Deductor is also accountable\nfor filing TDS rendering details of deductees, type of the payment made,\ndeducted tax, tax slab rate applied on the income for every quarter of a\nfinancial year. The TDS returns filed to allow the IT department to render\ncredit of Tax deduction at source to the right deductees. In addition to that,\nthe deductor is also liable to render a TDS certificate to the deductee for\nsuch tax deduction.&nbsp;<\/p>\n\n\n\n<p>Form 16B is referred to as a <strong>TDS certificate<\/strong><sup><a href=\"https:\/\/www.incometaxindia.gov.in\/Pages\/tax-services\/tds-certificate-verification.aspx\"><strong>[1]<\/strong><\/a><\/sup> issued by the deductor as per the rule of IT Act, 1961 to the deductee in the context of TDS deposited to the government. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Nature_of_Tax_Deduction_and_the_Person_Accountable_for_Deducting_Tax\"><\/span><strong>Nature of Tax Deduction and the Person Accountable for Deducting\nTax<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The section encloses the following provisions:-<\/em><\/strong><\/p>\n\n\n\n<ul><li>There is a transfer (apart from compulsory acquisition) of immovable property.&nbsp;<\/li><li>The immovable property indicates the establishment\/land\/part of the building. Agricultural land is not included.&nbsp;<\/li><li>The buyer is accountable for paying deliberation to the seller in the context of such transfer.&nbsp;&nbsp;<\/li><li>The transfer is for a consideration of fifty lakh rupees or more.&nbsp;<\/li><li>The buyer should deduct tax at the rate of one percent of consideration while making a payment or at the time of the event.&nbsp;&nbsp;<\/li><li>If the seller fails to renders PAN then TDS shall be deducted at the rate of twenty percent as per Section 206AA.&nbsp;<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Form_26QB_and_Form_16B\"><\/span><strong>Form 26QB and Form 16B<\/strong><strong><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Form 26QB is referred to as a challan for\nTDS payment to the Government which shall be submitted online for tax deducted\nas per Section 194-IA.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>Due date<\/em><em><\/em><\/h3>\n\n\n\n<p>Form 26QB shall be submitted within the\ntimeline of thirty days from the end of the month in which deduction took\nplace. For instance, if credit\/payment is made on April 16th, Form 26QB shall\nbe submitted by May 30th.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>Instalments<\/em><em><\/em><\/h3>\n\n\n\n<p>In the event of credit\/payment in\ninstalments, as TDS is needed for each instalment, Form 26QB shall be submitted\nsuch deduction.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>Multiple Parties to the Transaction<\/em><em><\/em><\/h3>\n\n\n\n<p> Form 26QB shall be submitted for each seller combination and buyer.&nbsp; <\/p>\n\n\n\n<p><strong><em>Example 1<\/em><\/strong>: Suppose there are two sellers S1 and S2 and one buyer B1, Form 26QB shall be submitted independently for B1 &amp; S1 combination &amp; B1 and S2 Combination, henceforth overall two forms to be filed.&nbsp;<\/p>\n\n\n\n<p><strong><em>Example 2<\/em><\/strong>: In the view of the above example, if the second buyer, B2 is appended, Form 26QB shall be submitted independently for B1 and S1 combination, and B1 &amp; S1 combination &amp; B2 and S2 combination, henceforth, as a whole, a four form to be filed to address such situation.&nbsp; <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_if_TAN_is_Available_with_the_Payer\"><\/span><strong>What if TAN is Available with the Payer?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per the above information, availing of\nTAN is compulsory for all deductors to become eligible for deducting TDS and\npay it to the government. It is also essential to mention TAN in all\ncorrespondence with the IT (TDS) department.&nbsp;<\/p>\n\n\n\n<p>TDS is needed to be paid via challan no: ITNS 281. But, in the event of immovable property transfer, the involved parties fail to use Challan No. ITNS 281 in the absence of the TAN and availing TAN for a one-off transaction is not viable. Henceforth, as Section 194-IA, the deductors are allowed to file TDS return without TAN. You are advised to note down the request number for further correspondence.&nbsp;<\/li><li>Next, select \u201cRequested Downloads\u201d to download Form 16B with the help of the request number.<\/li><li>Choose the Row and tap on the HTTP download button. A screen will prompt a long list of forms after a few seconds.
