The registration process\nas well as compliances for different form of entity in which educational institution as NGO can be\nformed, they are-<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Registration of\nEducational Institution as a Charitable Trust<\/h3>\n\n\n\n<p>Educational Institutions can be registered as Trust under Indian Trust Act, 1882. Trusts are formed by trust deed containing vital information such as information related to trustee, rights &amp; duties, operations of trust and most important of all is objective of the Trust.<\/p>\n\n\n\n<p>The\ntrust deed should be submitted to the local registrar with all the requirements\nand at the time of the settler and two witnesses with proof of identity should\nbe present. The registrar will keep a photocopy of the deed and return the\noriginal one. After registration, the trust should apply for PAN card as it is an\nimportant document for income tax registration from the department of income\ntax.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Registration of\nEducational Institutions as a Society <\/h3>\n\n\n\n<p>An educational institution can be <a href=\"https:\/\/corpbiz.io\/society-registration\"><strong>Registered Society<\/strong><\/a> according to the Societies Registration Act 1860. A society can be formed by group of 7 or more persons for charitable, scientific purposes &amp; literary as defined in Section 20 of the said act.<\/p>\n\n\n\n<p>The associated persons are required to subscribe their name in <a href=\"https:\/\/corpbiz.io\/learning\/alteration-of-memorandum-of-association-moa\/\"><strong>Memorandum of Association<\/strong><\/a> (MoA) and file it with registrar. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Exemption_Provided_to_Educational_Institution_as_NGO\"><\/span>Exemption Provided\nto Educational Institution as NGO<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Analysis\nof certain exemptions given to Educational Institution as NGO under <strong><em>Section\n10(23C) <\/em><\/strong>in comparison with exemption available under <strong><em>Section\n11 of the&nbsp;Income Tax Act<\/em><\/strong>, which are as follows- <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What is\nthe background Section 11?<\/h3>\n\n\n\n<p>Section 11 of <strong><em>Income Tax Act<\/em><\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Income_tax_in_India\"><strong><em>[1]<\/em><\/strong><\/a><\/sup> is a popular section to claim exemption from tax between the charitable trusts and institutions. The majority of the charitable trusts are registered as per section 12AA of the said Act and it can claim exemption as per Section 11. While the exemptions available under section 11 are common and accessible for all the charitable organizations and institutions, Section 10(23C) of the said Act is an explicit exemption obtainable to specific Governmental as well non-governmental educational institutions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Situations_Prevalent_for_Claiming_Exemption_for_Educational_Institution_as_NGO\"><\/span>Situations Prevalent\nfor Claiming Exemption for Educational Institution as NGO<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" width=\"591\" height=\"287\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-62.png\" alt=\"Educational Institution as NGO\" class=\"wp-image-18072\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-62.png 591w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-62-300x146.png 300w\" sizes=\"(max-width: 591px) 100vw, 591px\" \/><\/figure><\/div>\n\n\n\n<p><em><strong>Following are the prevalent conditions for exemptions-<\/strong><\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Government\nEducational Institutions<\/h3>\n\n\n\n<p>Income received by any educational institution obtainable exclusively for educational purposes. It should not be instituted for purposes of profit. Educational Institution is wholly or substantially financed by the Government is fully exempted from tax through Section 10(23C) (iiiab). Therefore, a Government educational institution is fully exempted from tax without any separate approvals as long as it does not have any profit motive.<\/p>\n\n\n\n<p class=\"text-left\"><b>Read our article<\/b>:<mark style=\"background: #fffd03 !important;\"><a href=\"https:\/\/corpbiz.io\/learning\/registering-an-ngo-in-india\/\">An Outlook: Registering an NGO in India<\/a><\/mark><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Non-government\nEducational Institutions<\/h3>\n\n\n\n<p>The\nexemption for non-government educational institutions depends on the collective\nannual receipts of the educational institution. They are as follows-<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Educational\nInstitutions with annual turnover up to 1 crore<\/h4>\n\n\n\n<p>Section\n10(23C) (iiiad) specifies that the income earned by any&nbsp; educational institution or university\nexisting exclusively for educational purpose will be exempted from income tax\nif the annual receipts of such university or educational institution does not surpass\nINR 1 crore.<\/p>\n\n\n\n<p>Therefore,\nan educational institution having receipts up to INR 1 crore can claim full\nimmunity under the above mentioned clause without any separate approval as well\nas registration.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Educational\nInstitutions with annual turnover exceeding 1 crore<\/h4>\n\n\n\n<p>Exemption\nin the case of an educational institution or university having turnover\nexceeding INR 1 crore is directed by <strong><em>Section 10(23C) (vi)<\/em><\/strong> which says that\nincome earned by any educational institution&nbsp;accessible exclusively for\neducational motive. Things mentioned in sub-clause (iiiab) and sub-clause\n(iiiad) is exempted&nbsp;if they are approved by the approved authority.&nbsp;Thus, where the total\nturnover of the educational institution exceeds INR 1 crore, the organization\nneeds a separate approval to claim exemption as per Section 10(23C).<\/p>\n\n\n\n<p>The\nApplication for approval is necessary to be made in <strong><em>Form 56D<\/em><\/strong> with the essential\ndocuments before the Commissioner of Income Tax. Just like the approval under\nSection 12AA, the approval under Section 10(23C) is also available for an\nindefinite period unless it is withdrawn by the authorities.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Further\nConditions<\/h4>\n\n\n\n<p><em><strong>The third proviso to Section 10(23C) gives the following conditions:-<\/strong><\/em><\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" width=\"684\" height=\"465\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-64.png\" alt=\"Further Conditions\" class=\"wp-image-18074\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-64.png 684w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-64-300x204.png 300w\" sizes=\"(max-width: 684px) 100vw, 684px\" \/><\/figure><\/div>\n\n\n\n<p><strong>Spend minimum 85%<\/strong><\/p>\n\n\n\n<p>The educational institution should spend its income&nbsp;entirely and exclusively for the objective for which it was established. Additionally, the educational institution should apply for at least 85% of the income every year. Consequently, registration under Section 10(23C) does not result in full exemption of Tax. The institution has to spend at least 85% of total income to claim full exemption of tax.<\/p>\n\n\n\n<div class=\"shadow1\"><strong>Note:<\/strong> The institutions are allowed to preserve 15% of total income without any further conditions.<\/div>\n\n\n\n<p>In\ncase the income that is applied falls short of 85% then the educational\ninstitution have to accumulate excess income for application in following year\nwhich does not exceed five years. <\/p>\n\n\n\n<p>On the other hand, the accumulated amount is said to be spent by the educational institution on its own as it cannot spent it by way of donations to any other <a href=\"https:\/\/corpbiz.io\/trust-registration\"><strong>trust registered<\/strong><\/a> according to 12AA of the said Act or another institution claiming exemption under Section 10(23C) of the Act.<\/p>\n\n\n\n<p><strong>Investments<\/strong><\/p>\n\n\n\n<p>The\nsecond condition is that the educational institution should invest its money\nonly in the forms specified according to section 11(5) of the Income Tax Act.\nThis provision is similar to the other provisions applicable under Section\n12AA.<\/p>\n\n\n\n<p><strong>Other Relevant Conditions<\/strong><\/p>\n\n\n\n<p><em>Some other conditions are as follows-<\/em><\/p>\n\n\n\n<p><strong>Income Tax Return<\/strong><\/p>\n\n\n\n<p>By the standards of 139(4C) all educational&nbsp;institution mention or allude to in sub-clause (iiiad) or (vi) of Section 10(23C) whose entire income,&nbsp;without any consequences regarding the provisions of section 10, surpasses the maximum amount which is not taxable under income-tax, should endow a return of income. Hence, if the total receipts of the organization exceeds INR 2,50,000\/-, it has to file the return of income. The Form of <a href=\"https:\/\/corpbiz.io\/income-tax-return-filing\"><strong>Income Tax Return<\/strong><\/a> (ITR) is ITR-7, the same is applicable for a Section 12AA registered Trust.<\/p>\n\n\n\n<p><strong>Audit<\/strong><\/p>\n\n\n\n<p>Proviso\nno. 10 to Section 10(23C) states that when the total income of an institution,\nwithout any consequences regarding the provisions of this section, exceeds the\nmaximum amount which is not taxable any preceding year, such establishment should\nget its accounts audited and furnish along with the income return for the\napplicable assessment year, the report of such audit is provided in Form No.\n10BB. Hence, if the total receipts of the establishment exceeds INR 2,50,000\/-,\nit should file the return of income.<\/p>\n\n\n\n<p><strong>Corpus Donations to other\nTrusts<\/strong><\/p>\n\n\n\n<p>Proviso\nno. 12 to the Section 10(23C) further states that any amount paid or credited\nout of the income of any educational institution or university to any\ninstitution registered under&nbsp;section 12AA or to any trust, being a corpus\ndonation should not be taken as application of income to the objects for which\nsuch educational institution or university is established. Hence, the\neducational institutions or university registered under section 10(23C) (VI)\nare excluded from giving corpus donations to other Trusts registered under section\n12AA. <\/p>\n\n\n\n<p><strong>Other Provisions<\/strong><\/p>\n\n\n\n<p>Applicability\nof other provisions such as Tax Deducted at Source (TDS) on expenses is\ncompletely applicable to an educational institution or university. Therefore,\nan educational institution or university is required to deduct tax from payments,\nwherever required to claim the amount as application of income.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>From the above detailed discussion, we can conclude that the exemption offered to Educational institutions or universities as an NGO are specified in provisions of&nbsp;Section 10(23C)&nbsp;and Section 11 are very similar. Both have similar requirements and conditions for claiming exemption by doing <a href=\"https:\/\/corpbiz.io\/ngo-registration\"><strong>NGO Registration<\/strong><\/a>.
