The business operator is also obliged to comply\nwith the provisions of the act, if the person fails, a legal notice regarding\nthe same would be sent to the person. If the business operator further fails to\naddress the legal notice too, the FSSAI license may be suspended as\nconsequence.<\/p>\n\n\n\n<p>As\nper the provisions of the act, each and every individual who has participated\nin commission of an offence along with the company will held liable and will\nhave to face the charges. <\/p>\n\n\n\n<p>As\nfor a company that holds multiple branches over the country or world, the head\noffice is held accountable for the offences under the FSSAI in that case. If\nthe investigation proves the involvement of the top tier officials of the\ncompany such as directors, manager, secretary etc., then the said party will be\nheld guilty and will have to face the charges accordingly. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"List_of_Punishable_offences_under_FSSAI_2006\"><\/span>List of\nPunishable offences under FSSAI, 2006<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The offences under FSSAI that are held punishable under the <strong><em>FSSAI Act<\/em><\/strong> are mentioned in <strong><em>Section 50 to Section 67<\/em><\/strong>. <\/p>\n\n\n\n<p><strong><em>Now, let\u2019s discuss the offences under FSSAI with their punishment or penalties:<\/em><\/strong><\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter is-resized\"><img decoding=\"async\" class=\"wp-block-heading\">Selling the Food\nItem which is not as per the Quality of FSSAI<\/h3>\n\n\n\n<p>If\nany business operator is found selling food that is not with compliance of the\nFSSAI, or fails to meet the requirement of the buyer in respect of nature,\nsubstance or quality, then the operator would be held liable to pay the penalty\nof not more than INR 5 lakhs as per the <strong><em>Section 50<\/em><\/strong>. <\/p>\n\n\n\n<p>However, if the business operator comes under the umbrella of <strong><em>Section 31(2)<\/em><\/strong>, that is, if he is a petty hawker, vendor etc., then the limit of penalty will not exceed INR 25 Thousand. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"> Fine on Sub-standard Food<\/h3>\n\n\n\n<p>If\na business operator himself, or any other person on his behalf manufactures,\nsells, stores food that do not meet the required standard (sub-standard food),\nis liable to pay a fine that will not exceed the amount of INR 5 Lakhs as per <strong><em>Section\n51<\/em><\/strong> of the act. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Fine on\nMisbranded Food<\/h3>\n\n\n\n<p>If\na business operator himself, or any other person on his behalf manufactures,\nsells, stores, import, export, etc. any kind of food that has been misbranded,\nis liable to pay a fine of not exceeding Rs 3 lakhs. <\/p>\n\n\n\n<p>However,\nunder this offence, the adjudicating officer can issue a notice to the offender\nto either rectify his mistake or to destroy the food items that has been\nmisbranded as per the <strong><em>Section 52<\/em><\/strong>. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Fine on\nMisleading Advertisement<\/h3>\n\n\n\n<p>Any\nbusiness operator who publishes or is involved in publishing a misleading\nadvertisement with deceiving intentions that may cause confusion among the\npeople with mediocre mind-set is liable to pay a fine of amount not exceeding\nRs 10 lakhs as per <strong><em>Section 53<\/em><\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Fine for Selling\nFood Consisting Extraneous Matter<\/h3>\n\n\n\n<p>Any\nbusiness operator either by himself or through somebody else is involved in\nselling food articles that consist of extraneous matter, then he is liable to\npay a fine not exceeding the amount of Rs 1 lakh as per <strong><em>Section 54<\/em><\/strong>. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Fine on Operating\na Food Business without the FSSAI License<\/h3>\n\n\n\n<p>If\na business operator is caught running a business without a food license, he is\nliable to pay a fine of not exceeding the amount of INR 5 lakhs and\nimprisonment of 6 months.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Fine upon Failure\nto Compliance with the Safety and Health Measure as per FSSAI<\/h3>\n\n\n\n<p>If\na business operator either himself or through somebody else is involved in\nmanufacturing or processing food for human consumption under untidy conditions,\nthen the person is liable to pay a fine of amount not exceeding Rs 1 lakh. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Fine upon\nFailure to comply with the Directions given by the Food Safety Officer<\/h3>\n\n\n\n<p>If\na business operator or importer fails to run by the rules and regulations given\nby the Food Safety Officer without any reasonable grounds, then the person is\nliable to pay a fine of amount not exceeding INR 2 lakh.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Fine on Performing\nAdulteration<\/h3>\n\n\n\n<p>Adulteration\nis punishable under <strong><em>Section 57<\/em><\/strong> of the act. If a business operator is found\nperforming adulteration that is not injurious to health, is liable to pay a\nfine for not exceeding the amount of INR 2 lakhs, and if the adulteration is\ninjurious to health, then the person is liable to pay a fine not exceeding INR\n10 lakhs.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Punishment for Producing\nUnsafe Food<\/h3>\n\n\n\n<p>A\nbusiness operator is found producing unsafe food:-<\/p>\n\n\n\n<ul><li>If the unsafe food did not result into any kind\nof injury, then the business operator is liable for imprisonment for 6 months\nand fine not exceeding INR 1 lakh. <\/li><li>If unsafe food resulted into non-grievous\ninjury, then the business operator is liable for imprisonment for 1 year and\nfine not exceeding INR 3 lakh.<\/li><li>If the unsafe food caused grievous injury, then\nthe business operator is liable for imprisonment for 6 years and fine not\nexceeding INR 5 lakh. <\/li><li>If the unsafe food leads to a death, then the\nbusiness operator is liable for imprisonment for not less than 7 years and\nwhich could be extended to life imprisonment and fines not less than INR 10\nlakh. <\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Punishment for Providing\nFalse Information<\/h3>\n\n\n\n<p>If\nany person is found providing misleading and deceiving documents to the FSSAI,\nthen the person will be liable to pay fine not exceeding the amount of Rs 2\nlakhs along with 3 months of imprisonment. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Punishment for Interference\nwith Seized Items<\/h3>\n\n\n\n<p>If\na person is found to be interfering with the seized goods for example,\ntampering, retaining or removing the food items, without the permission of the\nFood safety officer, the person would be held liable to face an imprisonment of\n3 months and a fine not exceeding INR 1 lakh. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Punishment for Harassing\nthe Food Officer<\/h3>\n\n\n\n<p>If\na person is found threatening, intimidating or assaulting the food officer\nwithout any reasonable grounds, while the officer is on duty, the person is\nliable to face imprisonment for the term of 3 months and is liable to pay a fine\nnot exceeding the amount of INR 1 lakh. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Punishment in Case\nof Subsequent Offence<\/h3>\n\n\n\n<p>If\na person is found repeating the offences twice, he is liable to face the double\nof the punishment that has been imposed in the earlier case. Also the person\ncould be held liable to pay fine on a daily basis which may extend to INR 1\nlakh. In a few cases, even the FSSAI license could be cancelled.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Compensation_in_Case_of_a_Customers_Death\"><\/span>Compensation in\nCase of a Customer\u2019s Death<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>If\na business operator himself, or any other person on his behalf manufactures,\nsells, stores, import etc. any kind of food that has caused bodily harm, then\nthe business operator is liable to pay-<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In case of Injuries<\/h3>\n\n\n\n<p>Compensation\nto be paid not exceeding INR 1 lakh.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In case of Grievous\nInjury<\/h3>\n\n\n\n<p>Compensation\nto be paid not exceeding INR 3 lakh.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">In case of\nDeath<\/h3>\n\n\n\n<p>Compensation\nto be paid not exceeding INR 5 lakh.<\/p>\n\n\n\n<p>The\ncompensation amount must be paid within 6 months from the occurrence of the unfortunate\nevent, and in the case of death, the amount must be paid within 30 days.<\/p>\n\n\n\n<p><strong><em>However, in cases of grievous injury and death, the court may pass\norder such as:<\/em><\/strong><\/p>\n\n\n\n<ul><li>Suspension of the license<\/li><li>Taking food off the market<\/li><li>Seizing the property <\/li><li>May issue prohibition orders<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Imported_Food_Item_Contravening_with_the_Provisions_of_the_FSSAI\"><\/span>Imported Food\nItem Contravening with the Provisions of the FSSAI<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Foreign\nTrade development and regulation act deals with the imported food items that\ncontravene with the provisions of the FSSAI. If the appropriate authority\npermits the use of the imported product, then the product shall be returned to\nits owner. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A person is authorised to run a food business, only if the said person has acquired the FSSAI license. FSSAI acts under the <em><strong>Ministry of Health and Welfare<\/strong><\/em><sup><a href=\"https:\/\/www.mohfw.gov.in\/\"><strong>[1]<\/strong><\/a><\/sup><strong><em> <\/em><\/strong>and intend to safeguard the people from consumption of low-quality foods and services. <\/p>\n\n\n\n<p>The Food Safety and Standard Authority Act 2006 has provided certain provisions for certain offences under FSSAI such as penalties and punishments.
