The type of music license depends on\nwhether the restaurant\/ bar\/ caf\u00e9 is playing pre-recorded music or hold live\nperformances.<\/p>\n\n\n\n<p><strong>1<em>.Phonographic Performance Limited (PPL)<\/em><\/strong>&nbsp;grants music license when you play pre-recorded music at the premises of your food business. Furthermore, any of the following forms can be used to play pre-recorded music in the restaurant;<\/p>\n\n\n\n<ul>\n<li>Gramophone Records<\/li>\n\n\n\n<li>CDs<\/li>\n\n\n\n<li>Music Cassettes<\/li>\n\n\n\n<li>Radio<\/li>\n\n\n\n<li>TV<\/li>\n\n\n\n<li>Any Audiovisual media<\/li>\n<\/ul>\n\n\n\n<p><strong>2.<em> Indian Performing Rights Society (IPRS)<\/em><\/strong> &#8211; On the other hand, you need a license from the Indian Performing Rights Society (IPRS) when you conduct live performances from singers, live band, or concert at your business premises.<\/p>\n\n\n\n<p><strong>3.<em> Indian Singer Rights Association (ISRA)<\/em><\/strong> was introduced in 2013, under Section 38 B of the Copyright Act and the purpose behind ISRA is to administer and manage from the performance of his singers and share the royalties that is collected among its singers.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pre-requirements_of_obtaining_a_Music_License\"><\/span>Pre-requirements\nof obtaining a Music License<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>You also need to pay attention to these details before applying for\nobtaining a Music License for your restaurant;<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Audible music range<\/li>\n\n\n\n<li>The area in square meter up to which the music is audible<\/li>\n\n\n\n<li>The number of seats in a restaurant, caf\u00e9 or other dining areas<\/li>\n\n\n\n<li>You need to specify the areas where music is audible such as restaurant\/cafe dining areas, bars or kitchens<\/li>\n\n\n\n<li>Types of devices, you are going to use to play music such as radio, CDs, TV etc<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fees_of_Music_license\"><\/span>Fees of Music\nlicense<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The fee of the music license from PPL is based upon the following\nfactors;<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>The type of place<\/li>\n\n\n\n<li>Number of hours<\/li>\n\n\n\n<li>Number of songs played<\/li>\n\n\n\n<li>The capacity of the venue<\/li>\n\n\n\n<li>The type of food business<\/li>\n<\/ul>\n\n\n\n<p>Furthermore, if you conduct live performances at your\nbusiness, you would need to apply for a music license from the IPRS. The amount of fees for a license in that case is Rs. 10, 000 per annum for Metro\ncities and for Non-Metro cities it is Rs. 5,000 per annum. Depending on the category of event there are various tariff schemes\navailable that can be carried\non in the premises and the\nminimum fee for the music public\nperformance at any store per\n5000 sq. ft is Rs. 2500. While\nthe music license received\nfrom ISRA, the license\nfees shall be calculated at the price of the minimum drink price on the menu card which is subject to\na minimum of Rs 3,650\/- p.a.<\/p>\n\n\n\n<p>On failing to make payment for the license granted by PPL, the person shall be liable to give an interest of 18% per\nannum together with\na penal charge of up\nto Rs 2 lakhs, while for\nthe non-payment for license approved\nby IPRS, the person shall be\nliable for an interest rate of 30 % p.a.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_required\"><\/span>Documents\nrequired<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>You need to submit these documents along with the application to get\nyour music license;<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Personal details, like name, nationality, address, etc.<\/li>\n\n\n\n<li>Information about the business you commence<\/li>\n\n\n\n<li>However, in case your business is an LLP, you have to submit the certificate of Incorporation<\/li>\n\n\n\n<li>List of the music you will play<\/li>\n\n\n\n<li><a href=\"https:\/\/corpbiz.io\/gst-registration\"><strong>GST registration certificate<\/strong><\/a>, if required<\/li>\n\n\n\n<li>PAN Card<\/li>\n\n\n\n<li>Address proof such as Electricity bill, Driver\u2019s License, Voter ID Card, etc.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Offences_and_penalties\"><\/span>Offences and\npenalties<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Restaurants\nthat plays pre-recorded music or holds live performances of any kind must\nobtain a Music License. Furthermore, any entity or businesses who do not\nregister with the respective Copyright Society or do any activity defined in\nSection 51 are liable for punishment under Section 63 and 63 A of the&nbsp;<strong>Copyright\nAct<\/strong><a href=\"https:\/\/en.wikipedia.org\/wiki\/Copyright_law_of_India\" target=\"_blank\" rel=\"noreferrer noopener\"><sup>[2]<\/sup><\/a>.<\/p>\n\n\n\n<p><strong><em>As per section 63 of the Copyright Act, any person who infringes the\ncopyrights or other rights is liable for a penalty as follows;<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Imprisonment for a period which is not less than six months which may be extended to three years<\/li>\n\n\n\n<li>With a fine, which is not less than Fifty Thousand Rupees which can be extended to two lakh rupees<\/li>\n<\/ul>\n\n\n\n<p><strong><em>Also, under section 63 A of the Copyright Act any person or entity who\ninfringes the copyrights or any other rights and is a repetitive lawbreaker is\nliable for punishment as follows;<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Jail term for a period which is not less than one year and which may be extended to three years<\/li>\n\n\n\n<li>Also, with a fine, which is not less than One Lakh Rupees and can be extended to Two Lakh Rupees<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Benefits_of_getting_a_Music_License\"><\/span>Benefits of\ngetting a Music License<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>There are numerous benefits of obtaining a Music license in India.
