registration<\/li><li>This automatically will lead to the\nabandonment of the trademark application and usually no extension provided by\nthe authority in such situation.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Specific_Forms_Subject_To_Trademark_Application_Cancellation\"><\/span>Specific Forms Subject To Trademark Application Cancellation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img decoding=\"async\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2021\/01\/Specific-Forms-Subject-To-Trademark-Application-Cancellation.png\" alt=\"Specific Forms Subject To Trademark Application Cancellation\" class=\"wp-image-25092\" width=\"530\" height=\"203\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2021\/01\/Specific-Forms-Subject-To-Trademark-Application-Cancellation.png 985w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2021\/01\/Specific-Forms-Subject-To-Trademark-Application-Cancellation-300x115.png 300w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2021\/01\/Specific-Forms-Subject-To-Trademark-Application-Cancellation-768x295.png 768w\" sizes=\"(max-width: 530px) 100vw, 530px\" \/><\/figure><\/div>\n\n\n\n<p>The Trademarks Rules, 2017, provides the forms that must be submitted before the Registrar for trademark application cancellation. The trademark application is accompanied by these forms for submitting cancellation to the Registrar. The below-mentioned are the said form for trademark application cancellation.  <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Form TM-O<\/h3>\n\n\n\n<p>This is the form of canceling a\ntrademark application on the conditions provided under Section 47 and 57 of the\nsaid Act.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Form TM \u2013 U<\/h3>\n\n\n\n<p>This is the form for a trademark\napplication for removal of entry of a trademark under the condition in Section\n50 of the said Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Concluding_Remark\"><\/span>Concluding Remark<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Under the subjected trademark act, the cancellation of the trademark application is also provided, and the held responsible authority is also embodied with their procedural norms. When applying for such cancellation, either the applicant could apply before the trademark registration or application before the Appellate board. <\/p>\n\n\n\n<p>The concerned authorities shall circulate a notice related to such objections against the related opposite parties and ask for their statement on the issue.
