The search for existing trademarks and\npending applications can be done on the website of the Office of Controller\nGeneral of Patents, Designs, and Trademarks.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Identifying the Classes of Goods and Services<\/h3>\n\n\n\n<p>The 4th Schedule of the Trademarks\nRules 2002 provides for the classification of goods and services. There are a\ntotal of 45 classes classified in the fourth schedule. It is very important to\nchoose the class in which you seek protection for your trademark. India follows\nthe Nice Classification system for the classification of goods and services.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Filing of Trademark Application<\/h3>\n\n\n\n<p>Trademark application has to be\nfiled with the trademark registrar after the search for a trademark is\ncompleted. Delhi, Kolkata, Mumbai, and Chennai are the four offices for the\nregistrar of trademarks. <\/p>\n\n\n\n<p>The application should be filed in\nthe registry under whose jurisdiction the primary place of business of the\napplicant falls. The Trademark application form is generally called a <strong><em>Form TM-1<\/em><\/strong>.\nThe TM-1 form is to be submitted with the required documents and the prescribed\nfees.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Details_Required_to_be_Mentioned_in_the_Trademark_Application\"><\/span>Details Required to be Mentioned in the Trademark\nApplication<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following details are required to\nbe specified in the application for trademarks:-<\/p>\n\n\n\n<ol>\n<li>Name,\naddress, and nationality of the applicant.<\/li>\n\n\n\n<li>Nature\nof the party (Incorporation, Partnership, Proprietorship)<\/li>\n\n\n\n<li>Types\nof trademark.<\/li>\n\n\n\n<li>Class\nof Goods &amp; Services under which the trademark is to be filed.<\/li>\n\n\n\n<li>Language\nof the Trademark.<\/li>\n\n\n\n<li>Translation\nof the trademark, if required.<\/li>\n\n\n\n<li>Date\nof first use, if any.<\/li>\n\n\n\n<li>Jurisdiction\nof the trademark in case of any dispute.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_Required_to_be_submitted_along_with_Trademark_Application\"><\/span>Documents Required to be submitted along with\nTrademark Application<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following documents are required\nto be submitted while filing along with the trademark application-<\/p>\n\n\n\n<ol>\n<li>Copy\nof the logo.<\/li>\n\n\n\n<li>Power\nof Attorney.<\/li>\n\n\n\n<li>Statement\nof use.<\/li>\n\n\n\n<li>Priority\napplication, if needed.<\/li>\n\n\n\n<li><a href=\"https:\/\/corpbiz.io\/msme-registration\" title=\"MSME Certificate\"><strong>MSME certificate<\/strong><\/a>, if any.<\/li>\n\n\n\n<li>Incorporation\nCertificate or Partnership deed.<\/li>\n<\/ol>\n\n\n\n<p>E- Filing of the trademark\napplication can also be done on the official website of the Office of\nController General of Patents, Designs, and Trademarks.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Verification by the Trademark Registrar<\/h3>\n\n\n\n<p>After the application of a\ntrademark has been made, the registrar verifies the uniqueness of the\ntrademark, by checking the existing and pending trademarks. The registrar can\nreject, completely accept, or ask for modifications and amendments. <\/p>\n\n\n\n<p>He can also accept the application subject to certain\nlimitations. If there is any trademark objection found in the application by\nthe registrar, the applicant is informed in writing about the objection.\nA prescribed time is given to the applicant for rectification of the issue.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_for_Trademark_Objection\"><\/span>Process for Trademark Objection<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Even after the trademark is published, a third party can challenge the registration of the trademark.<\/p>\n\n\n\n<p><strong><em>The detailed process for Trademark objection proceedings will be described below-<\/em><\/strong><\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\"><img decoding=\"async\" width=\"1000\" height=\"310\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/12\/The-detailed-procedure-of-the-Trademark-objection-proceedings-will-be-described-below.png\" alt=\"Trademark Objection and Proceedings\" class=\"wp-image-22555\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/12\/The-detailed-procedure-of-the-Trademark-objection-proceedings-will-be-described-below.png 1000w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/12\/The-detailed-procedure-of-the-Trademark-objection-proceedings-will-be-described-below-300x93.png 300w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/12\/The-detailed-procedure-of-the-Trademark-objection-proceedings-will-be-described-below-768x238.png 768w\" sizes=\"(max-width: 1000px) 100vw, 1000px\" \/><\/figure><\/div>\n\n\n<h3 class=\"wp-block-heading\">Filing of the process for Trademark Objection Application<\/h3>\n\n\n\n<p>Section 21 of the Act prescribes the procedure for raising an Objection against the <a href=\"https:\/\/corpbiz.io\/trademark-registration\" title=\"Trademark Registration\"><strong>trademark registration<\/strong><\/a> of the trademark. Within four months of the publication of the trademark, an Objection application can be filed by submitting the TM-O form along with the specified fees. <\/p>\n\n\n\n<p>This application is reviewed, and if the registry feels satisfied, a notice is served to the opposite party. The requirements of the notice of process for Trademark Objection is prescribed under Rule 43 of the Trademark Rules, 2017 (hereinafter referred to as &#8216;Rules&#8217;).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Filing of a Counter Statement<\/h3>\n\n\n\n<p>A counter-statement has to be filed\nby the original applicant of the trademark against the Objection within a\nperiod of two months from the date of receipt of the notice. The\ncounter-statement has to be filed on a TM-O form along with the prescribed\nfees.<\/p>\n\n\n\n<p>If no counter-statement is filed\nwithin this period, the application is considered to be abandoned by the\napplicant. Such counter-statement is also reviewed by the registry. Rule 44\nprovides the details on filing a counter-statement. A counter-statement is also\nto be verified by the registry according to the Sub Rule (2), (3), and (4) of\nRule 43.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Evidence in Support of the process for Trademark Objection<\/h3>\n\n\n\n<p>According to Rule 45, the Objection\ncan present the evidence in support of his claim within two months from the\nservice of a copy of a counterstatement. He can also abstain from submitting\nany evidence if he wants to rely on facts, but he has to inform this to the\napplicant and the Registrar.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Evidence in Support of Trademark Application<\/h3>\n\n\n\n<p>As provided under Rule 46, the\napplicant can also submit any required evidence in support of his application\nwithin a period of 2 months from the service of copies of evidence provided by\nthe opposite party. If he does not take any action within this period, the\napplication is considered to be abandoned by the applicant.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Evidence in Reply<\/h3>\n\n\n\n<p>Within one month of the service of\ncopies of evidence provided by the applicant, the opposite party can provide\nthe evidence in reply with the evidence furnished by the applicant. If the\nRegistrar feels necessary, he can allow any party to provide further evidence.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Hearing and Decision<\/h3>\n\n\n\n<p>After the submission of the\nevidence, the registrar sets up the hearing for which both the parties are\nnotified. The parties have an option of adjournment of the hearing for a\nreasonable cause by filing a TM-M form along with the prescribed fee. The\nnumber of adjournments is restricted to 2 for each party.<\/p>\n\n\n\n<p>The Registrar after hearing to the\nparties and examining the evidence decides whether the trademark should be\nregistered or not. The decision of the Registrar is communicated in writing to\nboth the parties, to the addresses provided by them.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"International_Registration_of_Trademarks\"><\/span>International Registration of Trademarks<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The world has a global economy, so\nany company wants to expand its businesses in other countries. To ensure the\nselling of the products and services in other countries, it is necessary to\nregister trademarks. The registration of trademarks is territorial in nature. It\nis necessary to file individual applications to register trademarks in\ndifferent countries.<\/p>\n\n\n\n<p>The Madrid Protocol is the most\neffective way of registering a trademark in many countries. Around 91 countries\nhave joined the Madrid Protocol. India is a member of the Madrid Protocol since\n8th July, 2013. Madrid Protocol is very useful and cost-effective than filing\nan individual application to every country.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p> Section 21 of the <strong>Trademark Act<\/strong><sup><a href=\"https:\/\/www.indiacode.nic.in\/handle\/123456789\/1993?locale=en\"><strong>[1]<\/strong><\/a><\/sup> prescribes the process for Trademark Objection.
