Examples of ART cover gamete (sperm or oocyte) donation, in-vitro-fertilization (breeding an embryo in the lab), including gestational surrogacy (the child is not biologically associated with a surrogate mother). ART assistance will be implemented within: <\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" width=\"590\" height=\"340\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-67.png\" alt=\"Assisted Reproductive Technology\" class=\"wp-image-18124\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-67.png 590w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-67-300x173.png 300w\" sizes=\"(max-width: 590px) 100vw, 590px\" \/><\/figure><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Regulation_of_Assisted_Reproductive_Technology_Bill_2020_on_clinics_and_banks\"><\/span>Regulation of Assisted Reproductive Technology Bill, 2020 on\nclinics and banks<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>This Bill presents that each ART clinic and the bank must be enrolled under the purview of the National Registry of Banks and Clinics of India. The National Registry will be authorized under the Bill and will function as a central data base with details of all ART clinics and banks. State governments will designate registration authorities to facilitate the registration process. Clinics and banks will be listed if they adhere to specific standards (specialized employees, physical infrastructure, and diagnostic facilities). The registration will validate for five years and can be restored for five years more. A bank can receive semen from males between 21 and 55 years of age, and\noocytes of females within 23 to 35 years. An oocyte donor should be a married\nwoman having at least one alive child of her own(minimum of three years\nof age). The woman can give oocyte only once in her life, and not more than\nseven oocytes can be retrieved from her. A bank cannot provide a single donor\nto more than one commissioning couple (couple seeking services).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conditions_for_Offering_ART_services\"><\/span>Conditions for Offering ART services<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>ART methods can only be carried out with the written consent\nof both the party seeking ART services and the donor. The party seeks ART\nservices that will be required to provide insurance coverage in favor of the\noocyte donor (in case of any loss, damage, or death of the donor). A clinic is\nprohibited from offering to give a child of pre-determined sex. The Bill also\nentails checking for genetic diseases before embryo implantation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rights_of_the_Further_child_born_through_ART\"><\/span>Rights of the Further child born through ART<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A child born through ART will be considered as a biological\nchild of a couple and will be authorized to the rights and privileges available\nto the commissioning couple&#8217;s natural child. Further, the donor will not have\nany parental rights over the child.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">National and State Boards<\/h3>\n\n\n\n<p>Assisted Reproductive Technology Bill, 2020 provides that the National and State Boards for Surrogacy authorized under the Surrogacy (Regulation) Bill, 2019, will now act as the National and State Boards to regulate ART services. <\/p>\n\n\n\n<p><em>Essential powers and functions of the National Board include <\/em><\/p>\n\n\n\n<ul><li>suggesting the central government on ART related policy concerns, <\/li><li>analyzing and observing the implementation of the Bill, <\/li><li>forming code of conduct and the standards for ART clinics and banks, and <\/li><li>Supervising various bodies to be commissioned under the Bill. The State Boards will regulate the enforcement of ART&#8217;s methods and guidelines as per the National Board&#8217;s recommendations, <em><strong>policies<\/strong><\/em><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Policy\"><em><strong>[1]<\/strong><\/em><\/a><\/sup>, and regulations.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Offenses_and_penalties_under_Assisted_Reproductive_Technology_Bill_2020\"><\/span>Offenses and penalties under Assisted Reproductive\nTechnology Bill, 2020<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Offences under this Bill includes- <\/em><\/strong><\/p>\n\n\n\n<ul><li>To abandon or exploit children born through ART, <\/li><li>To sell, purchase, trade, or import human embryos or gametes,\n(iii) using an intermediary to obtain donors,<\/li><li>Abusing the commissioned couple, woman, or the gamete donor\nin any form, and <\/li><li>Transporting the human embryo into a male or an animal. These\noffenses will be punishable with a fine between five and ten lakh rupees for\nthe first contravention. For subsequent contraventions, these offenses will be\npunishable with imprisonment for a term between eight and twelve years and\/or\nfine between ten or twenty lakh rupees. <\/li><li>Any clinic or bank advertisement or offering any\nsex-selective ART will be punishable with imprisonment for five and ten years,\nor fine Rs ten law thinks to Rs twenty-five lakh or both. <\/li><li>No court will take cognizance of offenses under the said Law,\nexcept in case any complaint made by the National or State Board or any officer\nauthorized by the Boards. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Apart from the aspects mentioned above, there are several different aspects connected to the surrogate mother and the child&#8217;s rights. The Assisted Reproductive Technology Bill, 2020 lacks in clarity and transparency required to protect these rights if legal issues arise sufficiently.
