So as for the purpose of controlling foreign contribution or foreign grants received by any individual, organisation, or corporation, the Government has incorporated laws and guidelines to identify such contributions.&nbsp; Herewith this blog, we will try to understand why and how Societies, Charitable trust, and Section 8 companies receiving funds from foreign needs to obtain FCRA registration <strong>section 6 (1), FCRA Act 2010<\/strong>, <a href=\"https:\/\/corpbiz.io\/learning\/forfeiture-of-exemption-to-charitable-trust-ngo\/\"><strong>Charitable Trusts<\/strong><\/a>, Societies, and Section 8 companies that receive a foreign contribution or any donation from a foreign source, are required to obtain FCRA registration. Such registration and contributions are regulated under the Foreign Contribution Regulation Act, 2010.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_Foreign_Contribution\"><\/span>What is Foreign Contribution?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>According to Section 2 (1) (h) of FCRA Act 2010, \u2018\u2019Foreign Contribution\u2019\u2019 means the donations, delivery or transfer made by any foreign source; <\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Under this\nclause, a donation, delivery, any currency received by any person who&nbsp; has received any&nbsp; grant, which is from any foreign resource,\neither directly or through one or more person;<\/li>\n\n\n\n<li>According to\nsub-section (1) of section 17, the interest accumulated on the foreign\ncontribution deposited in any bank or any income derived from foreign\ncontribution shall also be counted as foreign contribution.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_types_of_FCRA_Registration\"><\/span>What are the types of FCRA Registration?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>FCRA registration is characterised in two kinds \u2013<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Permanent&nbsp; FCRA Registration <a href=\"https:\/\/fcraonline.nic.in\/FC3.aspx?Resp_Id=1\">https:\/\/fcraonline.nic.in\/FC3.aspx?Resp_Id=1<\/a> <\/li>\n\n\n\n<li>Prior Permission&nbsp; <a href=\"https:\/\/fcraonline.nic.in\/FC3.aspx?Resp_Id=6\">https:\/\/fcraonline.nic.in\/FC3.aspx?Resp_Id=6<\/a>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Permanent FCRA Registration; <\/h3>\n\n\n\n<p>Such registration can be\nperformed when non- government organisation is running from 5year.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Prior Permission;<\/h3>\n\n\n\n<p>Such Certification is possible\nwhen non- government organisation is running from 1 year.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_can_be_the_applicant_for_FCRA\"><\/span>Who can be the applicant for FCRA?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>For applying FCRA applicant should be registered under as;<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Society Registration Act,1860;<\/li>\n\n\n\n<li>Indian Trust Act, 1882;<\/li>\n\n\n\n<li>Section 8 of companies act,2013<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_Eligibility_Criteria_for_obtaining_FCRA_Registration\"><\/span>What is the Eligibility Criteria for obtaining FCRA Registration?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Eligibility for <strong>Prior Permission<\/strong>;<\/p>\n\n\n\n<ul>\n<li>The applicant\u2019s\norganisation shall be running for at least 1 year;<\/li>\n\n\n\n<li>The\napplicant needs to furnish the details of foreign donors, along with their\ncredentials. The association detail form will be displayed. Enter following details;<\/p>\n\n\n\n<ul>\n<li>Darpan\nID <\/li>\n\n\n\n<li>Address\nof Association<\/li>\n\n\n\n<li>Registration number<\/li>\n\n\n\n<li>Place of registration<\/li>\n\n\n\n<li>Date of registration<\/li>\n\n\n\n<li>Nature of association<\/li>\n\n\n\n<li>Main aim of the  association<\/li>\n<\/ul>\n\n\n\n<p>Click on submit button and save data<\/p>\n\n\n\n<p><strong>Executive Committee Form<\/strong><\/p>\n\n\n\n<ul>\n<li>Now go to Executive Committee Form.<\/li>\n\n\n\n<li>Enter all details about Executive Committee.<\/li>\n\n\n\n<li>To add further foreigner details, select\ncheckbox of the record <\/li>\n\n\n\n<li>A new screen will be displayed, add related\nforeigner details. You can able to Edit\/Delete Record by clicking on the\nappropriate option.<\/li>\n<\/ul>\n\n\n\n<p><strong>Bank Details<\/strong><\/p>\n\n\n\n<p>Here, furnish your bank details such as Bank Name, IFSC code, Account\nNumber, Address of the bank.<\/p>\n\n\n\n<p><strong>Other details Section<\/strong><\/p>\n\n\n\n<ul>\n<li>Click on Other Details option from the menu to provide all other information.<\/li>\n<\/ul>\n\n\n\n<p><strong>Upload documents<\/strong><\/p>\n\n\n\n<ul>\n<li>Now, you have to upload all relevant documents in PDF format.<\/li>\n<\/ul>\n\n\n\n<p><strong>Final Submission<\/strong><\/p>\n\n\n\n<ul>\n<li>Click on final submission from the menu bar<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>Once you submitted finally, a pop-up window will appear, click on OK.<\/li>\n<\/ul>\n\n\n\n<p><strong>Online payment<\/strong><\/p>\n\n\n\n<ul>\n<li>click on Make Online Payment button from the menu\nbar<\/li>\n\n\n\n<li>Click on Continue for Payment button in this\nscreen.
