Here\nthe registrar at ministry will check the basic information filled in the\napplication and documents attached along with an application. It will further\nverify whether all the information is filed correctly or not. It also checks\nthe type of application made and under what class it has to be filed. In case the\nministry finds any defects in an application then the status of a trademark\napplication will turn into status as \u201cFormality Check Fail\u201d.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Reply by an applicant against \u201cFormality check fail\u201d <\/h3>\n\n\n\n<p>If an application is at the stage of Formality check fail\nthen a reply has to be filed within 30 days from receipt of this status. The\nMinistry requires a reply from an applicant and all corrections must be duly\nmade in an application within a specified period of time; otherwise, the\nMinistry may order to abandon the trademark application.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What is Formality check pass? <\/h3>\n\n\n\n<p><em><strong>There are two stages associated to check the status where the application shall be marked as \u201cFormality check pass\u201d. Those are as follows:-<\/strong><\/em><\/p>\n\n\n\n<ol><li>No deficiency found in an trademark application<\/li><li>Reply is filed to the \u201cformality check fail\u201d<\/li><\/ol>\n\n\n\n<p>This stage will proceed and clears the application to enter into a next stage. The correct class needs to be selected\nat the time of filing a trademark application. In case if wrong class is chosen,\nthe trademark application will become invalid and the status of an application\nwill change to formality check fail. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Inappropriate products or service description<\/h3>\n\n\n\n<p>In an application, it is important to provide description of\ngoods or services in which an individual wants to get registered. The\ndescription must be in accordance to the classification mentioned in the 45\nclass. Where a selected class, and its corresponding description, does not\nmatch, an application might show \u201cformality check fail\u201d status.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Inappropriate documents<\/h3>\n\n\n\n<p>The Trademark Registration Procedure can be stretched down\nif all the required documents are not submitted by an applicant. There are few\nrelevant documents needs to be attached while applying for the trademark\napplication, such as power of attorney, affidavit, and proofs for claiming user\ndate, supporting documents for claiming a rebate on application fees, start-ups\nor MSME certificate, etc. Sometimes\nthe uploaded documents can get corrupted so the examiner fails to open\nand view them. In such cases the examiner marks an application of trademark\nstatus as \u201cformality check fail\u201d and asks for submitting the documents again.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Inappropriate Information<\/h3>\n\n\n\n<p>The information in an application has to be filled properly,\ncorrectly and as required. For example, translation and transliteration will be\nprovided if the brand name is in a language other than English or Hindi. The\nname, address and other details of the applicant must exactly same in the\ntranslated document. The user data must be mentioned properly, description of\nthe image, etc.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Brand name and logo are different<\/h3>\n\n\n\n<p>If a logo, and brand name, is different from one another and\nalso the words stated in a logo does not match with a brand name, then the\nregistry marks the status as \u2018Formality check fail\u2019. Therefore, both the logo\nas well as the brand has to correlate with each other.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Notice_for_%E2%80%9CFormality_Check_Fail%E2%80%9D\"><\/span>Notice for \u201cFormality Check Fail\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The ministry would issue a notice for Formality check fail along with reasons issuing the same. The individual is required to file the reply within 30 days from the date of receiving of the notice. <em><strong>Ministry<\/strong><\/em><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Ministry\"><em><strong>[1]<\/strong><\/em><\/a><\/sup> shall mark an application as abandoned when a response is not received within the specified period. &nbsp;An individual can file a Formality check from the tab \u201c<strong><em>miscellaneous reply<\/em><\/strong>\u201d by selecting <strong><em>\u201creply to formality check (MIS-F)\u201d<\/em><\/strong> and providing an application number. If the mentioned specifically <strong><em>\u201cTM-M\u201d,<\/em><\/strong> then the individual is required to file that form. If the ministry is satisfied with the reply, then it would process the application for the next stage.
