It is to encourage the intentional development and majority rule working\nof co-agents as individuals&#8217; organizations dependent on self-improvement and\nshared guide. <\/p>\n\n\n\n<p>The Act also\nempowers the organizations to advance their monetary and social improvement. This Section lays down that No multi-State co-operative can be registered under this act unless and until its main objective is to serve the members not only in one state but members in more than one state and also the bye- laws must provide for the social and economic betterment of all its members. <\/p>\n\n\n\n<p>This can be done\nthrough society which shall be registered under this self-help and mutual aid\nin accordance with the co-operative principles. Furthermore, <strong><em>Section\n6 of MSCS Act<\/em><\/strong> 2002 provides for application of registration which shall\nbe made to the Central Registrar in such form with such particulars as may be\nprescribed. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Application has to be Signed<\/h3>\n\n\n\n<ul>\n<li>It is required to be signed by at least fifty\npersons from each of the concerned state<\/li>\n\n\n\n<li>It has to be authorized by representatives on\nbehalf of at least five such societies as are not registered in the same state<\/li>\n\n\n\n<li>It has to be authorized by representatives of\neach society<\/li>\n\n\n\n<li>The application should be accompanied by 4\ncopies of the proposed bye-laws of the multi-state cooperative society and the\nindividual by whom or on whose behalf such application is made should provide\nsuch information in regard to society as the registrar may need.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Process for Registration<\/h3>\n\n\n\n<p><strong><em>Following are the steps to register a Co-operative Society:-<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>10 persons are essential who are willing to form a Society;<\/li>\n\n\n\n<li>Provisional Committee and a chief Promoter has to be elected from those individuals;<\/li>\n\n\n\n<li>Name of the Society has to be unique.<\/li>\n\n\n\n<li>An application is essential to be made to relevant Authority for name reservation and for authorizing the reserved name;<\/li>\n\n\n\n<li>Entrance fees as well as Share Capital has to be collected from the potential members.<\/li>\n\n\n\n<li>As per the directions of the Authority, a bank account is required to be opened in the name of the proposed Society;<\/li>\n\n\n\n<li>Registration fees is required to be deposited with Reserve Bank of India (RBI) and get receipt Challan.<\/li>\n\n\n\n<li>An application has to be submitted to Registrar of Societies of the concerned Municipal Division for <a href=\"https:\/\/corpbiz.io\/society-registration\"><strong>Society Registration<\/strong><\/a>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Required_Documents_for_Setting_up_a_Multi-State_Cooperative_Society\"><\/span>Required Documents for Setting\nup a Multi-State Cooperative Society<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Documents required for registration of Multi State Cooperative Society are as follows-<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>A duly signed four copies of proposed Bye-Laws\nmust be submitted ;<\/li>\n\n\n\n<li>List of contributors to the share capital as\nwell as the list of contributors and the details of contribution of capital;<\/li>\n\n\n\n<li>A certificate from the bank which shows the\ncredit balance in the account of the desired cooperative society;<\/li>\n\n\n\n<li>A scheme showing indicating financial\nreasonability of the proposed society and further express that enlistment of\nsociety will be valuable for the social and monetary advancement of the\nindividuals.<\/li>\n\n\n\n<li>A resolution which provides the name and address\nof chief promoter;<\/li>\n\n\n\n<li>A copy of resolution in the favor of person who\nis authorized to make the Bye-Laws.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_is_Application_supposed_to_have_been_accepted\"><\/span>When is Application supposed to\nhave been accepted?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul>\n<li>The application can be disposed of by Registrar\nwithin a period of 4 months <\/li>\n\n\n\n<li>If the registration application is not disposed\nof within a period of 4 months then the application shall be deemed to have\nbeen accepted for registration<\/li>\n\n\n\n<li>Later, a registration certificate shall be\nissued.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Process for Passing the Refusal\nOrder<\/h3>\n\n\n\n<ul>\n<li>When the Central Registrar refuses to list a\nMulti State co-operative society, he will provide the opportunity to the\nsociety to be heard before passing such instructions;<\/li>\n\n\n\n<li>The registrar has to communicate, within a\nperiod of 4 months from the date of receipt of the application for\nincorporation. The order of refusal together with the reasons provided to the\napplicants, as the case may be.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Other Relevant Provisions<\/h3>\n\n\n\n<p>Under <strong><em>Section\n8 of the MSCS Act<\/em><\/strong>, it is mentioned that a certificate of registration\nwill be issued by the Central Registrar which will be a conclusive evidence of registration\nof the society.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Benefits_of_Registering_Multi-State_Cooperative_Society\"><\/span>What are the Benefits of\nRegistering Multi-State Cooperative Society?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The\nBenefits of Registering Multi State Cooperative Society are as follows-<\/em><\/strong><\/p>\n\n\n\n<p>Chapter VI of\nMSCS Act offers for privileges of Multi-State Cooperative society that are\nstated as follows:-<\/p>\n\n\n\n<ul>\n<li>A Multi-State Cooperative Society can charge and\nset-off in regard of offer or commitment or interest of individuals.<\/li>\n\n\n\n<li>Share of contribution or interest is not liable\nas an addition to the Society.
