The Act provides standards for the\nprotection of registered designs (as contemplated in the (WTO) World Trade\nOrganisation Agreement on&nbsp; (TRIPs)\nTrade-Related Aspects of IP Rights. It also conforms to international trends in\ndesign administration. <\/p>\n\n\n\n<p>The amendment in 2014 to the Designs Rules brings in &#8216;small entity&#8217; as a new category of applicants in addition to natural persons. India is the party to various international treaties that protect international designs, including the Paris Convention and Trade-Related Aspects of IP Rights. The finished article appeals to or is judged\nby the eyes.<\/p>\n\n\n\n<p>This definition is exhaustive, and the feature must fulfill\nall statutory requirements to constitute a design under the Act. The\nrequirement is the feature&#8217;s ability to appeal to the eye. It implies that the\nfeature must be visible on the article and have artistic merit or visual\nappeal. The Act provides an exception, which is a <strong><em>6-months grace period in the case\nof the design&#8217;s disclosure before filing an application. <\/em><\/strong><\/p>\n\n\n\n<p><strong><em>The grace period is available in case if:<\/em><\/strong><\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" width=\"610\" height=\"274\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/09\/image-5.png\" alt=\"Registered Designs\" class=\"wp-image-15713\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/09\/image-5.png 610w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/09\/image-5-300x135.png 300w\" sizes=\"(max-width: 610px) 100vw, 610px\" \/><\/figure><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Unregistered designs<\/h3>\n\n\n\n<p>It is important to have <a href=\"https:\/\/corpbiz.io\/design-registration\"><strong>Design registration<\/strong><\/a> as an unregistered design is not enforceable under the Design law. Hence, the design must be registered under the Act to enjoy protection. However, it is even possible to protect a design under other legislation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedures_of_Registered_Designs\"><\/span>Procedures of Registered Designs <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>All applicants or stakeholders can file design applications online through the official portal of an Office of the Controller General of&nbsp; Trademarks, Designs, and Patents.<\/li><li>The e-filing facility includes the comprehensive payment gateway that accepts electronic banking and debit and credit cards.<\/li><li>The Design Application Search Utility enables applicants to search for published design applications through a number of search inputs (e.g., an application number, applicant&#8217;s name, state, and country, date of filing, publication date, and name the article). <\/li><li>In order to apply to register a design, the applicant must complete <strong>Form 1,<\/strong> which includes its full name, nationality, address, the name of the article, the class number, and address for service in India. The applicant or its authorized <strong><em>agent<\/em><\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Agent\"><strong><em>[1]<\/em><\/strong><\/a><\/sup> may sign the application.&nbsp; <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Cancellation_of_Registered_Designs\"><\/span>Cancellation of Registered Designs<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>There is no particular provision to oppose the\nregistration of the design under Indian law. However, there <strong><em>is a\nprocedure for cancellation under which any interested person can file a\npetition for cancellation of the registered design<\/em><\/strong> at any time after\nthe registration with a controller on any of the following grounds:-<\/li><li>If the design is previously registered in India;<\/li><li>If the design has been published in India or any\nother country before the date of registration;<\/li><li>If a design is not original or new;<\/li><li>If the design cannot be registered under the\nAct;<\/li><li>If the design is not a &#8216;design&#8217; defined under\nSection 2(d) of the Act;<\/li><li>On receipt of the petition for cancellation, the\nDesign Office sends a copy of a petition and the evidence filed to registered\nowner.<\/li><li>After that, a registered owner files a counter-statement\nand evidence at the Design Office and delivers a copy to the petitioner. <\/li><li>After receipt of the counter-statement and\nevidence, the petitioner may file its reply statement and affidavit evidence.\nAfter hearing the parties, a hearing is fixed, and the controller rules on the\npetition and issues an order.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ownership_Changes_and_Rights_Transfers\"><\/span>Ownership Changes and Rights Transfers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per Indian design law, the right in a registered design\ncan be transferred through agreement, assignment, transmission, and licensing.\nRegistration of the title based upon assignment must be filed with the Design\nOffice within 6 months of execution of the assignment instrument. Further\nextension of 6 months can be sought.<\/p>\n\n\n\n<p>There is no other way to extend the time beyond 1 year after\nthe effective date of the instrument. The law also provides for the recorded\nlicense, which must be done within 6 months of the issue. Only a registered\nlicense or a registered assignment in respect of the registered design is\nadmissible as evidence before the courts or in other proceedings. Therefore\nsuch an instrument must be registered with the Design Office.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The procedural formalities are simple, time-constrained, and cost-effective. However, applicants must follow the procedural requirements carefully. Most Indian design applications were rejected on procedural issues, while very few rejections are due to a lack of fulfillment of substantive criteria.
