There began a norm for strict compliance under RERA that had to be adhered to by each developer, builder, and construction giant in different parts of the country. Most of the states have established their RERA offices where they work under the established Act. It gives complete details of a project to RERA authority and the public at large, which would try to ensure that all compliances are met. Some of the compliance is as under:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Uploading of Agreement\/Approval\/Plan, etc<\/h3>\n\n\n\n<p>RERA regulation\nhas mandated to publish the details along with the copy of agreements,\napprovals, etc., on the website of RERA Authority for the general public\nviewing purpose.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Quarterly updating with the RERA<\/h3>\n\n\n\n<p>Every registered\nproject must update the project&#8217;s prescribed details on the website of the\nrespective State RERA authority. Failure to do so may attract heavy penalties\nand penal proceedings from the RERA authority.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Separate bank accounts required for 70% of receipts<\/h3>\n\n\n\n<p>According to the\nRERA law, every developer is required to deposit 70% of the receipts from the\ncustomers in a separate RERA designated account, which must be used only for\ncost of a project. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Comply with Prescribed process of booking and the\nallotment<\/h3>\n\n\n\n<p>RERA regulations\nhave prescribed certain obligations and responsibilities on the developers\nwhile booking a new flat or allotment, some of them are:<\/p>\n\n\n\n<ul><li>Ensure that the transaction is\ndone through RERA registered agent<\/li><li>Making available the approved\nplan to a buyer<\/li><li>Non-acceptance of the advance\nmore than 10% of unit cost<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Taking necessary approval and the insurance<\/h3>\n\n\n\n<p>According to <strong>RERA regulation<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Real_Estate_(Regulation_and_Development)_Act,_2016\"><strong>[1]<\/strong><\/a><\/sup>, the builder or developer is required to take all the necessary approvals and insurance, as required by the state laws. RERA regulations relating to the insurance are very confusing and must require detailed research. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Formation of the allottee&#8217;s association<\/h3>\n\n\n\n<p>As per RERA\nregulations, every builder or developer shall form the society\/association or\nco-operative society as prescribed by the respective State Government. If the State\nGovernment specifically provides nothing, then society must be constituted\nwithin 3 months from a month in which majority of flats are sold.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Timely completion and delivery, including common areas<\/h3>\n\n\n\n<p>Every builder and\nassociation is required to complete a project at a given time and give\npossession within 3 months. All the common areas must be transferred to an\nassociation of the allottees.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Review of building quality<\/h3>\n\n\n\n<p>The developer\nrequires reviewing the quality of the building. Of the\ntotal collections, only <strong><em>30% have to be withdrawn<\/em><\/strong> or used\nwithout any restriction.<\/li><li>If the estimated receivables of\nan ongoing project are less than the estimated cost of completion of a project,\nthen 100% of the amount to be realized from the allottees must be deposited in\nthe said separate account. <\/li><li>Withdrawal from a RERA Account\nto be certified by the Architect, Engineer, and Chartered Accountant.<\/li><li>Withdrawals from a RERA Account\nto be in proportion to the percentage completion method.<\/li><li>Withdrawals from a RERA Account\ncan be made for the purpose of payment of construction and land cost of that\nproject only.<\/li><li>The amount in the RERA\ndesignated account cannot be used for Admin and Marketing expenses.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_objective_of_the_RERA_Act\"><\/span>The objective of the RERA Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The RERA aims to\nestablish a Real Estate Regulatory Authority that would regulate and promote\nthe real estate sector. The main objective of the Act is to protect the\ninterest of homebuyers and promote timely delivery of properties or projects. <\/p>\n\n\n\n<p>The RERA was also\nenacted to boost investment in the sector. The provisions like timely\ncompletion and delivery of the projects to a buyer and making the information\nof a project plan, layout, government approvals, land title status, and\nsub-contractors available, consent of 2\/3rd of the allottees on any alteration\nor addition in the project, and other such provisions, would bring in more\naccountability and transparency in a real estate sector. <\/p>\n\n\n\n<p>RERA has been\nimplemented and enacted in all states as well as Union Territories except in\nthe States of Jammu and Kashmir and West Bengal. The State of West Bengal has\nfollowed the different path altogether. Instead of RERA, a State of West Bengal\nhas implemented, the West Bengal Housing Industry Regulation Act. Also, the\nState Advisory Council of Jammu and Kashmir has approved the Real Estate\n(Regulation and Development) Bill, 2018.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The legislative regime was not too strong to render a developer and a builder guilty of misconduct and also for breaching the terms and conditions of the builder buyer agreement in the long run.
