The State Government may also establish one or more benches of Real Estate Appellate Tribunal for various jurisdictions in the State or UT. <\/p>\n\n\n\n<p>Many states have established regulatory authority under the <a href=\"https:\/\/corpbiz.io\/rera-registration\"><strong>RERA<\/strong><\/a> wherein the mechanism for speedy dispute redressal has been established. The Government or the competent authority or any person aggrieved by any decision or direction or order made by the Authority or Adjudicating officer can prefer an appeal before the Appellate Tribunal having jurisdiction over the matter. The word &#8220;<strong>Person&#8221;<\/strong> as above must include an association of allottees or any other voluntary consumer association registered under any law. <\/p>\n\n\n\n<p><strong><em>A promoter files an\nappeal with an Appellate Tribunal. It must not be entertained without the\npromoter first deposited with the Appellate Tribunal:-<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>At least <strong><em>30%<\/em><\/strong> of the penalty imposed or such higher percentage may be\ndetermined by an Appellate Tribunal or<\/li>\n\n\n\n<li>The total amount to be paid to an allottee including interest and\ncompensation imposed on him, or <\/li>\n\n\n\n<li>With both, before the said appeal is heard.<\/li>\n<\/ul>\n\n\n\n<p>Every\nappeal must be preferred within 60 days from the date the Govt receives a copy\nof direction or order or decision made by the Authority or Adjudicating officer\nor the competent authority or the aggrieved person. <\/p>\n\n\n\n<p>Every appeal must be filed in triplicate in <strong><em>form &#8216;L&#8217; along with fees of Rs. 5,000<\/em><\/strong> through DD and true copy of the order against which appeal is filed. The Appellate Tribunal shall endeavor to dispose of the appeal within 60 days from the date of receipt of an appeal.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Revision_of_orders_of_RERA_Adjudicating_Officer\"><\/span>Revision of orders of\nRERA \/ Adjudicating Officer<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p> The Appellate Tribunal may examine the legality or propriety or correctness of any order or decision or direction of the authority or the Adjudicating officer, on its motion or otherwise, call for the records relevant to disposing of such appeal and make such orders as it thinks fit. <\/p>\n\n\n\n<p class=\"text-left\"><b>Read our article<\/b>:<mark style=\"background: #fffd03 !important;\"><a href=\"https:\/\/corpbiz.io\/learning\/permissible-expenses-can-be-charged-to-rera-account\/\">Guide on Permissible expenses can be charged to RERA Account<\/a><\/mark><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Powers_of_Appellate_Tribunal\"><\/span>Powers of Appellate\nTribunal<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>All proceedings before the Appellate Tribunal are judicial proceedings under the Indian Penal Code and shall be deemed civil court for <strong><em>section 195<\/em><\/strong> of Cr. PC, 1973. The Appellate Tribunal must not be bound by the technicalities of the <strong>Code of Civil Procedure, 1908<\/strong>, and the Evidence Act. The principles of natural justice must bound the Appellate Tribunal.<\/p>\n\n\n\n<p><strong><em>The Appellate Tribunal must have all the powers of the Civil Court under CPC, 1908 in respect of following matters:-<\/em><\/strong><\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\"><img decoding=\"async\" width=\"520\" height=\"516\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/07\/image-129.png\" alt=\"The Appellate Tribunal must have all the powers of the Civil Court under CPC, 1908\" class=\"wp-image-13761\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/07\/image-129.png 520w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/07\/image-129-150x150.png 150w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/07\/image-129-300x298.png 300w\" sizes=\"(max-width: 520px) 100vw, 520px\" \/><\/figure><\/div>\n\n\n<h3 class=\"wp-block-heading\">Additional Powers of\nthe Appellate Tribunal<\/h3>\n\n\n\n<p><strong><em>The Appellate\nTribunal must exercise the following additional powers:<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Require a promoter or allottee or real estate agent to furnish in\nwriting such information or explanation or produce such documents reasonable\ntime, as it may deem necessary <\/li>\n\n\n\n<li>It was requisitioning any public record or document or copy of such\nrecord or document from any office.<\/li>\n\n\n\n<li>The Appellate Tribunal can call upon such experts or consultants from\nthe fields of economics, commerce, accountancy, real estate, competition, construction,\narchitecture, law or engineering or from any other discipline as it deems\nnecessary, to assist the Appellate Tribunal in the conduct of any inquiry or\nproceedings before it.<\/li>\n\n\n\n<li>Every order of an Appellate Tribunal under this Act must be executable\nby the Appellate Tribunal as a decree of the Civil Court.<\/li>\n\n\n\n<li>The Appellate Tribunal can send any of its orders to a Civil Court\nhaving local jurisdiction, and such Civil Court must execute the order as if it\nwere a decree made by the court.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Appeal to High Court<\/h3>\n\n\n\n<ul>\n<li>Any person aggrieved by any decision or order of an Appellate Tribunal\ncan file an appeal to the High Court within 60 days from the date of receipt of\nthe Appellate Tribunal&#8217;s decision or order.<\/li>\n\n\n\n<li>No appeal must be made against any decision or order made by the\nAppellate Tribunal with the party&#8217;s consent.<\/li>\n\n\n\n<li>The expression \u201cHigh Court\u201d means the High Court of a State or UT where\nthe real estate project is situated.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Main Points for consideration<\/h3>\n\n\n\n<ul>\n<li>No civil court must have jurisdiction to entertain any suit or\nproceedings in respect of any matter over which the Adjudicating officer, RERA\nAuthority, or RERA Appellate Tribunal is empowered by or under this Act to\ndecide the matter.<\/li>\n\n\n\n<li>No injunction or stay must be granted by any court or any other\nauthority in respect of any action taken or to be taken in pursuance of any\npower conferred by or under this Act.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Real Estate Appellate Tribunal (REAT) has been set up to hear appeals against orders passed by the Real Estate Regulatory Authority. It was established under <strong><em>Section 43<\/em><\/strong> of the Real Estate Regulation Act, 2016, that the REAT can examine the legality of orders passed by the RERA and decide whether to uphold or overturn them. Orders passed by REAT can further be appealed by filing an appeal in the High Court.
