Under this Act, the State Government is required to\nestablish the Real Estate Regulatory Authority for regulation and for promotion\nof the real estate sector. All Real Estate Agents must be registered under this\nAct. Under this Act, all the States have to appoint a Real\nEstate Regulatory Authority that carries out the purposes of the Act. The\nPunjab Government has notified the Real Estate (Regulation and Development)\nRules, 2017, on <strong>June 08, 2017<\/strong>. The Punjab\nRERA was established on date <strong>August 10,\n2017,<\/strong> upon the joining of Chairperson with two full-time Members.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Relief_for_Promoter_in_the_light_of_COVID-19_pandemic_under_Punjab_RERA\"><\/span>Relief\nfor Promoter in the light of COVID-19 pandemic under Punjab RERA<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Punjab RERA has considered the situation of Covid-19 pandemic, and\nfor the same purpose the following relief is granted by the Authority:<\/p>\n\n\n\n<ul><li>For the registered projects whose completion date\nwas on or before <strong>March 15, 2020<\/strong>, the\nperiod of validity of registration of such projects will be extended for <strong><em>further\nsix months from the original date<\/em><\/strong>.<\/li><li>For all registered projects whose registration has\nlapsed prior to March 15, 2020, and also the application for the extension has\nnot yet been made, there the period of validity for registration for such\nprojects is <strong><em>extended by six months<\/em><\/strong>. Provided the application can be made\nfor extension after paying late fees. Punjab RERA has primary objectives to help in promoting transparency within the real estate sector.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Real Estate Agents<\/h3>\n\n\n\n<p>Under the <strong>RERA Act 2016<\/strong><sup><a href=\"https:\/\/www.indiacode.nic.in\/handle\/123456789\/2158?locale=en\"><strong>[1]<\/strong><\/a><\/sup>, all Real Estate Agents must have to register with Punjab RERA before having any sale. Promoters, while applying for registration to Punjab RERA, must provide the names of registered agents who would be facilitating the sale of plot and apartments in the said project. No promoter will\nadvertise, sell, book, or offer for sale or invite persons to purchase in any\nmanner any plot, apartment, or building, in any real estate project, or part of\nit without having registration the real estate project with Punjab RERA. <\/p>\n\n\n\n<p>The Promoter of ongoing real estate projects, in which all buildings as\nper sanctioned plan have not received occupation or <strong><em>Completion Certificate, shall\nalso be required to be registered for such phase of the project<\/em><\/strong>. Here are the functions that Punjab\nRERA performs.<\/em><\/strong><\/p>\n\n\n\n<ul><li>As specified by overarching RERA rules, Punjab RERA\nand its policies are hosted on the official RERA website of State <a href=\"https:\/\/rera.punjab.gov.in\">https:\/\/rera.punjab.gov.in<\/a>. <\/li><li>To promote the real estate growth within the State,\nthe Punjab RERA has created a strong, efficient, transparent, and competitive\nenvironment.<\/li><li>RERA Act of Punjab oversees the sale of plots and\napartments in a fair manner.<\/li><li>Punjab RERA protects an interest of buyers in the\nreal estate sector. It allows the buyers to lodge a complaint or query on the\nRERA portal and receive a solution. <\/li><li>Under the Punjab RERA Act, real estate agents and\nother stakeholders have to compulsory register their projects so that RERA can\ndisplay records pertaining to stakeholders and projects on its official\nwebsite.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rules_and_Regulations_of_Punjab_RERA_Act\"><\/span>Rules\nand Regulations of Punjab RERA Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Punjab RERA&#8217;s goal is to stop malpractices and project delays to ensure\nthis holds real estate agents and builders to the highest standards. The most\nimportant RERA rules that Punjab RERA have are as follows: <\/em><\/strong><\/p>\n\n\n\n<ul><li>As a homebuyer, one only requires to pay the carpet\narea cost for the property they are buying. <strong><em>Builders cannot charge for the\nsuper built-up area, such as the balcony, stairs, lift, and lobby.<\/em><\/strong><\/li><li>The other way in which RERA impacts real estate\nagents and homebuyers as it requires property developers to inform buyers about\nupdates during the construction process. In case of construction of project or\nhandover delays, as per RERA rules, the developer has to <strong>pay 2% interest<\/strong>.<\/li><li>The property developer&#8217;s duty does not end, as one\ncan report defects and problems and have the <strong><em>developer rectify them within\nfive years<\/em><\/strong> <strong><em>from the date of handover.<\/em><\/strong><\/li><li>In case of any dispute, developers have to attend\nto and resolve the concerns <strong><em>within 120 days from the date when a\ncomplaint was filed.<\/em><\/strong><\/li><li>As a homebuyer, two-thirds of allottees can <strong><em>express\nconsent for alterations<\/em><\/strong> for a sanctioned plan of a developer or builder\nregarding making changes to the property.<\/li><li>The Punjab RERA Act <strong><em>prohibits developers from taking\nanything more than 10% as advance from a homebuyer.<\/em><\/strong><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Compliances_under_Punjab_RERA\"><\/span>Compliances\nunder Punjab RERA<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As a homebuyer, one can create a virtual account to log into the\nofficial Punjab RERA website, whereas as a real estate agent, developer or\nagency, one has to register with RERA by submitting the list of documents and\nby paying fees.&nbsp; <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Registration\nFees of Punjab RERA for real estate agents<\/h3>\n\n\n\n<p>The real estate agent must pay a registration fee at the time of\napplication for registration through online at the time of online registration,\nin the case of the applicant being an individual a sum of <strong>Rs.5,000\/-<\/strong> and in the case of the applicant being anyone other than\nthe individual a sum of <strong>Rs.25,000\/-.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The\nvalidity of Registration number <\/h3>\n\n\n\n<p>Real estate agents will have a certificate number, which shall be <strong>valid for a period of five years.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Renewal\nof RERA Registration<\/h3>\n\n\n\n<p>RERA certificate for real estate agents can be renewed after five years.\nThe application fee for a renewal sum of <strong>Rs\n3,000<\/strong> in the case of an individual and in the case of other than an\nindividual is <strong>Rs 12,000<\/strong>. Renewal\ngranted by RERA must be <strong>valid for five\nyears<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Jurisdiction<\/h3>\n\n\n\n<p>This Registration number must be valid for the entire State of Punjab.\nThe real estate agent has to maintain and preserve his books of records,\naccounts, and documents in accordance with the provisions of the Income Tax\nAct, 1961.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Registration_for_Punjab_RERA\"><\/span>Registration\nfor Punjab RERA<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>RERA forms are available on the RERA website, and one can register their\nproject, as well as create a builder or developer profile by using the\nplatform.<\/em><\/strong><\/p>\n\n\n\n<ul><li>To register projects, one must visit the official\nRERA Punjab website and select <strong>&#8216;Project\nRegistration.&#8217;<\/strong><\/li><li>Thereafter, they will be redirected to a page where\nthey can create an account. In accordance to do so, click on to the <strong>&#8216;Agent Registration&#8217;<\/strong> tab on the official Punjab RERA website. Thereafter, select the user type and fill in other details.
