In layman language, when an exclusive right of the owner of the Trademark is violated, it constitutes to be a Trademark Infringement. A trademark registration offers the exclusive rights to the brand name of the owner of the registered trademark, who can be the applicant of the Trademark. In case, any third party uses the brand name in course of business without prior permission of the owner, it known to be the violation of owner\u2019s right.<\/p>\n\n\n\n<p><strong><em>Section 30 of the Trademark Act<\/em><\/strong>\ntalks about certain situations that are not considered as Trademark infringement.\nIf any person has the license from the owner of the registered Trademark then\nit is not covered under infringement as the license is allowed by assignment\nagreement. There a few basics\nare to be met for a direct infringement of Trademark; those are as follows:-<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Use by an Unauthorized Person<\/h4>\n\n\n\n<p>The violation of any trademark only\noccurs when the mark is used by a person who is not authorized or allowed by\nthe owner of the registered trademark. If the mark is used with the permission of\nthe owner of the registered trademark, it does not comprise to Trademark infringement.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Identical or Deceptively Similar<\/h4>\n\n\n\n<p>The trademark used by the unauthorized\nperson needs to be either identical or deceptively similar to that of the\nregistered trademark. The term \u2018<strong><em>deceptively similar\u2019<\/em><\/strong> means that the\ncommon buyer may be confused between the marks and think them of being of the same\nbrand. As long as there is a chance of misrepresentation of the trademark, it\nis sufficient for proving trademark infringement.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Registered trademark<\/h4>\n\n\n\n<p>The Trademark Act only provides\nprotection to trademark that has been registered with the <strong><em>Trademark Registry of India<\/em><\/strong>.\nIn the case of infringement of any unregistered mark, the common law of passing\noff can be used to settle the disputes. <strong><em>Passing off<\/em><\/strong> is a <strong><em>Law\nof Tort<\/em><\/strong> that can be used when the injury or damage is caused to the\ngoodwill linked with the activities of any other person.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Class of Goods &amp; Services<\/h4>\n\n\n\n<p>For Trademark infringement, the illegal\nuse of the trademark has to be used for the dissemination of Goods &amp;\nServices that falls under the same class of any registered trademark.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Indirect Infringement<\/h3>\n\n\n\n<p>Different from direct infringement,\nthere is no proviso in the Trademark Act that deals with indirect infringement exclusively.\nThis does not state that there is no legal responsibility for indirect\ninfringement of trademark. There are two types of indirect infringement, they\nare as follows-<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Vicarious liability<\/h4>\n\n\n\n<p>As per <em><strong>Section 114 of the Trademark Act<\/strong><\/em><sup><a href=\"https:\/\/indiankanoon.org\/doc\/292232\/\"><strong>[1]<\/strong><\/a><\/sup>, if any business owner commits any offence under this provision, then the entire company will be liable for Indirect Infringement. Those people who acted in good faith and without knowledge of the infringement they won\u2019t be liable for Trademark infringement.<\/p>\n\n\n\n<p><em>The\nessentials for vicarious liability are as follows-<\/em><\/p>\n\n\n\n<ul><li>The person can control the activities of the\nprincipal infringer;<\/li><li>The person knows about the infringement and also\ncontributes to the infringement of trademark;<\/li><li>The person obtains any financial gains from the\ninfringement of trademark.<\/li><\/ul>\n\n\n\n<p>The exception to vicarious\nliability of any company for infringement of trademark is when the company\nacted in good faith and had no idea about the trademark infringement.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Contributory Infringement<\/h4>\n\n\n\n<p>There are three basic essentials to\ncontributory infringement; those are as follows-<\/p>\n\n\n\n<ul><li>The person knows about the infringement of\ntrademark;<\/li><li>The person considerably contributes to the\ndirect infringement;<\/li><li>The person provokes the principal infringer to\ncommit infringement of trademark.<\/li><\/ul>\n\n\n\n<p>There is no exception in case of\nindirect infringement as there is no chance of the contributory infringer to\nact in good faith.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Penalties_for_Trademark_Infringement\"><\/span>Penalties for Trademark Infringement<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Trademark infringement in India is\na cognizable offence that means that the infringer can face civil charges along\nwith criminal charges. It is not mandatory as per Indian law that trademark\nshould be registered for the institution of civil as well as criminal\nproceedings. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Cost of Legal Proceedings<\/h3>\n\n\n\n<p>In case of criminal proceeding, the\ncourt orders the following punishment-<\/p>\n\n\n\n<ul><li>Imprisonment for a period not less than 6 months\nthat may extend to 3 years;<\/li><li>A fine that is not less than INR 50,000 that may\nextend to INR two lakh.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Remedies_for_Trademark_Infringement_in_India\"><\/span>Remedies for Trademark\nInfringement in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Registered Trademark owner can initiate legal\nproceedings against the infringer declaring the unfair business practices that\nhe carried on. <\/p>\n\n\n\n<p>There are two types of remedies available\nto the trademark owner against any unauthorized use of trademark by any third\nparty. With respect to trademark infringement in India, it is preventing\na person from unauthorized use of trademark. By a temporary or permanent stay\norder, the Court can grants protection to the trademark owner.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Damages<\/h4>\n\n\n\n<p>Damage refers to the recovery of\nany loss faced by the trademark owner by trademark infringement. The fiscal\nvalue of loss or brand injury is recovered under Damages.
