It\u2019s mandatory for Private Security Agencies to obtain license for their operation, issued by the <strong>state controlling authority<\/strong>. The said Act states, that if a person or agency is willing to set security business in India needs to obtain the PSARA license from controlling authority. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Eligibility_and_Requirement_Criteria_for_Online_PSARA_License\"><\/span>Eligibility and Requirement Criteria for Online PSARA License  <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Who can apply?<\/h3>\n\n\n\n<p>An Individual, <a href=\"https:\/\/corpbiz.io\/partnership-firm-registration\" title=\"Partnership Firm Registration\">Partnership Firm<\/a>, <a href=\"https:\/\/corpbiz.io\/one-person-company\" title=\"Partnership Firm Registration\" \"=\"\">One Person Company<\/a>, <a href=\"https:\/\/corpbiz.io\/llp-registration\" data-type=\"URL\" data-id=\"https:\/\/corpbiz.io\/llp-registration\">LLP<\/a>, <a href=\"https:\/\/corpbiz.io\/company-registration\" data-type=\"URL\" data-id=\"https:\/\/corpbiz.io\/company-registration\">Private Limited Company<\/a> is qualified to apply for PSARA License.&nbsp; The qualified company can make an application to the concerned state competent authority for registration of Private Security Agency.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What should be the name and\nobject of applicant?<\/h3>\n\n\n\n<p>The name of\nthe entity should contain the word security service or any other related word,\nwhich can represent the object. Where applicant is a company, Memorandum of\nAssociation must contain <strong>\u2018Providing of\nSecurity Company\u2019<\/strong> as its main object of the company. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What should be Director\u2019s eligibility?<\/h3>\n\n\n\n<p>Director\nshould be an Indian resident, who should have sound financial standing\n(Required to submit a copy of ITR). Person should not be sentenced for any\noffence and ought to have a perfect precursor past.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">MOU with Training Institute <\/h3>\n\n\n\n<p>The applicant must have entered into\nan MOU with the institute or organisation engaged in providing training to the\nsecurity guard. The institute should be approved by the state controlling\nauthority. In such training programs, special relaxation is being provided to\nthe ex-servicemen.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">National Interest Cause <\/h3>\n\n\n\n<p>PSARA license cannot be issued to the person who is found to be associated or linked with any organisation or association, which is banned under the Indian Law\/Government. <\/p>\n\n\n\n<p>If an association is found to be working against the national security, or engaged in any activity which is prejudicial to national security, govt. Do not grant PSARA license to such associations.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Restriction of Foreign Investment\n<\/h3>\n\n\n\n<p>As per <strong>section 6(2) of The Private Security Agencies (Regulation) Act, 2005<\/strong>, PSARA license will not be issued, if an entity is not registered in India, or having proprietorship or a majority of shareholder, partners or Director of outside India.<\/p>\n\n\n\n<p class=\"text-left\"><b>Read our article<\/b>:<mark style=\"background: #fffd03 !important;\"><a href=\"https:\/\/corpbiz.io\/learning\/who-cannot-apply-for-psara-license-eligibility-criteria\/\">Who cannot apply for PSARA License? Eligibility Criteria<\/a><\/mark><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Persons_not_eligible_for_PSARA_license\"><\/span>Persons not eligible for PSARA license <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>According to Private Security Agencies Act, 2005, a person shall not be eligible for issue of a license under this Act, if he has been\u2014&nbsp; <\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Applicant who is convicted for an offence in connection with\npromotion, formation or management of a company including an undischarged\ninsolvent; or <\/li>\n\n\n\n<li>If an applicant is convicted by a competent court for an offence,\nfor which prescribed punishment is imprisonment of not less than two years; or <\/li>\n\n\n\n<li>If applicant is keeping links with any organisation or association\nwhich is banned under any law on account of their activities which are threat\nto the national security or public order or there is information about such a\nperson indulging in activities which are prejudicial to national security or\npublic order; or <\/li>\n\n\n\n<li>If applicant is dismissed or removed from Government service on\nthe grounds of misconduct or moral turpitude;<\/li>\n<\/ul>\n\n\n\n<p>&nbsp;A company, firm or an association of persons\nshall not be considered for issue of a license under this Act, if, they are not\nregistered in India, or having a proprietor or a majority shareholder, partner\nor Director, who is not a citizen of India.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_Required_For_PSARA_License_in_Uttar_Pradesh\"><\/span>Documents Required For PSARA License in Uttar Pradesh <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul>\n<li>Residential\nProof of Proprietor \/Partners \/ Director;<\/li>\n\n\n\n<li>Date of\nBirth Proof which can be ( Adhar \/ PAN )&nbsp;of Proprietor \/ Partners \/\nDirectors;<\/li>\n\n\n\n<li>Three\nPhotographs&nbsp; of&nbsp;Proprietor \/\nPartners \/ Directors;<\/li>\n\n\n\n<li>Affidavit as\nper PSARA Act ;<\/li>\n\n\n\n<li>Rent \/ Lease\nAgreement ( In case where premises on Rent );<\/li>\n\n\n\n<li>No Objection\nCertificate ( N.O.C ) (In case where premises on Rent);<\/li>\n\n\n\n<li>Ownership\nProof of Business Premises;<\/li>\n\n\n\n<li>Signed MOA\nwith Training Institute <\/li>\n\n\n\n<li>Memorandum\nof Associations ( In case of Pvt. \/ Limited \/ OPC \/ Company );<\/li>\n\n\n\n<li>Certificate\nof Incorporation ( In case of Pvt. \/ Limited \/ OPC \/ Company );<\/li>\n\n\n\n<li>Partnership Deed ( In case of Partnership Firm );<\/li>\n\n\n\n<li>E-mail\nAddress;<\/li>\n\n\n\n<li>Demand Draft\nRs. 500\/- of Proprietor \/Partners \/ Director;<\/li>\n\n\n\n<li>Three Year\nIncome Tax Return ( 10,00,000\/- Yearly );<\/li>\n\n\n\n<li>Guard \/\nSupervisor Photo with Uniform;<\/li>\n\n\n\n<li>Identity\nCard of Agency;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Govt_Fee_for_PSARA_License_in_Uttar_Pradesh\"><\/span>Govt. Fee for PSARA License in Uttar Pradesh <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Following is the fee structure in Uttar Pradesh for applying for Online PSARA license in Uttar Pradesh are;<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li><strong>In entire Uttar Pradesh &#8211;<\/strong><\/li>\n<\/ul>\n\n\n\n<p>For\nproviding services security services in entire Uttar Pradesh prescribed govt. fee\nis 25,000\/-. (Twenty Five Thousand Rupees Only);<\/p>\n\n\n\n<ul>\n<li><strong>For Five District in Uttar Pradesh &#8211;<\/strong><\/li>\n<\/ul>\n\n\n\n<p>For\nproviding services security services in five districts of Uttar Pradesh\nprescribed govt. fee is 10,000\/-. (Ten Thousand Rupees Only);<\/p>\n\n\n\n<ul>\n<li><strong>For Single District &#8211;<\/strong><\/li>\n<\/ul>\n\n\n\n<p>For providing\nservices security services in five districts of Uttar Pradesh prescribed govt.\nfee is 5,000\/-. (Five Thousand Rupees Only).<\/p>\n\n\n\n<div class=\"shadow1\"><strong>Note:<\/strong> Draft in the Name Of \u2018NIYANTRAK PRADHIKARI\/A.D.G. L&amp;O UP. LUCKNOW &#8216;. <\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Renewal_of_PSARA_license\"><\/span>Renewal of PSARA license<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul>\n<li>An\napplication of Renewal is required to be made to the controlling authority.\nApplication shall be made not less than forty days before the expiry of\nlicense.<\/li>\n\n\n\n<li>Application\nshall be made with the requisite fee, and other documents shall be furnished\naccording to section 6, 7, 8 of the <strong>Private\nSecurity Agencies Act, 2005.<\/strong><\/li>\n\n\n\n<li>Controlling\nauthority required to pass an order on the renewal application of license\nwithin 30 days from the date of receiving complete applicant\u2019s renewal\napplication.<\/li>\n\n\n\n<li>After\nreceiving applicant&#8217;s renewal application, controlling authority will make a\nnecessary enquiry if authority finds any inquiry is required.<\/li>\n\n\n\n<li>Further,\ncontrolling authority by order in writing will renew the license or can refuse\nthe same. <\/li>\n\n\n\n<li>NO order in\nrespect of license refusal shall be passed without providing the reasonable\nopportunity of being heard to the applicant. <\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Validity_of_PSARA_License\"><\/span>Validity of PSARA License<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Usually,\nPSARA license is valid for 5 years in many of the states of India. However, in\nthe states like Uttarakhand and Chhattisgarh, the license is valid only for 1\nyear.&nbsp;&nbsp; <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Eligibility_of_Security_Guard\"><\/span>Eligibility of Security Guard;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Private security can employ any person as a private security guard;<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Who is a Citizen of India <\/li>\n\n\n\n<li>Who has attained the age of eighteen years, but has not attained\nthe age of sixty-five years;<\/li>\n\n\n\n<li>A person can satisfy the agency about his character in such a\nmanner prescribed under the Act; <\/li>\n\n\n\n<li>A person who has successfully completed security training;<\/li>\n\n\n\n<li>Completely fulfils such physical standards as required to be a\nsecurity guard; and <\/li>\n<\/ul>\n\n\n\n<p>No such person can be appointed as a security guard who has been convicted by a competent court or who has been dismissed or removed on the grounds of misconduct, during his govt. Service tenure.<\/p>\n\n\n\n<p>Every\nprivate security agency while employing a person as a private security guard, shall\nprovide first preference to the person who is from the background of;<\/p>\n\n\n\n<ul>\n<li>Army; <\/li>\n\n\n\n<li>Navy;<\/li>\n\n\n\n<li>Air Force; <\/li>\n\n\n\n<li>Any other armed forces of the Union;<\/li>\n\n\n\n<li>Police, including armed constabularies of States; and <\/li>\n\n\n\n<li>Home Guards.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Cancellation_or_Suspension_of_PSARA_License\"><\/span>Cancellation or Suspension of PSARA License;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The Controlling Authority may cancel any license on the following reasons;<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>If the License holder has obtained a license on misrepresenting of fact while applying for the license. <\/li>\n\n\n\n<li>If the license holder has forged documents or photographs in respect of obtaining a license. &nbsp;<\/li>\n\n\n\n<li>If the license holder has violated the provisions of this Act or the rules made there under or any of the conditions of the license.<\/li>\n\n\n\n<li>If the private security agency had failed to commence its activities or to engage a supervisor within the specified time period.<\/li>\n\n\n\n<li>If the license holder is or has willfully failed or refused to provide the services agreed to any person; <\/li>\n\n\n\n<li>If the license holder has violated court order or an order of a lawful authority;<\/li>\n\n\n\n<li>If a license holder has violated the provisions of the Acts prescribed by the Central Government;<\/li>\n\n\n\n<li>If repeated instance by private security guards provided by the private security agency is committed such as;\n<ul>\n<li>In case where agency fails to provide private security;<\/li>\n\n\n\n<li>Where security guards have committed a breach of trust or misappropriated the property where they are appointed <\/li>\n\n\n\n<li>If security guards were found habitually drunker or indiscipline; <\/li>\n\n\n\n<li>If Security guards were found to be involved in committing crimes.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p><a href=\"https:\/\/corpbiz.io\" title=\"Corpbiz Advisors\"><strong>Corpbiz<\/strong><\/a> is the current market leader in providing and renewing the PSARA License.
