According to <strong>Section 3<\/strong> of Water (Prevention &amp; Control of Pollution) Act, the Central Board is constituted by the Central Government is known as the <strong><em>Central Pollution Control Board<\/em><\/strong>. <\/p>\n\n\n\n<p>The Central Board must be considered a body corporate with\nperpetual succession with the power to acquire, hold, and dispose of it. <strong>Section 3(3)<\/strong> of the Water (Prevention\n&amp; Control of Pollution) Act, 1974, can also enter into a contract with the\nperson or party. They can sue or can be sued in the name of the Central Board.<\/p>\n\n\n\n<p>According to <strong>Section\n4<\/strong>, the State Boards must be constituted by the State Government, which is\nknown as the <strong><em>State Pollution Control Board<\/em><\/strong>. Every State Board must be\nconsidered as a body corporate having perpetual succession with the power to\nhold, acquire, and dispose of the property. It can also enter into a contract\nwith any person or party. class=\"wp-block-heading\">Advise Central Government<\/h3>\n\n\n\n<p>The Central Pollution Control Board has to advise the <strong><em>Central Government<\/em><\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Central_government\"><strong><em>[1]<\/em><\/strong><\/a><\/sup> on preventing and controlling water pollution.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Co-Ordination with the State Board<\/h3>\n\n\n\n<p>Central Pollution Control Board is to co-ordinate Active-Board\nactivities to resolve disputes among them.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Technical Assistance and Guidance to State Boards<\/h3>\n\n\n\n<p>The Central Pollution Control Board has to provide technical assistance and guidance to State Boards, to carry out investigations and research relating to the problem of water pollution and prevention, control, or reduction of water pollution.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Various Training Programs<\/h3>\n\n\n\n<p>The Central Pollution Control Board is to organize and plan the training programs for persons engaged or engaged in prevention, control, or reduction of water pollution.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Organizing a Comprehensive Programme<\/h3>\n\n\n\n<p>The Central Pollution Control Board is to organize a\ncomprehensive program through mass Data<\/h3>\n\n\n\n<p>The Central Pollution Control Board has to collect, compile,\npublish technical and statistical relating to water pollution. Besides the aforesaid statutory functions.\nMoreover, the State Board also performs functions as may be prescribed from\ntime to time or may be entrusted to it by the Central Pollution Control Board\nor the State Government.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Powers_of_Central_Pollution_Control_Board\"><\/span>Powers of Central Pollution Control Board<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The Central Pollution Control Board has the following powers:-<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>The Central Pollution Control Board has been empowered by <strong><em>Section 18<\/em><\/strong> of the Water (Prevention &amp; Control of Pollution) Act to give directions to the State Pollution Control Boards. <\/li>\n<\/ul>\n\n\n\n<ul>\n<li>The Central Pollution Control Board has the\npowers to perform any of the functions of a State Pollution Control Board in\ncase of a non-compliance with the Central Pollution Control Board&#8217;s directions.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>The Central Pollution Control Board has been\nempowered to issue directions under <strong><em>section 33A<\/em><\/strong> of the Water (Prevention\n&amp; Control of Pollution) Act to direct the prohibition, closure, or\nregulation of any operation, industry, or process or regulation of supply\nelectricity, water or any other service.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Powers_of_State_Pollution_Control_Board\"><\/span>Powers of State Pollution Control Board<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The State Pollution Control Board has the powers conferred on it are as follows:<\/em><\/strong><\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\"><img decoding=\"async\" width=\"638\" height=\"560\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/08\/image-117.png\" alt=\"Powers of State Pollution Control Board\" class=\"wp-image-15464\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/08\/image-117.png 638w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/08\/image-117-300x263.png 300w\" sizes=\"(max-width: 638px) 100vw, 638px\" \/><\/figure><\/div>\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"List_of_Important_Cases_along_with_its_Interpretation\"><\/span>List of Important Cases along with its Interpretation <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul>\n<li>The Supreme Court in <strong><em>M.C.Mehta v. Union of India<\/em><\/strong>\nheld that the ternaries&#8217; financial capacity is not the relevant consideration\nwhile requiring them to set up the primary treatment plants. The industry which\ncannot set up the primary treatment plant cannot be granted consent by the\nState Pollution Control Board to continue its business.<\/li>\n\n\n\n<li>It was held in <strong><em>Narula Dying and Printing Works\nv. Union of India<\/em><\/strong> that the consent order made under <strong><em>section\n25 (2)<\/em><\/strong> of Water (Prevention &amp; Control of Pollution) Act by the\nState Pollution Control Board does not entitle the industrial unit to discharge\ntrade effluents into a stream. A unit must comply with the conditions mentioned\nin a consent order and install effluent treatment plants with the consent\norder&#8217;s time.<\/li>\n\n\n\n<li>In the matter of<strong><em> Mahavir Soap and Godakhu Factory\nv. Union of India<\/em><\/strong>, the State Pollution Control Board refused to consent\nto the factory&#8217;s continuation in the populated area on the public complaint. It\nwas held that genuine reason for the refusal to grant consent. The Court\nfurther had no reason to substitute its opinion in place of State Pollution\nControl Board&#8217;s decision. <\/li>\n\n\n\n<li>In the matter of<strong><em> T.N. Godaverman Tirumalpad v.\nUnion of India<\/em><\/strong>, it was held that where various sources of pollution are\nregulated by a State Pollution Control Board step by step. It was not for Court\nto direct the government as to which step has to be regulated first.<\/li>\n\n\n\n<li>The Supreme Court in <strong><em>Andhra Pradesh Pollution Control\nBoard v. M.V. Nayudu<\/em><\/strong> stated that prohibition under <strong><em>section 25<\/em><\/strong> of Water\n(Prevention &amp; Control of Pollution) Act, extends even to newly opening\nindustries in the process of being set up. Hence, permission required from a\nState Pollution Control Board must be sought when steps are being taken to\nestablish an industry.<\/li>\n\n\n\n<li>In <strong><em>the matter of Mahabir Soap and Godakhu\nFactory v. Union of India, <\/em><\/strong>the State Pollution Control Board, refused\nto consent to the continuation of industry on the ground that the factory is\nlocated in the populated area, and there was a public complaint. It was held\nthat the reasons cited by the State Pollution Control Board conform with the\nobject of the Water (Prevention &amp; Control of Pollution) Act. The Court\nfurther held that the refusal is at the discretion of the State Pollution\nControl Board.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Water (Prevention &amp; Control of Pollution) Act has vested with some necessary powers and functions of Central Pollution Control Board and the State Pollution Control Boards.
