FSSAI Act has clearly directed the penalties under FSSAI Act for offenses made by One Person Company, Private Limited Company, or Limited Company. <\/em><\/strong><\/p>\n\n\n\n<div <strong><em>offense under FSSAI Act<\/em><\/strong>, during the\noffense, all the people who were responsible to or who were handling the charge\nof the company, responsible for overseeing the company&#8217;s business along with\nthe company would be considered guilty must get proceeded against and get the <strong><em>duly\npunishment<\/em><\/strong>. <\/li><li>If\na company has multiple branches or establishments or different units in any\nbranch or establishment, then the <strong><em>concerned head<\/em><\/strong> of such branch or\nestablishment looking after the food safety, chosen by the company, must be\nlegally responsible for branch, unit, or establishment. <\/li><li>If\na company has committed an offense and by any means, if it gets proved that the\nreason behind the commitment of the offense is the <strong><em>negligence of Manager, Director,\nsecretary<\/em><\/strong> or rest of the <strong><em>officers<\/em><\/strong> that are working for the\ncompany and these people have given their nod for the commitment of offense\neither deliberately or non-deliberately, then such Manager, Director, or other\nofficial people would be considered as guilty for such an offense and would\nreceive the punishment as well.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Penalties under FSSAI Act for Misbranded and\nSub-Standard Food<\/h3>\n\n\n\n<ul><li>If any person either himself or by another\nperson on his behalf is involved in manufacturing, storing, selling,\ndistributing, as well as importing any <strong><em>misbranded food for human consumption<\/em><\/strong>,\nhe would have to pay a <strong><em>penalty<\/em><\/strong> which may reach up to the <strong><em>Rs\nthree lakh. <\/em><\/strong><\/li><li>&nbsp;The\nperson found guilty of committing an offense under this section would get\nissued a direction from the <strong><em>office of Adjudicating Officer<\/em><\/strong> in\norder to follow required corrective measures to bring correction in the\nmistakes, or such food material must get destroyed.<\/li><li>If any person either himself or by another\nperson on his behalf is into manufacture for sale or distribution or stores or\nimports of <strong><em>food material sub-standard in nature for consumption <\/em><\/strong>by a human,\nhe will be liable to a penalty which may reach up to <strong><em>Rs five lakh.<\/em><\/strong><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Punishment Regarding Unsafe Food<\/h3>\n\n\n\n<p><strong><em>If any person either himself or\nby another person on his behalf manufactures for the purpose of selling,\nstoring, distributing or importing food articles or items for human consumption\nwhich is not safe, then such a person shall be punishable- <\/em><\/strong><\/p>\n\n\n\n<ul><li>If\nhis failure or non-compliance with the rules <strong><em>does not cause any injury<\/em><\/strong>,\nhe may get imprisoned for six<strong><em> months duration<\/em><\/strong>, and fines imposed\non him may extend to <strong><em>Rs one lakh.<\/em><\/strong><\/li><li>If\nhis failure or non-compliance with the rules leads to a <strong><em>grievous injury<\/em><\/strong>, he may\nget imprisoned for <strong><em>six years duration<\/em><\/strong>, and fines imposed on him may extend to <strong><em>Rs\nfive lakh<\/em><\/strong>.<\/li><li>If\nhis failure or non-compliance with the rules causes an <strong><em>injury of non-grievous nature<\/em><\/strong>,\nhe may get imprisoned for a period of up to <strong><em>one year,<\/em><\/strong> and fines\nimposed on him may extend to <strong><em>Rs three lakh.<\/em><\/strong><\/li><li>If\nhis failure or non-compliance leads to <strong><em>death<\/em><\/strong>, he shall get imprisoned for a\nperiod of up to <strong><em>seven years,<\/em><\/strong> and fines imposed on him won&#8217;t be less than <strong><em>Rs\nten lakh.<\/em><\/strong> Also, his <strong><em>imprisonment<\/em><\/strong> may get extended for a <strong><em>lifetime<\/em><\/strong>.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Penalties\nunder FSSAI Act for Running a Food Business without FSSAI License<\/h3>\n\n\n\n<p>If any person or FBO (except\nthose who got an exemption from licensing under Section 31(2) of FSSAI Act),\neither himself or by another person on his behalf, who is in need of acquiring\nthe license, sells, manufactures, distributes or imports or stores any food\narticle without a license or in a different way we can say <strong><em>carrying business without FSSAI\nlicense<\/em><\/strong>, shall get imprisoned for a duration up to <strong><em>six months<\/em><\/strong> along with a\nfine which may touch the figure of <strong><em>Rs five lakh.<\/em><\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Penalties under FSSAI Act for Unhygienic Processing or Manufacturing of Food and Food Containing Extrinsic Matter<\/h3>\n\n\n\n<ul><li>If\nany person either himself or by another person on his behalf processes or\nmanufactures any foodstuff for human consumption under an <strong><em>unhygienic environment<\/em><\/strong>,\nthen he would have to pay the Penalty that may extend to <strong><em>Rs one lakh.<\/em><\/strong><\/li><li>&nbsp;If any person either himself or by another\nperson on his behalf manufactures with the intent to sell, store or distribute\nor import any food article containing <strong><em>extraneous matter<\/em><\/strong> for consumption by\na human, then Penalty of up to <strong><em>Rs one lakh<\/em><\/strong> might get imposed on\nhim.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Penalties under FSSAI Act for Selling Food\nwithout Meeting the Buyer Demand for Quality or Substance<\/h3>\n\n\n\n<ul><li>If\na person or a food business operator is selling food to the purchaser without\ncomplying with the FSSAI Act provisions or the guidelines prescribed in the\nAct, or <strong><em>without meeting the requirements of the purchaser for substance or\nquality of food<\/em><\/strong>, then the penalty imposed on him won&#8217;t be exceeding <strong><em>Rs.\nFive lakh. <\/em><\/strong><\/li><li>Also,\nthose people who got covered under <strong><em>Section 31- subsection 2<\/em><\/strong> for such\nnon-compliance shall be liable to a penalty not more than <strong><em>Rs.
