The sections of the Act were enforced with effect from 1st May 2017.  The government notified the Bihar Real Estate (Regulation &amp; Development) Rules 2017 (Including Agreement for Sale Rules) of Bihar on <strong>28th April 2017<\/strong>. The Real Estate Regulatory Authority (RERA Bihar) will provide the platform for <a href=\"https:\/\/corpbiz.io\/rera-registration\"><strong>RERA Registration<\/strong><\/a> of a Real Estate Project with Promoter details and a Real Estate Agent. Exercising power conferred by the third proviso to <strong><em>sub-section (1) of section 20<\/em><\/strong> and first proviso to<strong><em> subsection (4) of section 43 of the Act<\/em><\/strong><sup><a href=\"http:\/\/www.aaptaxlaw.com\/income-tax-act\/section-43-income-tax-act-definitions-of-certain-terms-relevant-to-income-from-profits-and-gains-of-business-or-profession-sec-43-of-income-tax-act-1961.html\"><strong><em>[1]<\/em><\/strong><\/a><\/sup>, The Government of Bihar has designated with the Principal Secretary, Urban Development &amp; Housing Department, Government of Bihar as a Regulatory Authority and The Bihar Land Tribunal, as an Appellate Tribunal respectively.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" width=\"596\" height=\"452\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/08\/image-26.png\" alt=\"Components of RERA Bihar\" class=\"wp-image-14444\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/08\/image-26.png 596w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/08\/image-26-300x228.png 300w\" sizes=\"(max-width: 596px) 100vw, 596px\" \/><\/figure><\/div>\n\n\n\n<p>The Appellate Tribunal shall hear an appeal from the decisions, directions, and orders of a Real Estate Regulatory Authority. If any person is aggrieved by the direction or order or decision made by the Authority or by an adjudicating officer can file an appeal before the Appellate Tribunal.<\/p>\n\n\n\n<p class=\"text-left\"><b>Read our article<\/b>:<mark style=\"background: #fffd03 !important;\"><a href=\"https:\/\/corpbiz.io\/learning\/online-rera-registration-process-for-builders\/\">All You Need To Know About RERA Registration Process<\/a><\/mark><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Requirements_of_RERA_Bihar_Real_Estate_Projects_Registration\"><\/span>Requirements of RERA Bihar Real\nEstate Projects Registration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>All commercial and the\nresidential real estate projects will have to register except the projects\nwhere<\/em><\/strong><\/p>\n\n\n\n<ul><li>An area\nof land proposed to be developed which does not exceed <strong><em>500 sq m. <\/em><\/strong><\/li><li>A\nnumber of the apartments proposed to be developed, which <strong><em>does not exceed 8<\/em><\/strong> units\ninclusive of all phases.<\/li><li>The\nPromoter has received the completion certificate for a real estate project\nbefore the commencement of the Act.<\/li><li>In case\nof the repair or renovation or re-development, and does not involve marketing,\nselling, advertising, or new allotment of a plot, apartment, or building under\na real estate project.<\/li><li>The\nPromoter of ongoing real estate projects, in which all buildings as per\nsanctioned plan have not received a Completion Certificate, must require to be\nregistered for such phase of a project, which consists of buildings not having\nan occupation or completion certificate.<\/li><\/ul>\n\n\n\n<p>If the Promoter fails to register as per Act, he must be liable to a penalty that may extend up to <strong><em>10% percent<\/em><\/strong> of the estimated cost of a real estate project. If violation continued, he must be liable for an imprisonment of a term which can be extended up to <strong><em>3 years<\/em><\/strong> or with the fine which can be extended up to further <strong><em>10% percent<\/em><\/strong> of the estimated cost of a real estate project, or with both, as mentioned in <strong><em>Rule 35<\/em><\/strong> of Bihar Real Estate (Regulation and Development) Rules 2017. Apart from RERA Registration, the promoters shall be required to provide quarterly updates on the project&#8217;s status to the Authority. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"RERA_Bihar_Agents_Registration\"><\/span>RERA Bihar Agents Registration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>All the\nReal Estate Agents have to register under the RERA Act. No real estate agent\nmust facilitate a sale or purchase on behalf of any other person to facilitate\na sale or purchase of the plot, apartment, or building, in the real estate\nproject without obtaining RERA registration under the section.<\/li><li>Suppose\nany real estate agent fails to register. In that case, he must be liable to a <strong>penalty of Rs 1000<\/strong>, for every day\nduring which such default continues, which can cumulatively extend up to 5%\npercent of the cost of the plot, apartment, or buildings of the real estate\nproject.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Complaints_made_in_RERA_Bihar\"><\/span>Complaints made in RERA Bihar<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>Any aggrieved person can file a <a href=\"https:\/\/corpbiz.io\/rera-complaint\"><strong>RERA complaint<\/strong><\/a> with the Bihar RERA or with an adjudicating officer with respect to the registered real estate project. Complaints can be filed for any violation or contravention of the Act&#8217;s provisions or the rules and regulations made thereunder.<\/li><li>Any person aggrieved by the decision or direction or order made by the Bihar RERA or by an adjudicating officer can file an appeal before the Appellate Tribunal.<\/li><li>Any person aggrieved by the Appellate Tribunal&#8217;s decision or order may file an appeal to the High Court.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_of_filing_complaint_in_RERA_Bihar\"><\/span>Process of filing complaint in\nRERA Bihar<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Step1:<\/em><\/strong> Go to a complaint registration on the RERA\nBihar portal through the website (https:\/\/rera.bihar.gov.in\/) and select the\noption of complaining before RERA or before an adjudicating authority. <\/p>\n\n\n\n<p><strong><em>Step 2:<\/em><\/strong> The form can be filled online with all the\ndetails required to be furnished in the column of complaint against and also\nrequire mentioning that a project is registered in RERA Bihar or not. <\/p>\n\n\n\n<p><strong><em>Step 3:<\/em><\/strong> Details of a complainant, the address, and\nContact details are the mandatory fields that need to be properly filled.<\/p>\n\n\n\n<p><strong><em>Step 4:<\/em><\/strong> Fill details of a respondent, address, and\nother details of the complaint mentioning about the relief sought from RERA\ntherein. <\/p>\n\n\n\n<p><strong><em>Step 5:<\/em><\/strong> After attaching the supporting documents,\none has to make an online payment or bank draft of Rs. 1000\/- and then declare\nand verify the consent by clicking on the submit button. <\/p>\n\n\n\n<p><strong><em>Step 6:<\/em><\/strong> Retain the complaint reference number for\nfuture use. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The real estate sector has its growth in recent years but has largely been unregulated from consumer protection.
