It can be a word, a letter, a picture, device label, or a\ncombination. It also acts as a tool by using which general public can\ndifferentiate between the goods &amp; services offered to them.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Law Suit<\/h3>\n\n\n\n<p>A civil action was taken in the court by the plaintiff\n(the person, who claims to have suffered the loss) against the defendant (the\nperson, who allegedly have caused the loss). <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Infringement of Trademark<\/h3>\n\n\n\n<p>When a person who is not the owner of a trademark, uses\nthe proposed mark with mala-fide intent to create a false identity among the\ncustomers with the average mindset in the course of trade, is called\ninfringement. <\/p>\n\n\n\n<p>In other words, if any person uses another person&#8217;s\nregistered trademark and claims to own it, it is a case of infringement. The primary\ncondition is that the trademark should be registered before initiating an action\nfor infringement. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ingredients_for_Initiation_of_Suit_for_Trademark_Infringement\"><\/span>Ingredients for Initiation of\nSuit for Trademark Infringement<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Ingredients which\nmust be there to initiate a suit for Trademark infringement action are as\nfollows-<\/p>\n\n\n\n<ol><li>The\nTrademark should be either identical or deceptively similar to the registered mark.<\/li><li>The\ngoods &amp; services should be specifically covered by the registration of\ntrademark.<\/li><li>The\nutilization of the alleged infringing trademark should be &nbsp;in the trade course; and <\/li><li>One\nmust make the use of the allegedly infringed trademark as a trademark. <\/li><\/ol>\n\n\n\n<p>As per the law,\nonce a trademark is registered under a specific person for specific goods and\nservices, he or she holds the exclusive right of that trademark in relation to\nthe said good or service.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Provisions_Related_to_Suit_for_Trademark_Infringement\"><\/span>Provisions Related to Suit for\nTrademark Infringement<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Provisions related to the filing of Suit for Trademark Infringement provided in Trademark Act, 1999 are explained below-<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" width=\"1000\" height=\"375\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2021\/01\/Provisions-Related-to-Suit-for-Trademark-Infringement.png\" alt=\"Provisions Related to Suit for Trademark Infringement\" class=\"wp-image-23946\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2021\/01\/Provisions-Related-to-Suit-for-Trademark-Infringement.png 1000w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2021\/01\/Provisions-Related-to-Suit-for-Trademark-Infringement-300x113.png 300w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2021\/01\/Provisions-Related-to-Suit-for-Trademark-Infringement-768x288.png 768w\" sizes=\"(max-width: 1000px) 100vw, 1000px\" \/><\/figure><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Section 27(1)<\/h3>\n\n\n\n<p>Section 27(1)\nof the Trademark Act, 1999 specifically entitles a person to initiate a legal\nproceeding to prevent infringement and recover damages of infringement of his\nregistered Trademark. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Section 28<\/h3>\n\n\n\n<p>Section 28\nconfers upon the registered proprietor the right to exclusively use his\nregistered Trademark and to obtain relief against the person who is an unauthorized\nway uses the trademark.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Section 29<\/h3>\n\n\n\n<p>Section 29 of the\nAct provides for infringement of trademarks. The section provides nine\nsubsections that enumerate different ways in which infringement occurs. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Conditions provided u\/s 29<\/h4>\n\n\n\n<p>There are certain\nconditions provided in section 29(1), 29(2), 29 (3) which must be fulfilled to\ninitiate a legal proceeding for Trademark infringement, are given below:-<\/p>\n\n\n\n<ul><li>The alleged infringed trademark must be a\nregistered trademark;<\/li><li>The person who has been allegedly infringing the\nTrademark should not be the original creator or the registered owner of the\nconcerned trademark;<\/li><li>The person who is causing the infringement must\nuse it in the course of business or trade;<\/li><li>The person must use the trademark without the\nauthorization. <\/li><li>The alleged infringing trademark must be\nidentical or similar to the registered trademark to initiate the legal\nproceedings. <\/li><li>The infringed trademark must be related to the\nclass of goods and services under which the actual owner has registered its\ntrademark.<\/li><li>The infringed trademark must be used in a manner\nin which a trademark is used. (To cause confusion or deceive the buyers into\nbelieving that the infringed trademark is the original one). <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Constitutes_the_Use_of_a_Trademark\"><\/span>What Constitutes the Use of a\nTrademark?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According to Section 29(6) of The <strong>Trademark&nbsp;Act, 1999<\/strong><sup><a href=\"https:\/\/www.indiacode.nic.in\/handle\/123456789\/1993?locale=en\"><strong>[1]<\/strong><\/a><\/sup>, the use by a person means:-<\/p>\n\n\n\n<ul><li>When a person offers the goods for sale under\nthe name of the registered trademarks<\/li><li>When a person stocks the goods for sale or\nintends to expose them for sale in the market under the registered trademark.<\/li><li>When a person offers supplies services under the\nregistered trademarks<\/li><li>When a person imports or exports goods under the\nregistered trademark<\/li><li>When a person uses the registered trademark on\nbusiness papers.<\/li><li>When the trademark is used by the person for\nadvertising. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Case_Laws_on_Trademark_Infringement\"><\/span>Case Laws on Trademark\nInfringement<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>There are few important case laws\nassociated under the trademark Infringement, which are as follows:-<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Glaxo Smith Kline Pharmaceuticals\nLtd. v. Unitech Pharmaceuticals Private Ltd., Decided on 16th December 2005\nDelhi High Court.<\/h3>\n\n\n\n<p>The plaintiff\nalleged that the defendant\u2019s mark Fexim is deceptively similar to the\nregistered Trademark \u201cPhexin\u201d which is used for pharmaceutical preparations. <\/p>\n\n\n\n<p>The packing\nmaterial was also deceptively similar, and it was claimed by the plaintiff that\nthe intention of the defendant is not only to infringe the trademark, however,\nalso to pass off the goods as both the marks are also phonetically similar. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">M\/s Bikanervala v. M\/s Aggarwal\nBikanerwala, 17 (2005) DLT 255<\/h3>\n\n\n\n<p>The plaintiffs\nwere running his business under the Trademark \u201cBIKANERVALA\u201d and alleged that\nrespondent\u2019s Trademark \u201cAGGARWAL BIKANERWALA\u201d claiming that the said Trademark\nis deceptively similar to the Trademark of the plaintiff who was used from 1981\nand also got registered it in the year 1992. <\/p>\n\n\n\n<p>The judgement was\npassed by the court in favour of plaintiff. The defendant was restrained from\nproducing, selling or advertise any food article under the trademark &#8216;AGGARWAL\nBIKANERWALA&#8217; <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Exceptions_to_Infringement_Actions_Section_34\"><\/span>Exceptions to Infringement\nActions (Section 34)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>There are certain exceptions against the infringement of\nthe Trademark, and the exceptions are mentioned in Section 34. The act states\nthat the proprietor or a registered user of registered Trademark cannot\ninterfere or put restrain on the use by any person of a Trademark similar to\nhis if the other person has continuously used that Trademark from a date prior-<\/p>\n\n\n\n<ul><li>to the use of the first stated Trademark with\nrelation to those goods or services be the owner or a forerunner in their title;\nor<\/li><li>to the registration date of the first stated Trademark in\nrespect of the goods or services in the name of the owner of a forerunner in their\ntitle;<\/li><li>Whichever is the earlier<\/li><\/ul>\n\n\n\n<p>The Registrar should not refuse (on such use being\nproved) to register the second Trademark by reason only to the registration of\nthe first stated Trademark.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Remedies_Available_Against_Suit_for_Trademark_Infringement\"><\/span>Remedies Available Against Suit\nfor Trademark Infringement<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According to the provisions of the Trademarks Act 1999, the <a href=\"https:\/\/corpbiz.io\/trademark-registration\"><strong>registration of a trademark<\/strong><\/a> is not a pre-requisite to avail the criminal or civil remedies if the rights of a party are violated. Both civil and criminal remedies can be availed in India against infringement and passing off. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Civil Remedies<\/h3>\n\n\n\n<p>For the civil remedies, one can seek aid from the\nprovisions of the Sections 134 &amp;135 of the Trademarks Act, 1999, under\nwhich the court grant relief in any suit for infringement or for Passing Off\nincluding the Permanent &amp; Interim injunction. Injunction is to put an order\nto stop.&nbsp; <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Criminal Remedies<\/h3>\n\n\n\n<p>Section 103 of the Trademarks Act, 1999 provides the\nprovision under which criminal remedies can be availed for the encroachment.\nInfringement of a trademark is a punishable offence under which, the offender\nis punished with imprisonment for a term of 6 months to 3 years and with fine ranging\nfrom 50,000 but which may extend to INR 200,000.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Being a legal\nright, Section 134 of the Trademarks Act, 1999 provides the jurisdiction for\nfiling of suit for Trademark Infringement. According to the provisions, a Trademark\ninfringement Suit can be instituted before a District Court underlining the\nlocal limits of whose jurisdiction, at the time of the institution of the suit\nor other proceeding.
