Therefore, this should be one of the first considerations when planning for a new business venture.<\/li><li>The <strong><em>application will contain details<\/em><\/strong> about the business and personal background.<\/li><li><strong><em>Details of your age, your work experience, and a clean personal record<\/em><\/strong> may impact the state&#8217;s decision to grant a license.<\/li><li>The important documents along with an application are submitted, which includes a <strong><em>certificate of incorporation, a partnership contract, your company&#8217;s constitution<\/em><\/strong>, a copy of your suggest food menu, photos or drawings of the exterior of the property and a floor plan of the interior, a code compliance authorization, a copy of the title certificate for the premises.<\/li><li><strong><em>Renew of the liquor license<\/em><\/strong> required annually. An entrepreneurial license is granted after the following\nconditions:<\/p>\n\n\n\n<ul><li>The <strong><em>stock or collection of foreign liquor<\/em><\/strong>\nfrom the licensee (except for disposal at the store) can be held by him at 12\ngodowns approved by the government.<\/li><li>The license holder has to <strong><em>pay all leases, costs, and\nexpenses<\/em><\/strong> related to warehouses and surveillance.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Section 35 \u2013 Hotel license<\/h3>\n\n\n\n<p>The government, according to rules, can make an order in\nwriting, and authorize an officer to grant licenses to the license holders of\nhotels in order to sell foreign liquor to people permitted under this Act. It\nis provided that the government must satisfied that such a hotel usually has a\nsufficient number of staff members eligible to hold the permits. Such licenses\nare issued after the following conditions:<\/p>\n\n\n\n<ul><li>Liquor must be <strong><em>sold to the permit holders<\/em><\/strong>\nliving or boarding at a hotel.<\/li><li>Consumption of <strong><em>liquor sales shall not be allowed\nin any of the personal rooms<\/em><\/strong> of the hotel for which any other member of\nthe public has access. <\/li><li>The hotel liquor license holders must <strong><em>pay\nthe expenses of any officer of the excise department<\/em><\/strong> if any required\nfor the grant and control of permits on the premises or regarding the\nsupervision of the issue or the consumption of foreign liquor in the hotel. <\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Wholesale License<\/h3>\n\n\n\n<ul><li>The procedure to obtain wholesale license for selling liquor is mentioned in <strong>Part-III<\/strong> of <strong>Bombay Prohibition Act, 1949<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Bombay_Prohibition_Act,_1949\"><strong>[1]<\/strong><\/a><\/sup><strong>.<\/strong> <\/li><li>Anyone who wants to obtain the wholesale license has to make <strong><em>an application to the Commissioner<\/em><\/strong> through the superintendent of the district for the area in which he desires to establish a warehouse for storing the country liquor.&nbsp; <\/li><li>Then superintendent will further <strong><em>verify the particulars <\/em><\/strong>given thereof and satisfy himself that the building and rooms of the warehouse are for the purpose of sale of liquor conform to the requirements of <strong>Rule 15<\/strong>. <\/li><li>The <strong><em>requirements of warehouse premises<\/em><\/strong> are also prescribed in the Act. <\/li><\/ul>\n\n\n\n<p class=\"text-left\"><b>Read our article<\/b>:<mark style=\"background: #fffd03 !important;\"><a href=\"https:\/\/corpbiz.io\/learning\/tobacco-license-in-india\/\">\nTobacco License in India \u2013 Brief Overview\n<\/a><\/mark><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Renewal_of_Bar_and_Shop_License\"><\/span>Renewal of Bar and Shop License<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In Mumbai City Restaurants, having <strong>Grade 1<\/strong> has the facility of obtaining the Bar License i.e., Permit\nRoom License for &#8220;ON- Consumption.&#8221; However, the <strong>FL II licenses <\/strong>are given to the shops to sale sealed Bottles for\n&#8220;OFF- Consumption.&#8221; <strong>The\nvalidity of these licenses lasts up to one year.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Under what Rule the license is issued?<\/h3>\n\n\n\n<p>The liquor license in Mumbai is issued under <strong><em>Rule 24, 44, 47 of Bombay Foreign Liquor Rules 1953 <\/em><\/strong>and for Beer Bars under <strong><em>Special Permit Rules 1952.<\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_for_Renewal_for_Liquor_License_in_Mumbai\"><\/span>Procedure for Renewal for Liquor License in Mumbai<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Any person who desires to renew a license must apply thirty\ndays before the date of the expiry of liquor license. Every application must be\naccompanied by a challan and evidence of payment of <strong><em>application fee, which is\nRs.25\/-.<\/em><\/strong> The renewal fees are fixed by the State Government from time\nto time.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Documents need to be submitted along with the application.<\/h3>\n\n\n\n<ul><li>The licensee who desires to renew the license\nmust apply in the prescribed form along with <em>Rs.1\/- Court fee stamp.<\/em><\/li><li><em>Application\nfee of Rs.25\/-<\/em> in challan<\/li><li>License fee challan as fixed by the State\nGovernment from time to time <\/li><li>Income tax\/Sales Tax clearance certificate or\naffidavit.<\/li><li>Partnership Deed copy or Declaration for no\nchange in the Partnership or status of the institution<\/li><li>Documents regarding Ownership\/Tenancy of the\npremises<\/li><li>License copy in Original <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"License_for_purchasing_transporting_and_consuming_liquor\"><\/span>License for purchasing, transporting and consuming liquor<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The person in Maharashtra, it requires to buy\nalcohol; he must have to <strong><em>attain the age of majority (i.e., above 18\nyears) as per Bombay Prohibition Act, 1949<\/em><\/strong>. <strong>Section-18<\/strong> of the Act, he cannot consume the alcohol because the\nconsumption age in Maharashtra is of <strong>25\nyears<\/strong> (as per Bombay Prohibition Act 1949- <strong>Part VI-A Rule 70D<\/strong>). <\/li><li>Sometimes such law becomes difficult to enforce\nas there are very limited ways to ensure that the person is above the age of 25\nyears.<\/li><li>Even if the person is caught for consumption of\nalcohol, then he cannot be punished in case he is above 18.<\/li><li>If an individual wanted to buy alcohol, he first\nrequires getting a license from the state government.<\/li><li>&nbsp;He also\nrequires showing that license to the vendor before making a valid purchase. <\/li><li>A person is only allowed to have 12 units of\nalcohol at a time.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Cost_of_obtaining_liquor_license\"><\/span>Cost of obtaining liquor license<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The temporary club license or party permit fees\nfor bigger parties (more than 100 people) are <strong>Rs 15,000.<\/strong> In case for smaller parties (below 100 people) is <strong>Rs 10,000.<\/strong><\/li><li>For temporary club licenses for liquor parties\nin smaller towns, such as Navi Mumbai, where the population is below 20 lakh,\nthe mandatory license will cost <strong>Rs\n10,000<\/strong> for above 100 members and <strong>Rs\n7,000<\/strong> for below 100 members. <\/li><li>As per excise department rules, the <strong>FL-4 license<\/strong> is required to host the\nprivate liquor party in a flat or at a resort that costs <strong>Rs 13,000<\/strong> across cities in the state. <\/li><li>Consumers must have this license even if they\nare drinking with friends in an apartment or a house party. The person can be\npunished for illegal possession of liquor if he does not have valid permission\nto host the party. <\/li><li>In case only if few friends are together, the\nconsumer must at least have a <strong>daily\ndrinking permit.<\/strong><\/li><li>License fee for the permit rooms is <strong>Rs. 544,000<\/strong> and that for the beer shops\nis <strong>Rs.<\/strong> <strong>150,000<\/strong>.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Online_liquor_license_process\"><\/span>Online liquor license process<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The state excise department has an online\nportal, which is <strong>&#8216;excise.maharashtra.gov.in,&#8217;<\/strong>\nto grant liquor license for consumption.<\/li><li>The permit could be obtained by simply <strong><em>registered\nby your Aadhar Card<\/em><\/strong> number on the website.<\/li><li>A <strong>digital\npermit<\/strong> will be granted within few minutes of the application made. The applicants\nhave an option to check the application status even online.<\/li><li>Those applying for liquor permits <strong><em>must\nhave the age of 25 years<\/em><\/strong> and above.<\/li><li>A one-day drinking permit for foreign liquor\ncosts Rs 5, country liquor costs Rs 2 whereas an annual permit costs Rs 100,\nand a lifetime permit costs Rs 1,000. <strong>One\ncan apply for only one permit in a day.<\/strong><\/li><li>Previously, applicants required to go to the\nexcise office to submit documents and pay fees for getting the drinking permits,\nwhereas now the online grant of permit is more easy and time-saving.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Places_prohibited_for_Liquor_shops\"><\/span>Places prohibited for Liquor shops.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The <strong>Supreme\nCourt in December 2017<\/strong> had <strong><em>banned the sale of liquor<\/em><\/strong> within <strong><em>500 meters\nof state and national highways<\/em><\/strong> across the nation, but this order does\nnot prohibit licensed establishments within municipal areas. <\/li><li>No liquor shops must be established in municipal\ncorporations and municipalities within a distance of <strong><em>50 meters from an existing place\nof worship or educational institutions<\/em><\/strong>.
