Sec 12AA dealing with the procedure for registration of a charitable trust is not to be applicable; instead, a&nbsp;new section 12AB has inserted prescribing the procedure for new registration. The Government aims to create a National Register of all charitable and religious institutions, and the <strong><em>IT Department<\/em><\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Income_Tax_Department\"><strong><em>[1]<\/em><\/strong><\/a><\/sup> will issue an electronically generated Unique Registration Number (URN) to all charitable and religious institutions.<\/p>\n\n\n\n<p>In case of the new <a href=\"https:\/\/corpbiz.io\/trust-registration\"><strong>trust registration<\/strong><\/a>, the Principal Commissioner or the Commissioner shall grant a provisional certificate of registration within one month from the end of the month in which the application for provisional registration is made. <\/p>\n\n\n\n<p class=\"text-left\"><b>Read our article<\/b>:<mark style=\"background: #fffd03 !important;\"><a href=\"https:\/\/corpbiz.io\/learning\/audit-of-charitable-trust-or-ngo-under-section-12a-b\/\">Audit of Charitable trust or NGO under section 12A (b)<\/a><\/mark><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Amended_provision_of_Section_12AB_for_Registration_of_Trust\"><\/span>Amended provision of\nSection 12AB for Registration\nof Trust<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The amended provisions of sec-12AB for Registration of Trusttabulated are as follows-<\/em><\/strong><\/p>\n\n\n\n<table class=\"table table-bordered\"><tbody><tr><td>\n  <strong><em>Application\n  made&nbsp; <\/em><\/strong><strong><em>u\/s-<\/em><\/strong><strong><em><\/em><\/strong>\n  <strong><em>12A(1)(ac)<\/em><\/strong>\n  <\/td><td>\n  <strong><em>Procedure\n  for fresh registration<\/em><\/strong>\n  <strong><em>under Section 12AB<\/em><\/strong>\n  <\/td><td>\n  <strong><em>Remarks<\/em><\/strong>\n  <\/td><\/tr><tr><td>\n  <strong>(i)<\/strong>\n  <\/td><td>\n  Registration granted&nbsp;for\n  five years\n  [Sec-12AB(1)(a)]\n  <\/td><td>\n  No documents will be called, or query\n  will be made for the grant of registration. The application should be made in 3\n  months&nbsp;from the end of the month.\n  <\/td><\/tr><tr><td>\n  <strong>(ii)\/(iii)\/<\/strong>\n  <strong>(iv)\/(v)<\/strong>\n  <\/td><td>\n  Registration&nbsp;may\n  be&nbsp;allowed for five years\n  if PCIT or CIT is satisfied with the genuineness of actions and compliance under any other laws of the trust.\n  &nbsp;\n  Registration may be revoked after\n  providing a reasonable opportunity of being heard to the trust.\n  &nbsp;\n  [Section\n  12AB(1)(b)(ii)]\n  <\/td><td>\n  The PCIT or CIT shall have the powers to call\n  for documents from the trust to make inquiries before renewal of the\n  registration after five years, and\n  within six months from the month end in which the application is made.\n  \n  &nbsp;\n  Further,\n  before cancelling the registration, the trust shall be allowed to present its\n  case.\n  <\/td><\/tr><tr><td>\n  <strong>(vi)<\/strong>\n  <\/td><td>\n  Provisional registration will be\n  allowed for 3 years from the assessment year of which the registration\n  is brought.\n  &nbsp;\n  [Sec-12AB(1)(c)]\n  <\/td><td>\n  It resembles that in this case no documents will be called or inquiry will be made for granting\n  the provisional registration, in one\n  month&nbsp;from the end of the month in which application is made.\n  <\/td><\/tr><\/tbody><\/table>\n\n\n\n<ul><li>Granting\nof registration by the Principal Commissioner\nafter receipt of an application under the conditions specified in section 12A\n(1) (i) to (vi).<\/li><\/ul>\n\n\n\n<ul><li>Time\nlimit to grant the registration by the Principal Commissioner\nor the Commissioner after the receipt of an application under the circumstances\nspecified in sec 12A(1)(i) to (vi).<\/li><\/ul>\n\n\n\n<ul><li>Any&nbsp;registration granted under section 12AB(1)(a)\nor u\/s 12AB(1)(b) empowers the Principal Commissioner or the\nCommissioner to revoke the registration of a Trust or institution in the new\nsec 12AB is on the same line of the existing section 12AA.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_for_Registration_of_Trust_New_Approach\"><\/span>Procedure for Registration of Trust:\nNew Approach<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The process for registration of trust includes the following-<\/em><\/strong><\/p>\n\n\n\n<p>Application Form\n10 A has to be filed and submitted along with the relevant documents to the\nappropriate authority.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Documents required to be provided\nalong with the application Form for Registration of Trust<\/h3>\n\n\n\n<p><em><strong>The documents which are required to be provided along with Form 10A are as follows-<\/strong><\/em><\/p>\n\n\n\n<ul><li>When trust is formed under an instrument, self-certified copy of the instrument creating the trust;<\/li><li>When trust is formed under an instrument, self-certified copy of the document evidencing the creation of the trust;<\/li><li>A self-certified copy of the filing with Registrar of Public Trusts;<\/li><li>Self-certified copy of the documents for evidencing adoption or modification of the objects, if any;<\/li><li>The trust has been in existence during any year or years before the financial year in which the application is made for registration, self-certified copies of the annual accounts of the trust related to such prior year or years but not more than three years immediately preceding the year in which the application is made for which such accounts have been made<\/li><li>Self-certified copy of existing order granted registration under section 12A or 12AB, and<\/li><li>Self-certified copy of the order of denial of an application for grant of registration under section 12A or 12AB, as the case may be if any.<\/li><\/ul>\n\n\n\n<p>Further, if an\napplication is impending for registration as on 01.10.2020, the same shall be\nconsider as an application pending under the said provisions. No separate\napplication is require to be made.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The process to re-validate all the charitable and religious trust will enable the authority to wipe out all the dormant and defunct charitable institutions. In the past, many registered trusts were discovered engaging in malpractices for private gain rather than doing any actual social activity. The department wants to restrain those practices.
