The <strong>Delhi Liquor License Rules, 1976<\/strong>,\npronounces types of licenses that serve liquor in a State. Besides this, the\nAct ensures to supply quality and safe Liquor to its consumers. The legal age\nfor consuming alcohol has been specified in every State. Under <strong><em>Section\n23<\/em><\/strong> of <strong>Delhi Excise Act, 2010<\/strong>\nand Delhi Liquor License Rules, 1976, the legal age for alcohol consumption is\n25 years.<\/p>\n\n\n\n<div the issue of transport pass, and the\nsame must be issued in such a manner as specified by the <strong>Excise Commissioner<\/strong> from time to time. Each application must be\naccompanied by a receipted treasury challan showing deposit of duty and fees,\npayable on a quantity of liquor for which transport pass is required unless\nduty &amp; fee have been paid at the time of import.&nbsp; <\/li>\n\n\n\n<li>The <strong>Assistant Commissioner<\/strong>\nmust cause the application to be scrutinized to see that the quantity applied\nis within the limit of the licensee, and after satisfying himself that the duty\nhas been paid and the application form is otherwise in order, he must issue the\ntransport pass.<\/li>\n\n\n\n<li>The transport pass must be in triplicate; the <strong>first copy<\/strong> will be issued to the <strong>applicant<\/strong>. The <strong>second copy<\/strong>\nmust be given to the <strong>licensee<\/strong> of the\nwarehouse. The <strong>third copy<\/strong> will\nremain on <strong>record in an office<\/strong> in the\nform of a compact disc or paper print. The quantity issued must be indicated\nlegibly both in figures and words on all the copies of the pass. <\/li>\n\n\n\n<li>No over-writing or cutting is permissible on this. If any reason,\nsome erroneous entries have been made in the past, the Assistant Commissioner\nwill <strong><em>issue\na fresh pass<\/em><\/strong> and will cancel all the three copies of the defective\npass.<\/li>\n\n\n\n<li>The <strong><em>signature of an excise official<\/em><\/strong>, by whom the pass is issued,\nmust be in ink, and his name and designation have to be written in capital\nletters on all the copies, whenever prepared manually.<\/li>\n\n\n\n<li>The liquor must be issued from a warehouse on the basis of transport\npasses. The record of these transactions covered by such passes must be\nmaintained in <strong>form-2.<\/strong><\/li>\n\n\n\n<li>The record of such passes must be maintained by the licensee or the\nexcise officer, as the case may be, in a register in <strong>form-2.<\/strong><\/li>\n\n\n\n<li>Before issuing, the licensee or the excise officer, as the case may be,\nmust make appropriate endorsements on the copies of pass:-<\/li>\n<\/ul>\n\n\n\n<ol>\n<li><strong><em>pass-holder<\/em><\/strong><\/li>\n\n\n\n<li><strong><em>warehouse licensee<\/em><\/strong><\/li>\n\n\n\n<li><strong><em>copies to be retained by\nhim in personal custody<\/em><\/strong><\/li>\n<\/ol>\n\n\n\n<p>A monthly statement of all such passes must\nbe submitted to the Assistant Commissioner, who must cause entries made in the\nsaid statement has to be compared with relevant records in the office. The\nAssistant Commissioner, must after such comparison, <strong><em>submits his report to the Deputy\nCommissioner <\/em><\/strong>and will make an endorsement to this effect on a statement\naforesaid. <\/p>\n\n\n\n<ul>\n<li>The Assistant Commissioner has to<strong><em> maintain record<\/em><\/strong>s showing\nthe particulars of all such passes issued by him with the summary showing the\ntotal number of passes issued, names of the licensees to whom issued, the total\nquantity of liquor, and also the total number of duty involved. The Assistant\nCommissioner must append his signature below the summary. <\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_person_licensed_to_import_export_and_transport_of_liquor\"><\/span>A person licensed to import, export and transport of\nliquor<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>No person except a licensed vendor can import, export\nor transport liquor, provided that-<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Any person holding a license for the possession of liquor can import and transport any quantity, but not exceeding the quantity which he is permitted to possess under a permit on the payment of prescribed duty and fee.<\/li>\n\n\n\n<li>Defense Laboratory, Quarter Master General branch, can import, transport, or possess Indian liquor on the basis of an import license for purposes of analysis without paying a fee.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conditions_applicable_on_an_individuals_possession_limit\"><\/span>Conditions applicable on an individual&#8217;s possession limit<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>No person must have in his possession any quantity of\nintoxicant, except the permissible limit of possession and retail sale as\nprescribed. Also, further on the condition that it must not be &#8211;<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Consumed in any public place;<\/li>\n\n\n\n<li>They were kept in any premises used as a place to which has admitted\nfor the consumption of food or a drink for consideration unless such premises\nhave been licensed for consumption of liquor under the Act or the rules. It has\nbeen exempted by an order by the Government in writing from the provisions of\nthese rules.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conditions_applicable_to_grant_of_a_liquor_license_in_Delhi\"><\/span>Conditions applicable to grant of a liquor license in\nDelhi<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>All passes and the <\/em><\/strong><em><a href=\"https:\/\/corpbiz.io\/liquor-license\"><strong>Liquor license<\/strong><\/a><\/em><strong><em> granted to cover import, export, and transport of intoxicants must be subject to the conditions-<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>That bulk must not be broken in transit;<\/li>\n\n\n\n<li>That copies of permits or passes must be sent to an Excise Officer\nof the district of origin or destination, in the case of imports and exports:<\/li>\n<\/ul>\n\n\n\n<p>It is provided that a pass shall be\nsufficient to cover the transport of intoxicants to the premises where an\nimporter is either licensed to sell and to possess intoxicants in Delhi.<\/p>\n\n\n\n<p>The export pass must show in all cases the quantity and strength of intoxicants to be exported and duty at the rates prevailing in Delhi has been paid, or exemption has been granted, or the bond has been executed to safeguard excise revenue. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Power_of_refusal_to_grant_a_liquor_license_in_Delhi\"><\/span>Power of refusal to grant a liquor license in Delhi.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Excise Commissioner, the Assistant Commissioner or the Deputy&nbsp; Commissioner might<strong><em> refuse to grant any <\/em><\/strong>licenses for any sufficient reason, which is to be recorded and must not grant any such licenses if he had a reason to believe that an applicant has not paid any dues demanded from him.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Authority_empowered_to_issue_Permit_or_pass\"><\/span>Authority empowered to issue Permit or pass.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Passes for an import, export, or transport\nof liquor and permit for possession of liquor can be granted by a Deputy\nCommissioner, or he can delegate his powers to any excise officer who is\nsubordinate to him. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Extension_of_validity_of_liquor_license_in_Delhi\"><\/span>Extension of validity of liquor license in Delhi<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul>\n<li>No pass or license must be valid after the date of its expiry\nprovided that a Deputy Commissioner, granting the license or the authority to\nauthorize a dispatch of any consignment under these rules, can extend the\nperiod of currency thereof. If an extension is applied for the delay in transit\nof a consignment or for any other sufficient reason on the payment of composition\nmoney, it must <strong><em>not exceed 25% of the duty of consignment<\/em><\/strong>, or otherwise, and\nreasons to be recorded.<\/li>\n\n\n\n<li>Where during the course of an import of liquor, the delay occurs for\nreasons beyond the control of the licensee, he must submit <strong><em>an application for revalidation of\nimport license<\/em><\/strong> to a Deputy Commissioner within 3 working days of the occurrence\nof the event and the Deputy Commissioner may re-validate the same.<\/li>\n\n\n\n<li>For transport permit, the application for such revalidation must be\nmade on the next working day from the date of expiry of validity.<\/li>\n\n\n\n<li>Where the application is not submitted within a stipulated period or\nthe delay is for any other reason, the revalidation can be done on payment of\ncomposition money, which must<strong><em> not exceed 10% of the duty involved<\/em><\/strong>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_validity_of_liquor_license_in_Delhi\"><\/span>The validity of liquor license in Delhi<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul>\n<li>Unless the Government otherwise directs, the license must ordinarily be granted for a <strong>period of one year.<\/strong><\/li>\n\n\n\n<li><strong><em>A temporary license<\/em><\/strong> can be given to provide for a sale of liquor on special occasions in such cases, as the Deputy Commissioner can determine.&nbsp; <\/li>\n\n\n\n<li>All licenses other than temporary licenses must unless otherwise provided, determine on 31st March following the <strong><em>grant or renewal<\/em><\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"text-left\"><b>Read our article<\/b>:<mark style=\"background: #fffd03 !important;\"><a href=\"https:\/\/corpbiz.io\/learning\/suspension-and-revocation-of-liquor-license-in-india\/\">\nSuspension and Revocation of Liquor License in India\n<\/a><\/mark><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Restriction_on_grant_of_liquor_license_to_certain_persons\"><\/span>Restriction on grant of liquor license to certain persons<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Persons to who licenses cannot be granted.In addition\nto the provisions provided in Section 13, license for vend of intoxicant shall\nnot be given to:<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Any person who <strong><em>does not have his <\/em><\/strong>Permanent Account Number(PAN) the Income Tax Department or has not been assessed to income tax<\/li>\n\n\n\n<li>Any person who is <em><strong>not registered under Delhi (VAT) Act, 2004<\/strong><\/em><\/li>\n\n\n\n<li>Any person who has held a license in Delhi for the sale of any intoxicant and has <strong><em>failed to pay due to excise revenue<\/em><\/strong> and not exempted by order of the Government from payment of duty<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Granting_of_liquor_Licenses_in_Delhi\"><\/span>Granting of liquor Licenses in Delhi<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Licenses in this domain are of different kinds. The granting provisions for a few of them are as below:<\/em><\/strong><\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter\"><img decoding=\"async\" width=\"680\" height=\"374\" src=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/06\/image-157.png\" alt=\"Granting of liquor Licenses in Delhi\" class=\"wp-image-11412\" srcset=\"https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/06\/image-157.png 680w, https:\/\/corpbiz.io\/learning\/wp-content\/uploads\/2020\/06\/image-157-300x165.png 300w\" sizes=\"(max-width: 680px) 100vw, 680px\" \/><\/figure><\/div>\n\n\n<h3 class=\"wp-block-heading\">Grant of L-1 License<\/h3>\n\n\n\n<p>The L-1 licenses are for wholesale vending\nto companies, partnership firms, societies, or proprietorship firms subject to\nthe condition that the applicant has distillery\/manufacturing\nunits\/breweries\/bottling plants. Moreover, they have to abide by the terms and\nconditions ordered by the concerned authority.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Grant of L-6 License<\/h3>\n\n\n\n<p>The L-6 licenses are for the retail sales\nof foreign liquor. Issuance of this license requires to choose undertakings of\nthe Delhi government, DTTDC, DSCSC, DSIDC, and DCCWS.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Grant of L-9 License<\/h3>\n\n\n\n<p>The L-9 licenses are for the retail sale of\nvarious brands of Indian Liquor and Foreign Liquor. This license was earlier\nknown as L-52 D. To attain this license. The applicant requires to abide by the\nterms and conditions ordered by concerned authority.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Grant of L-10 License<\/h3>\n\n\n\n<p>The L-10 licenses are for the retail sale\nof various brands of Indian Liquor and Foreign Liquor. However, the terms and\nconditions for the L-9 license do not apply to the L-10 licenses.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Grant of P-10 and P-13<\/h3>\n\n\n\n<p>These licenses are temporary licenses for\nserving liquor in the parties, functions, and conferences. The terms &amp;\nconditions ordained for these licenses vary from residents, clubs, hotels, restaurants,\nand other premises.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Grant of L-15 and L-16<\/h3>\n\n\n\n<p>These licenses are for star hotels that are\napproved by the Department of Tourism to accommodate the tourists. The hotel\nmanagement is to abide by the terms and conditions ordered by the authorities.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Grant of L-17 and L-18<\/h3>\n\n\n\n<p>These licenses are for the star hotels\nwhich are approved by the Department of Tourism. These establishments must be\nlocated in a commercial area with adequate space for parking.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Grant of L-28<\/h3>\n\n\n\n<p>The L-28 license is for clubs that have\nbeen registered with the registrar of firms or registrar of cooperative\nsocieties to provide services of foreign liquor to its club members. All clubs\nwhich agree to specified terms and conditions can apply for this license.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Grant of L-29<\/h3>\n\n\n\n<p>The L-29 license is for clubs or mess which\nprovides liquor or beer exclusively to Government Servants, and that are not\nsubject to commercial rates and rules.
