This new code is expected to amend and combine the laws relating to social security for all the employees either in the organized or unorganized sector.<\/p>\n\n\n\n<div id=\"ez-toc-container\" Security, 2020, the following Acts were repealed-<\/em><\/strong><\/p>\n\n\n\n<ul><li>The Unorganized Workers Social Security Act, 2008.<\/li><li>The <strong><em>Payment of Gratuity Act, 1972<\/em><\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/The_Payment_of_Gratuity_Act,_1972\"><strong><em>[1]<\/em><\/strong><\/a><\/sup>;<\/li><li>The Maternity Benefit Act, 1961;<\/li><li>The Employment Exchanges (Compulsory Notification of Vacancies) Act, 1959;<\/li><li>The Employees State Insurance Act, 1948;<\/li><li>The Employees Provident Funds and Miscellaneous Provisions Act, 1952;<\/li><li>The Employees Compensation Act, 1923;<\/li><li>The Cine-Workers Welfare Fund Act, 1981;<\/li><li>The Building and Other Construction Workers\u2019 Welfare Cess Act, 1996.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Reason for Merging the above Acts<\/h3>\n\n\n\n<ul><li>Merging of the above acts will\nremove the diversity of definitions;<\/li><li>Extending the scope of the\nbenefits to the fixed-term employees.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Features_of_the_Code_on_Social_Security_2020\"><\/span>Features of the Code on Social\nSecurity, 2020<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The features of the bill are as follows-<\/em><\/strong><\/p>\n\n\n\n<ul><li>To amend and combine the laws\nrelated to social security with the goal to widen the scope of social security\nto all the employees of the sectors;<\/li><li>To provide for an establishment\nunder chapter III related to Employees\u2019 Provident Fund and under chapter IV related\nto Employees State Insurance Corporation on controlled basis even if the number\nof employees in the&nbsp;organization is less than the threshold;<\/li><li>To define a variety of expressions\nused in the bills like \u201caggregator\u201d, \u201ccareer centre\u201d, \u201cplatform worker\u201d, \u201cgig\nworker\u201d, \u201cwage ceiling\u201d, and more. Additionally, the definition of \u201cemployee\u201d\nhas been broadly defined to cover maximum number of employees as well as\nworkers;<\/li><\/ul>\n\n\n\n<ul><li>To provide for E-Registration for every organization to which the bill will apply, within time and manner as the central government determines. It also provides for an option for cancellation of registration by any organization whose business activities are in the process of closure.<\/li><li>Constitution of various social security establishment for the management of the bill, they are as follows-<\/li><\/ul>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" width=\"592\" height=\"424\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-21.png\" alt=\"Code on Social Security, 2020\" class=\"wp-image-17460\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-21.png 592w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/10\/image-21-300x215.png 300w\" sizes=\"(max-width: 592px) 100vw, 592px\" \/><\/figure><\/div>\n\n\n\n<ul><li>To provide for the medical\neducation institutions and training institutes of the ESIC. It may be run by\nthe corporation itself or on the request by the central government or any state\ngovernment or any PSU of the central government;<\/li><\/ul>\n\n\n\n<ul><li>To authorize the central\ngovernment to outline any schemes for gig workers, unorganized workers, or\nplatform workers and for the members of their family &amp; providing benefits\nrelated to ESIC;<\/li><li>Requirements for maternity\nbenefits such as prohibition from work during such periods, claim for maternity\nbenefits, provision for nursing breaks etc;<\/li><li>To authorize the central\ngovernment, to outline the proposal for the purpose of providing social\nsecurity benefits to all the self-employed workers or any other class of workers.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p> The government\u2019s move to initiate The Code on Social Security, 2020 was done to consolidate the laws related to social security and to make improvement over the previous versions of these labour laws. The merging of the said laws will facilitate implementation as well as remove the variety of definitions provided in the previous Acts.
