Ever since 1998, ETSI has\njoined services with five other standardization bodies to form the global 3rd\nGeneration Partnership Project (3GPP), mainly for the standardization of UMTS.\nThe political initiative is that competitors\u2019 technology must be made available\nto other network companies or mobile phone companies.<\/p>\n\n\n\n<p>Therefore, particularly in the mobile communications sector, standard essential patents (SEPs) are reported by the patent possessor as vital to the standardization organization \u201cEuropean Telecommunications Standards Institute\u201d (ETSI). By doing so, they embark on to license these patents to rivals on reasonable, non-discriminatory and fair (FRAND) terms in harmony with ETSI\u2019s Intellectual Property Right (IPR) Directive. The USA\nhas just a year ago distanced itself from its own affirmation of principles of\n2013 and it wants to make it easy for patent holders to take legal action in\ncase of a denial of a license agreement.<\/p>\n\n\n\n<p>Now a court case\nhas been filed regarding the forthcoming 5 G standard. Legal action initiated\nby Ericsson against Samsung on Friday before the District Court of EASTERN\nDISTRICT OF TEXAS in US. Ericsson against Samsung stated for not complying with\nits obligations in view of FRAND rules for SEP and requests the court to assert\nthat Ericsson itself has acted in compliance with FRAND.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_Issue_of_case-_Ericsson_against_Samsung\"><\/span>What is the Issue of case- Ericsson against\nSamsung?&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The background to this is the fact that, even\nthough there were wide-ranging licensing agreements for the preceding standards\n(2G, 3G and 4G), for the new standard 5G these licenses will have to be\nrenegotiated or they will expire anyway.<\/p>\n\n\n\n<p>In 2019, proposal hence started\nnegotiations for new license contracts. As per Ericsson, the Swedes made a\nFRAND-compliant proposal, which included a compensation payment. Though,\nSamsung rejected this proposal. Samsung, in turn, asked that Ericsson agree to\na compensation payment in a worldwide cross-license, which the Swedes said was considerably\nlower than Ericsson\u2019s SEPs under the FRAND provisions.<\/p>\n\n\n\n<p>Therefore, Ericsson\nagainst Samsung have already shown willingness to negotiate. This is not insignificant\nwith regard to competition law rules. For abuse in the sense of Art. 102 TFEU\n(with the right to claim for damages and injunctive relief) take place when the\nuser looking for a license makes a proposal in accordance with FRAND but the\npatent holder does not agree to it. In this context, the patent holder is also anticipated\nto make a counter-offer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Permanent_Dispute_FRAND_Conditions\"><\/span>Permanent Dispute: FRAND\nConditions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The FRAND conditions are always the point of conflict because <em><strong>ETSI<\/strong><\/em><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/ETSI\"><em><strong>[1]<\/strong><\/em><\/a><\/sup> is a politically preferred compromise. European Telecommunications Standards Institute neither controls whether intellectual property rights are legally applicable for an SEP nor whether they are even important.  Also, every patent holder decides for himself regarding <a href=\"https:\/\/corpbiz.io\/patent-registration\"><strong>Patent Registration<\/strong><\/a> with ETSI as an SEP. Above all, nevertheless, the term \u201clicense under FRAND conditions\u201d is not explicated by ETSI.<\/p>\n\n\n\n<p>Conversely, there\nis still no consistent legal clarity and obligatory force in many questions regarding\nSEPs and FRAND conditions from the courts.<\/p>\n\n\n\n<p>What are \u201cfair\u201d\nlicense conditions? To what degree may patentee\u2019s agreements with third parties\nbe used for assessment purposes? Or may nationalized courts determine what is\nto be measured \u201cfair\u201d? The same applies to the issue: Who has the burden of\nproof for FRAND conformity? Who is accountable for the FRAND obligation if an\nSEP is reassigned to another holder? And how is compensation calculated in case\nof violation?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Does_it_come_to_a_Judgment_at_all\"><\/span>Does it come to a Judgment at\nall?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In this respect, it\nwill be very fascinating to observe the lawsuit filed by Ericsson against\nSamsung in the further course of the discussions. Ericsson claims that Samsung\nhas dispossessed Ericsson of its right to an equal worldwide license to\nSamsung&#8217;s vital patents on reasonable and fair terms. <\/p>\n\n\n\n<p>However, it is just\nas likely that a contract between the parties will be done, this can without\ndoubt be seen as a trend in the sector of mobile telecommunications: Apple vs.\nSamsung, Huawei vs. Qualcomm, Apple vs. Qualcomm, Nokia with Xiaomi and Unwired\nvs. Huawei (in DE).<\/p>\n\n\n\n<p>Anyway, this year,\nSamsung contributes approx. 22% of the global sales of 5G smart phones with its\nmodels of the Galaxy S20 series and hence leads the competition by far. Samsung\nis also a supplier and manufacturer of network infrastructure. With Ericsson\nagainst Samsung, the big names in mobile telecommunications and network\ntechnology are crossing swords \u2013 by 5G.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A court case has been filed regarding the forthcoming 5 G standard.
