As per the said law, the\npassing off is a common law remedy; meanwhile, the infringement action is a\nstatutory remedy.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Infringement<\/h3>\n\n\n\n<p>Section 29 of the\nTrademarks Act, 1999, talks about the trademark Litigation on Infringement.\nTrademark infringement is an act of violation of rights conferred to the owner\nof the registered trademark. An infringer of the trademark registered is an\nindividual who is involved in the unauthorized uses of the mark which:-&nbsp;<\/p>\n\n\n\n<ul><li>Adheres to duplicity\nconcerning the original mark.<\/li><li>Is used for\ncommodities or services which aren&#8217;t identical to those for which the trademark\nregistration is availed; and&nbsp;<\/li><li>The registered\ntrademark has earned ample goodwill in India and the use of the mark without\nlegal ground taking unfair advantage of or deteriorating the reputation of a\nregistered trademark.&nbsp;<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Passing Off<\/h3>\n\n\n\n<p>Trademarks Act,\n1999 still lacks a clear explanation of the term &#8220;passing off.&#8221;\nSection 27 of the Trademarks Act, 1999 talks about the common law rights of the\nowner to take legal action against the defaulter for passing off his goods as\nthe goods of another individual or as services rendered by another individual\nor the remedies thereof.&nbsp;<\/p>\n\n\n\n<p><strong><em>For passing off action, some imperative elements require to be established. The following list talks about the same.<\/em><\/strong><\/p>\n\n\n\n<ul><li>Misrepresentation,<\/li><li>The act ought to be made by the defendant during Business,&nbsp;<\/li><li>The end-users or consumers of the applicant&#8217;s goods &amp; services have been tricked by wrongful presentation,<\/li><li>Such an act is executed to hinder the reputation of the plaintiff&#8217;s business, and&nbsp;<\/li><li>Such an act leads to actual damage to the business both in terms of goodwill and revenue.<\/li><\/ul>\n\n\n\n<p>In action for\npassing off, the defendant&#8217;s motive doesn&#8217;t really matter from a legal\nviewpoint.
