The registration of the\ntrademark and remedies regarding the infringement of trademark are provided\nunder the <strong>Trademarks Act 1999<\/strong>. <\/p>\n\n\n\n<p>The ministry has now become more pro-active and made the process of registering a trademark much faster. However, earlier, the timeline for <a href=\"https:\/\/corpbiz.io\/trademark-registration\"><strong>trademark registration<\/strong><\/a> process would take 15-18 months to register a trademark, but now the registering a trademark would take 6-8 months (without any objections). <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Timeline for Trademark Registration <\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" width=\"606\" height=\"455\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-29.png\" alt=\"Timeline for Trademark Registration \" class=\"wp-image-17595\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-29.png 606w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-29-300x225.png 300w\" sizes=\"(max-width: 606px) 100vw, 606px\" \/><\/figure><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Trademark Search<\/h3>\n\n\n\n<p>There are some definite processes that are to be followed for the timeline for trademark registration. The first and foremost step requires conducting a <a href=\"https:\/\/corpbiz.io\/trademark-search\"><strong>trademark search<\/strong><\/a> before filing an application for trademark registration. It is to make sure that there are no similar or identical trademark exists or has been registered earlier. According to <strong><em>Section 18 of the Act<\/em><\/strong>, application for trade mark registry can be made in specified forms.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Trademark Application<\/h3>\n\n\n\n<p>A single application can be made for trademarks for different classes of goods and services. The prescribed fees must be paid for each class of goods and services. Drafting an application, the collection of documents and filing of trademark application will take <strong><em>2-3 working days<\/em><\/strong>. Then the registrar publishes an\napplication in the trademark journal <strong><em>within 6 months<\/em><\/strong> of such acceptance.\nWhen an application is published the same can be opposed or objected by the\nother person if their marks are similar or identical with the pending\napplication.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Trademark Objection<\/h3>\n\n\n\n<p>In the process of trademark registration, an advertisement is made so that general public has an opportunity to raise any <a href=\"https:\/\/corpbiz.io\/trademark-objection\"><strong>trademark objection<\/strong><\/a> against the pending application of the trademark. The opponents get a chance to defend their marks against pending marks which may be similar or identical to theirs. &nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Examination Report<\/h3>\n\n\n\n<p>At this stage, the Ministry examine the brand name or logo applied under various sections of the <em><strong>Trademark Act<\/strong><\/em><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Trademark\"><em><strong>[1]<\/strong><\/em><\/a><\/sup>. Accordingly, the ministry must issue an examination report either objecting or accepting the trademark. If none objections are raised, the mark will directly be allowed to be advertised. Otherwise, the trademark application is examined by the Trade Marks Office in about <strong><em>2 to 4 months<\/em><\/strong> time, from the filing date of objections raised. <strong><em>These objections can either be raised on:<\/em><\/strong><\/p>\n\n\n\n<ul><li><strong><em>Absolute Grounds: <\/em><\/strong>Devoid of\ndistinctive character, Distinctiveness, not capable of distinguishing goods or\nservices, etc.<\/li><li><strong><em>Relative Grounds:<\/em><\/strong> Similarity with any\nearlier trademark already existing on the Trademarks Register<\/li><\/ul>\n\n\n\n<p>If an examination report is issued, a response has to be\nfiled within <strong><em>1 month<\/em><\/strong> from a receipt of an examination report failing which\nan application is \u201c<strong><em>deemed to have been abandoned<\/em><\/strong>\u201d by an Applicant. If Trade Marks\nOffice is convinced with the response filed, an application is further advertised\nin the Trademarks Journal. Alternatively, in case an Examiner has further\nobjections, the show cause hearing will be offered to an Applicant.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Journal Publication<\/h3>\n\n\n\n<p>The application must be proceeded to registration if a\ntrademark application is <strong><em>not opposed<\/em><\/strong> <strong><em>within 4 months<\/em><\/strong> from a\ndate of advertisement in the Trademarks Journal. Any party can raise opposition\nagainst the registration of the trademark <strong><em>within 4 months<\/em><\/strong> of publication of\ntrademark in a journal.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Trademark Opposition<\/h3>\n\n\n\n<p>Any person can oppose a trademark registration application\nby submitting the written notice as well as by paying prescribed fees <strong><em>within\n4 months<\/em><\/strong> from the advertisement of the trademark application to the\nregistrar. If any person opposes the trademark then, after a receipt of the\nnotice of opposition, Registrar serves the same to an applicant of the opposed\nmark <strong><em>within\n2 months<\/em><\/strong>. However, if no opposition is made, the trademark will be\nprocessed further for registration. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Counter Statement <\/h3>\n\n\n\n<p>If an applicant receives a third party opposition within the\ntime period of <strong><em>4 months<\/em><\/strong> then he has to file a reply. The reply has to be filed\nwithin <strong><em>2 months<\/em><\/strong> from the receipt of notice of opposition. In case if\nreply is not filed then a ministry will abandon the trademark. The opponent\nwill get one more chance for filing a reply against an applicant. An applicant\nwill also get <strong><em>2 months<\/em><\/strong> period to file the second counter statement.\nTherefore, within <strong><em>2 months <\/em><\/strong>of the receipt of such notice by an applicant, a\ncounter statement is to be filed to the registrar. <\/p>\n\n\n\n<p>The counter-statement is served to an opponent by the registrar\nas well. Based on the oppositions and counter statements, registrar will make a\ndecision whether a trademark is to be accepted or not. Both the parties have a\nliberty to appeal against any decision made by the Registrar. <strong><em>An\nappeal can be filed before Intellectual Property Appellate Board.<\/em><\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Hearing<\/h3>\n\n\n\n<p>The last stage of the opposition is the hearing, where both\nparties argue and put their forth statements.&nbsp;\nAfter hearing both sides, the presiding officer will pass necessary\norder. If an order is in the favour of an applicant then the trademark will get\nregistered otherwise it will get abandoned by the officer.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Trademark Registration<\/h3>\n\n\n\n<p><em><strong>Under the following circumstances, an applicant will receive the trademark certificate:-<\/strong><\/em><\/p>\n\n\n\n<ul><li><strong><em>If no opposition is raised<\/em><\/strong>: After\nthe completion of <strong><em>4 months<\/em><\/strong> of publishing a trademark in the journal.<\/li><li><strong><em>In case opposition<\/em><\/strong>: When an officer\npassed an order of hearing in favour of an applicant.&nbsp;&nbsp; <\/li><\/ul>\n\n\n\n<p>In both cases, an applicant shall be granted with the\ntrademark registration certificate that ends the timeline for trademark\nregistration process. An applicant is allowed to use the \u201cR\u201d sign with its\nbrand name or logo after receiving a registration certificate. The certificate\ncan be downloaded online from the trademark portal when an application number\nentered.<\/p>\n\n\n\n<p>The Registrar accepts the trademark, and eventually the trademark entry is made in the register. On the registration of the Trademark, the Registrar issues a Trademark Registration Certificate in favour of an applicant. The whole timeline for trademark registration process must not exceed a period of 12 months from a date of application. And after every 10 years the <a href=\"https:\/\/corpbiz.io\/trademark-renewal\"><strong>Trademark Renewal<\/strong><\/a> can be done. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion <\/h2>\n\n\n\n<p>An application goes through a timeline for trademark registration. But if the brand name is unique then one can get the trademark registration certificate in around six to eight months. An application is processed through the Trademark ministry so the processing time completely depends on government processing time.
