It can be\nmade through an agent authorized by a trademark applicant. <\/p>\n\n\n\n<p>By the virtue of <strong>Form TM48<\/strong> under the Trade Marks Act,\n1999, the authorization is made by a Power of Attorney and the response is\ncalled <strong><em>Reply to Examination Report<\/em><\/strong>. It is required that an Applicant to\nreply within 30 days from a date of receipt of an examination report. However, at the time of Trademark registration process, a trademark is rarely accepted without an objection from the Trademark Registry.<\/li><li>At the time of verification by Trademark Registry, an Examiner will looks into the database of Trademark Applications received to check any identical or similar Trademark if already applied or is registered. If yes, then the same must be communicated to an Applicant by publication in an <strong><em>Examination Report<\/em><\/strong>.<\/li><li>Any observations and findings of an examiner that has been recorded in a report are known as the Examination Report. This is issued to an applicant seeking a clarification, explanations on the grounds of an application by way of filing a written submission or hearing.<\/li><li>Once an examination report will be issued by a Trademark Registry, an applicant can view and download the Examination Report. An applicant can then reply at a given time by himself or through his\/her attorney.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Tracking_the_Status\"><\/span>Tracking the Status<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After issuance of the Examination Report, if a status of an application on a portal will show as \u201cObjected\u201d then an applicant has to file reply to <a href=\"https:\/\/corpbiz.io\/trademark-objection\"><strong>Trademark objection<\/strong><\/a> in Examination Report. The reply to an examination report must be made within time period of 30 days of receipt of an Examination Report. <\/p>\n\n\n\n<p>In a case of failing to which Trademark Registry can abandon an application made i.e. an applicant has to give up any claim over a Trademark. Those are as follows:-<\/em><\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">List of Absolute Grounds of Refusal (Section 9) <\/h3>\n\n\n\n<p>The trademark which consist any of\nthe following characteristics will be objected by the Trademark Registry for\npreventing the monopoly of Owner:<\/p>\n\n\n\n<ul><li>When a trademark is incapable of distinguishing any goods or services from one person to those of another person<\/li><li>When a trademark that indicates the quality, quantity, any intended purpose, values, geographical origin at time of production of the goods or rendering of the service or any other specified characteristics of the goods or services. For example, Delicious Snacks, etc.<\/li><li>When it consists exclusively of trademarks or indications that have become customary or has established practice of the trade,<\/li><li>When a trademark is of such nature which likely to deceive the public or cause confusion<\/li><li>When it contains or comprises of any matter which likely to hurt any &nbsp;religious susceptibilities of any class or section of the people of India<\/li><li>When it comprises or contains scandalous or any obscene matter<\/li><li>When it is prohibited under the <strong><em>Emblems and Names (Prevention of Improper Use) Act, 1950<\/em><\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Emblems_and_Names_(Prevention_of_improper_use)_Act_1950\"><strong><em>[1]<\/em><\/strong><\/a><\/sup><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Relative Grounds of Refusal (Section 11)<\/h3>\n\n\n\n<ul><li>The section restricts the Trademark\nregistration, when possibility of confusion exists among the customers due to\nidentification with an earlier trademark or similarity of goods or services. Trademark\nObjection may come on the ground if the Trademark (wordmark) is phonetically\nsimilar to the existing Trademark applied to the Registry.<\/li><li>There are few more grounds when a Trademark\nRegistry will consider issuing Examination report such as visual similarity in\na design, fonts, pattern and colour combination in logo as well as in wordmark\napplied for with an existing applications received by the Trademark Registry.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Other Common Grounds<\/h3>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" width=\"594\" height=\"553\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-88.png\" alt=\"Other Common Grounds\" class=\"wp-image-18381\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-88.png 594w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-88-300x279.png 300w\" sizes=\"(max-width: 594px) 100vw, 594px\" \/><\/figure><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Response to Examination Report<\/h3>\n\n\n\n<ul><li>An applicant himself or an attorney will file a\nresponse to an examination report against the raised Trademark objection in\nexamination report within the stipulated time after the comprehensive analysis\nof the grounds of objection raised by the Examiner.<\/li><li>The reply must be drafted in the manner that\nconstruct supportive grounds and must able to give proper reasoning why a trademark\napplied and it further does not fail to comply with the provisions of the law.<\/li><li>When there is no format prescribed in respect of\nreply to examination report, being an applicant to the Registry one enjoys all\nthe rights to deliver a clarification asked with proper reasoning. However, in\naddition to above one must not oversight certain factors that are generally\naccepted in the practise.<\/li><li>Further, it is recommended to consult\nprofessional for drafting and filing of Reply as they are experienced with the trademark\nprovisions and cases that is taken care for filing the reply to satisfy the\nqueries raised by the Registry in a best manner.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Post Filing the Reply<\/h3>\n\n\n\n<ul><li>Once the Examination Report Reply is filed on\nthe portal, the status will turned to \u201cObjected\u201d replacing the alert of\n\u201cAwaiting to Reply.\u201d Now, an applicant has to rest and wait for the further\nresponse from the Trademark Registry.<\/li><li>The examiner can either accept a response or\nschedule the hearing according to the satisfaction of the reply filed.<\/li><li>A reply filed and after hearing to the\nsatisfaction of an examiner, the examiner will order for publication of a\nTrademark in Trademark Journal.<\/li><li>If the response\/reply fails to satisfy an\nexaminer, then an applicant can avail am opportunity of hearing before a\nTrademark Registrar, where he can present his submissions orally.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The trademark faces the objection during registration of Trademark on the ground of same or similar trademark which have been registered prior or applied before the Trademark registry by some third party.
