{"id":15181,"date":"2020-08-22T12:43:38","date_gmt":"2020-08-22T07:13:38","guid":{"rendered":"https:\/\/corpbiz.io\/learning\/?p=15181"},"modified":"2021-01-29T15:35:47","modified_gmt":"2021-01-29T10:05:47","slug":"consent-for-noc-from-state-pollution-control-board-india","status":"publish","type":"post","link":"https:\/\/corpbiz.io\/learning\/consent-for-noc-from-state-pollution-control-board-india\/","title":{"rendered":"Consent for NOC from State Pollution Control Board"},"content":{"rendered":"\n<p class=\"has-drop-cap\">The industries are required to obtain consent to operate (CTO) for NOC from the State Pollution Control Board to operate an outlet <strong><em>under section 25<\/em><\/strong> of the Water (Prevention and Control of Pollution) Act, 1974 and to operate an industrial plant <strong><em>under section 21<\/em><\/strong> of the Air (Prevention &amp; Control of Pollution) Act, 1981. <strong>Consent to Operate<\/strong> is important, before carrying out any action at the industrial plant or activity. For all categories of Industries and Projects,  a composite Performa has been prescribed by the State Pollution Control Board for obtaining consent to operate or <a href=\"https:\/\/corpbiz.io\/noc-pollution-control-board\"><strong>NOC from Pollution Control Board<\/strong><\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Process for Obtaining NOC<\/h2>\n\n\n\n<ul><li>Under the existing pollution Control Laws, all types of industrial units, before establishing, are required to obtain consent to establish (No Objection Certificate) from the environmental pollution angle. For this purpose, the Board has prescribed an application format.<\/li><li>Industries are required to <strong><em>submit an application and necessary enclosures<\/em><\/strong> pertaining to information like site details, proposed pollution control plans, registration certificates from the Industry Department, etc.<\/li><li>The complete application will be <strong><em>submitted to the General Manager, District Industrial Centre<\/em><\/strong> (GM, DIC) or <strong><em>Member Secretary<\/em><\/strong>, Pollution Control Board, or <strong><em>Regional Officers<\/em><\/strong> of Pollution Control Board. <\/li><li>To simplify the process of Obtaining Consent for (NOC), the Board has decentralized the power of issuance of this certificate. It has delegated to GM, DIC, and Regional officers.<\/li><li>The <strong><em>application must be disposed of within four months<\/em><\/strong> from the date of receipt of the application to the Board. Critical Control Point: HACCP Certification<\/a><\/mark><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">A chart describing the Validity of NOC and Time duration for obtaining NOC<\/h3>\n\n\n\n<p><\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" width=\"646\" height=\"636\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/08\/image-92.png\" alt=\"Validity of NOC and Time duration for obtaining NOC\" class=\"wp-image-15182\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/08\/image-92.png 646w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/08\/image-92-300x295.png 300w\" sizes=\"(max-width: 646px) 100vw, 646px\" \/><\/figure><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">NOC from State Pollution Control Board for new Industries<\/h2>\n\n\n\n<p>For setting up new industries or to change in a production\nprocess or modernization or capacity enhancement, the provision has been made\nthat the entrepreneur must have to obtain <strong>No\nObjection Certificate<\/strong> from the Board for Air Pollution and Water Pollution.\n<\/p>\n\n\n\n<p>The motive behind issuing NOC is that where the industry is proposed to be implemented, that there will not be any future aggravation in environmental pollution due to the industry&#8217;s establishment. <strong><em>The application for a highly polluting industry is disposed-off within four months from the date of receipt of an application to the Board and for remaining within one month. <\/em><\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Exemption from obtaining No Objection Certificate<\/h3>\n\n\n\n<p>The exemption from obtaining the consent of the Board under the provisions of the Water (Prevention &amp; Control of Pollution) Act, and Air (Prevention &amp; Control of Pollution) Act, and <strong><em>Hazardous Waste<\/em><\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Hazardous_waste\"><strong><em>[1]<\/em><\/strong><\/a><\/sup> (Management &amp; Handling &amp; Transboundary Movement) Rules, 2008, if the unit satisfies the following conditions:<\/p>\n\n\n\n<ul><li>That the industry is established or being\nestablished in the demarcated Industrial Estates or Zones classified by the\nState Authorities viz PSIEC, Department of Industries, PUDA, CTP under a draft\nmaster plan or in mixed category area of predominantly industrial areas within\nMunicipal limit of a city after classification of the area by CTP\/STP\/DTP.<\/li><\/ul>\n\n\n\n<ul><li>That the investment of the <strong><em>industry is not more than Rs. 1\nCrore on plant and machinery<\/em><\/strong><\/li><\/ul>\n\n\n\n<ul><li>That the investment of <strong><em>the industry is not more than Rs.\n2 Crore on plant and machinery for hosiery units<\/em><\/strong><\/li><\/ul>\n\n\n\n<ul><li>That there will not be any discharge of trade\neffluent from the industry into stream or well or sewer or onto land and that <strong><em>industry\nwill not discharge any air pollution, including noise into the atmosphere.<\/em><\/strong><\/li><\/ul>\n\n\n\n<ul><li>That is, the <strong><em>industry will not discharge any\ntoxic or hazardous wastes and will not handle any toxic or hazardous chemicals<\/em><\/strong>.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n\n\n<p>As per the provisions of Water (Prevention &amp;
