These NGO are working for the upliftment of the economically weaker sections of the Society so that they stand equal in Society. These organizations help in development in the Society to live an improved life in the Society. NGO work to bring a positive change in the Society, area and situations.<\/p>\n\n\n\n<p><strong><em>There are two kinds of NGO: <\/em><\/strong><\/p>\n\n\n\n<ul><li><strong>\u00a0A\u00a0private\u00a0NGO \u2013<\/strong> A non-profit private foundation is a\u00a0charitable entity that is usually formed by a single benefactor, generally any\u00a0individual\u00a0or any business.<\/li><li>\u00a0<strong>A\u00a0public\u00a0NGO \u2013<\/strong> a public NGO works like a charity and functions by using publicly collected funds to openly support and sustain its initiatives.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Laws_Applicable_for_NGO_Registration\"><\/span>What are the Laws Applicable for NGO Registration? <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>In order to be clear about the whole process of\u00a0NGO registration and its choices, you need to focus on these subjects:-<\/em><\/strong><\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" width=\"629\" height=\"277\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/02\/image-4.png\" alt=\"process of NGO registration \" class=\"wp-image-3326\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/02\/image-4.png 629w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/02\/image-4-300x132.png 300w\" sizes=\"(max-width: 629px) 100vw, 629px\" \/><\/figure><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Trust under Public Trust Act of each State<\/h3>\n\n\n\n<p>There are different Trust Acts for all states in\nIndia. In case there is no Trust Act for a particular state, the general rules\nof the Indian Trust Act 1882 are followed. Usually, when&nbsp;<em><strong>there is\nproperty involved a charitable trust is formed<\/strong><\/em>. An&nbsp;<em><strong>Author or\nSettlor<\/strong><\/em>&nbsp;is the person who intends to form the Trust. An\nAuthor is the one who knows the main reason for the formation of Trust. <\/p>\n\n\n\n<p>A&nbsp;<em><strong>minimum of 2 trustees&nbsp;<\/strong><\/em>is\nneeded to form a trust. There is&nbsp;<em><strong>no limit on the maximum number<\/strong><\/em>&nbsp;of\nthe trustees. The main document&nbsp;<em><strong>required for the formation of the Trust is the\nTrust Deed<\/strong><\/em>. In a Trust Deed the main aims and objectives of the\nTrust, how the Trust will be managed, appointment and removal of the Trustees,\netc. should be clearly written. The Trust deed should be signed by both the\ntrustees in the presence of two witnesses.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Society under Societies\nRegistration Act, 1860<\/h3>\n\n\n\n<p>A society is a form of organization which is formed\nby a group of individuals who come together to promote literature, social\nwelfare, social development, fine arts, useful knowledge, military orphan\nfunds, maintenance of public museums, public libraries and any other social and\ncharitable causes. <\/p>\n\n\n\n<p>A\u00a0minimum of 7\u00a0people of are needed to form a society under\u00a0<strong><em>Societies Registration Act, 1860<\/em><\/strong><a href=\"https:\/\/www.mca.gov.in\/Ministry\/actsbills\/pdf\/Societies_Registration_Act_1860.pdf\"><sup><em><strong>[1]<\/strong><\/em><\/sup><\/a>. The name of all seven members should be mentioned in the Memorandum of Association (MOA), and the same names should also be filed with the Registrar of Joint Stock Companies to form Society under Societies Registration Act, 1860.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Section 8 Company under Companies Act 2013<\/h3>\n\n\n\n<ul><li><a href=\"https:\/\/corpbiz.io\/section-8-company-registration\"><strong>Section 8 Company\nregistration&nbsp;<\/strong><\/a>formed under the Companies Act 2013 has the same purpose\nas the Trust and Society. Any company registered as a Non-Profit Organization\n(NPO) company under Section8 of\nthe Company Act&nbsp;when such company has the motive of promoting\ncharity, arts, education, protection of environment, commerce, religion,\nsports, science and social welfare intending to use its profits or other income\nfor the purpose of promoting these objectives. The profit made under this\nsection is used for welfare, research and development purposes only. Also the\nobjective of the company under this section should mandatorily be that the\ncompany does not intend to pay any dividend to its members.<\/li><li>A minimum of 2 directors is needed if the Section 8 company is to be incorporated as a Private Limited Company whereas, a minimum of 3 directors if incorporated as Public Limited Company. The maximum number required in case of Public Limited Company has no limit, but on the other hand, a maximum of 200 directors can be there in Private Limited Section 8 Company.  <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"NGO_Registration_Process_Requirements\"><\/span>NGO Registration\nProcess\/ Requirements<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Trust Registration Process <\/h3>\n\n\n\n<p>The first step to be followed before registering a trust is to\u00a0form a Trust Deed. The main aims and objectives of the Trust should be clearly specified in the Trust Deed, along with the following pre-requisites:<\/p>\n\n\n\n<ul><li>Name  and Address of the Author<\/li><li>Name and Address of all the Trustees<\/li><li>Name of the Trust(minimum three preferences should be given)<\/li><li>Address of Registered Office of Trust<\/li><li>Beneficiaries<\/li><li>Purpose of Trust<\/li><\/ul>\n\n\n\n<p>Once the Trust Deed is completed, the same is\nsubmitted to the Registrar for&nbsp;<a href=\"https:\/\/corpbiz.io\/trust-registration\"><strong>Trust\nRegistration<\/strong><\/a>. The presence of the\nAuthor of the Trust, along with two witnesses, is required during registration.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" width=\"580\" height=\"264\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/02\/image-5.png\" alt=\"Registration Process of Trust\" class=\"wp-image-3328\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/02\/image-5.png 580w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/02\/image-5-300x137.png 300w\" sizes=\"(max-width: 580px) 100vw, 580px\" \/><\/figure><\/div>\n\n\n\n<h4 class=\"wp-block-heading\">Name Selection<\/h4>\n\n\n\n<p>The name selected should be a unique <strong><em>one and should not resemble to any <\/em><\/strong><a href=\"https:\/\/corpbiz.io\/society-registration\"><strong>society Registration<\/strong><\/a> already registered with <strong><em>the Societies Registration Act,<\/em><\/strong> <strong><em>1860.<\/em><\/strong> The other exemption which should be followed while finalizing the name of a Society is the restricted name list under the Emblems and names Act, 1950.<\/p>\n\n\n\n<p class=\"text-left\"><b>Read our article<\/b>:<mark style=\"background: #fffd03 !important;\"><a href=\"https:\/\/corpbiz.io\/learning\/online-ngo-registration-and-legal-procedure\/\">NGO Registration \u2013 Step by Step Procedure <\/a><\/mark><\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Memorandum of Association &amp; Rules\nand Regulations<\/h4>\n\n\n\n<p>The Memorandum of Association (MOA) and the Rules of the Society must be signed by each member of the Society, witnessed by the Chartered Accountant, Gazette Officer, Notary Public, Oath commissioner or a First Class Magistrate.<\/p>\n\n\n\n<p><strong><em>The MOA includes the following clauses:<\/em><\/strong><\/p>\n\n\n\n<ul><li>Name Clause<\/li><li>Registered Office Clause<\/li><li>Objectives Clause<\/li><li>Liability clause<\/li><li>Capital clause<\/li><\/ul>\n\n\n\n<p><strong><em>The\nRules and Regulations include the following clauses:<\/em><\/strong><\/p>\n\n\n\n<ul><li>Membership clause<\/li><li>Meeting clause<\/li><li>Dissolution<\/li><li>Legal procedure<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Other Documents<\/h4>\n\n\n\n<p><strong><em>The\nother documents required for the Registration process of Society are:<\/em><\/strong><\/p>\n\n\n\n<ul><li>A\ncover letter with a request to register the Society<\/li><li>ID\nProofs of all the members<\/li><li>Minutes\nof the meeting<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Documents Submission and Registration<\/h4>\n\n\n\n<p>The MOA with the Rules and regulations document is submitted to the Registrar of the Societies in the State. The Registrar if is satisfied with the documents and the terms and conditions mentioned, then he can certify your Society to be registered under the Societies Registration Act 1860.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Registration Process of Section 8 Company<\/h3>\n\n\n\n<p>The Companies under Section 8 can be incorporated in part A of Spice+ form by reserving the names followed by filling the part B of Spice+ form. During the incorporation of the company under section 8, the License number shall be given to that company. As stakeholders already having license can fill up the form with ease.<\/p>\n\n\n\n<ul><li><em><strong>Digital Signature Certificate (DSC)<\/strong><\/em>\u00a0\u2013 the digital signatures of all the proposed directors of the company are required during filing up      the company incorporation form. DSC is issued by the certified agencies as recognized by government.<\/li><li><em>After receiving the DSC, the directors shall file Form DIR-3 for getting the Director Identification Number with the ROC.<\/em><\/li><li><em><strong>\u00a0Directors Identification Number (DIN)<\/strong><\/em>\u00a0can be applied directly through\u00a0<em><a href=\"https:\/\/corpbiz.io\/learning\/new-spice-plus-form-launched-by-mca\/\"><strong>SPICe+ form<\/strong><\/a><\/em>.<\/li><li>\u00a0It is helpful if one opts for two different choices of a name as sometimes the proposed name for the Company does not get selected.<\/li><li>After name reservation\u00a0<em><strong>SPICE Form 32<\/strong><\/em>\u00a0will be filed with the\u00a0<em><strong>Registrar of Companies (ROC)<\/strong><\/em>\u00a0for the incorporation of the Company with the required documents.
