When a\nBeer and Wine License are obtained, there is a prohibition upon the license\nholder to deal with any kind of hard liquor.<\/p>\n\n\n\n<ul>\n<li><strong><em>Restaurant Liquor License<\/em><\/strong><\/li>\n<\/ul>\n\n\n\n<p>The Restaurant Liquor License is\nfor restaurants that are willing and wish to serve alcohol on their premises.\nThis type of license is also called the &#8220;<strong><em>All-Liquor License<\/em><\/strong>.&#8221;\nHowever, this type of license is only granted to restaurants whose business is\nmainly generated from the sale of food items, and only a percentage <strong><em>(not\nexceeding 40%)<\/em><\/strong> of sales come from liquor.<\/p>\n\n\n\n<ul>\n<li><strong><em>Tavern Liquor License<\/em><\/strong><\/li>\n<\/ul>\n\n\n\n<p>This type of license is granted to\nbusinesses, which in spite of offering food items make up half of their profits\nout of the alcohol sale. <\/p>\n\n\n\n<ul>\n<li><strong><em>Brewpub Liquor License<\/em><\/strong><\/li>\n<\/ul>\n\n\n\n<p>As the name suggests, this type of license is granted to those who make\/ brew their wine and beer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_the_need_to_obtain_a_Liquor_License_in_India\"><\/span>What is the need to obtain a Liquor License in\nIndia?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A Liquor License is granted by the <strong><em>State Excise Department<\/em><\/strong> to those who wish to sell and distribute alcohol and alcoholic beverages. Thus, if any person is involved or planning to venture in a business that deals with the sale\/distribution or manufacturing of alcohol and alcoholic drinks, then they must apply for a Liquor License.<\/p>\n\n\n\n<p>Every state government keeps a stringent check on the sale and consumption of alcohol sold within its territory, every State has a different set of liquor laws that must be carefully observed before applying for a Liquor License. Moreover, since dealing with the <strong><em>manufacture, import, export, transport, possession, purchase, sale,<\/em><\/strong> etc., of liquor is made punishable in the absence of a Liquor License, it is mandatory for one to obtain a valid Liquor License in India accordance with the state laws.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Ambit_of_a_Liquor_License_in_India\"><\/span>The Ambit of a Liquor License in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Depending upon the legislation and laws of each state, a valid <strong>liquor license in India<\/strong> covers a wide ambit in relation to the manufacture, import, export, transport, possession, purchase, sale, etc., of liquor. Depending upon the type of Liquor License granted and the event for\nwhich it is granted, the following are the average costs that are incurred in\nobtaining a Liquor License:<\/p>\n\n\n\n<ul>\n<li><strong><em>Temporary Liquor License Cost<\/em><\/strong><\/li>\n<\/ul>\n\n\n\n<p>In case liquor is to be served at\nan event\/party or a marriage organized in a small town, with a population below\n<strong><em>twenty\nlakhs<\/em><\/strong>, the temporary liquor license will cost somewhere around <strong>Rs.10,000<\/strong> for more than 100 members and\n<strong>Rs. 7,000<\/strong> for less than 100 members.<\/p>\n\n\n\n<ul>\n<li><strong><em>Liquor License cost for a Party in a Private\nResort or Flat<\/em><\/strong><\/li>\n<\/ul>\n\n\n\n<p>As per the excise department, the\nFL 4 license is required for bringing in liquor in a party organized in a\nresort or a private flat. The average cost of an FL 4 license is <strong>Rs. 13,000<\/strong>.<\/p>\n\n\n\n<ul>\n<li><strong><em>Serving Liquor License Cost in the Permit\nRooms<\/em><\/strong><\/li>\n<\/ul>\n\n\n\n<p>The Liquor License cost for serving\nin permit rooms is <strong>Rs.5, 44,000<\/strong> and\nthat for a restaurant or beer shop is <strong>Rs.\n1, 50,000<\/strong>.<\/p>\n\n\n\n<ul>\n<li><strong><em>Liquor License cost for a particular State<\/em><\/strong><\/li>\n<\/ul>\n\n\n\n<p>For obtaining a Liquor License in\na particular state, the applicant is required to submit an application fee\nalong with the relevant application form. The license fee attached ranges from <strong>Rs. 5000 to Rs. 15000<\/strong> or more depending\nupon the prevailing state laws and regulations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_to_apply_for_a_Liquor_License_in_India\"><\/span>How to apply for a Liquor License in India?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As each state in India has its own\nset of liquor laws, rules, and regulations, it is important to have full\nknowledge of the liquor laws prevailing in your state before applying for a\nliquor license. Liquor consumption, manufacturing, and distribution are issues pertaining to the state list as per the seventh schedule of the Indian constitution. <\/p>\n\n\n\n<p>This is why each state has its own liquor laws. Even for registration of foreign liquor bar licenses, every government regulates alcohol sales to prevent minors from purchasing spirits, wine, beer, and liquor. For instance, the requirement for a liquor license varies in small towns where they often only approve a new license when the population grows.<\/p>\n\n\n\n<p>According to the <strong><em>Licensing Act 2003<\/em><\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Licensing_Act_2003\"><strong>[1]<\/strong><\/a><\/sup>, one needs a liquor license in India for selling the alcohol. This includes giving away free alcohol as it is considered an incentive to purchase or that it is included in your pricing structure. Before starting a liquor business, one has to know about the License or Government regulations and legal things, which are the most important factors before starting the liquor business in India.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_to_apply_for_a_Liquor_License_in_India\"><\/span>Procedure to apply for a Liquor License in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul>\n<li><strong>STEP 1:<\/strong>\nVisit the official website of your State Excise Department and download the\napplication form for your preferred license type. Once downloaded, fill in the\napplication form with all necessary details. Once filled, the form must be\nsubmitted to the concerned authority along with the required application fee,\nwhich varies from state to state. While filling out the form, do remember to\nmention all the required details, including the type of liquor license\nrequired, premises where it needs to be served\/sold, type of liquor planning to\nbe served\/sold, etc. Also, one must make sure to state your background\ninformation like age, business experience, criminal record (if any), etc. along\nwith relevant documents.<\/li>\n\n\n\n<li><strong>STEP 2:<\/strong> The documents which are required to be attached along with the application form vary from license to license. However, documents like applicant\u2019s identity proof, residence proof, a valid address and\/or premise address proof, incorporation certificate (in case of business entities), copy of <a href=\"https:\/\/corpbiz.io\/income-tax-return-filing\" title=\"Income Tax Return Filing\"><strong>ITR<\/strong><\/a>, etc. are universally required.<\/li>\n\n\n\n<li><strong>STEP 3:<\/strong>\nOnce the application form is submitted, the state licensing authority will\ncross-check and verify the credentials submitted by you and can also call for\nadditional documents required.<\/li>\n\n\n\n<li><strong>STEP 4:<\/strong>\nPost verification, a notice shall be posted by the concerned state authority on\nyour personal or business address, declaring your name and the license details.\nThe notice so displayed shall be open for any objections raised by the local\npeople, which will be communicated to the concerned department.<\/li>\n\n\n\n<li><strong>STEP 5:<\/strong>\nIn case an objection is raised, you will be given a right to defend yourself.\nIn case, no objections are raised, the authority will review the application\nand grant you the Liquor License.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_Required_for_Obtaining_a_Liquor_License\"><\/span>Documents Required for Obtaining a Liquor License<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Each state has its own prescribed\nset of documents that are required for obtaining a liquor license. However,\nthere are certain documents that are needed in general for obtaining a Liquor\nLicense. These are:<\/p>\n\n\n\n<ul>\n<li>Identity Proof of the Applicant<\/li>\n\n\n\n<li>Address proof of the applicant<\/li>\n\n\n\n<li>Address proof of the premise used for\nserving\/selling\/storing\/manufacturing of alcohol<\/li>\n\n\n\n<li>NOC from the state fire department and municipal\ncorporation<\/li>\n\n\n\n<li>Application with personal and business details\nof the applicant<\/li>\n\n\n\n<li>MOA and AOA copy in case of companies<\/li>\n\n\n\n<li>Latest ITR copy<\/li>\n\n\n\n<li>Applicant\u2019s photograph<\/li>\n\n\n\n<li>An affidavit declaring that there are no past\ncriminal records in the name of the applicant<\/li>\n\n\n\n<li>An affidavit declaring that there are no pending\ndues in the name of the applicant.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Revocation_of_the_Liquor_License\"><\/span>Revocation of the Liquor License<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>A Liquor License in India will be liable for revocation if any one of the following acts is committed by the applicant:<\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Serving of Liquor on Dry Days<\/li>\n\n\n\n<li>Serving of Liquors to Minors<\/li>\n\n\n\n<li>Violations of the rules and laws laid down by the state excise department<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Validity_and_Renewal_of_License\"><\/span>Validity and Renewal of License<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A Liquor License has a <strong>validity of 1 year<\/strong> from the date of\nissue. After expiry, a liquor license can be renewed annually, by filling the\nrenewal application form available on the website of the State Excise\nDepartment and paying the relevant renewal fee.<\/p>\n\n\n\n<p>Therefore, if any person wishes to\nget his \/her license renewed, then they must apply for same <strong><em>before\nthe thirty days from the date of expiry of the license<\/em><\/strong> along with the\npayment of a renewal fee which is fixed by the State Excise Department\ndepending upon the type and\/or class of the license.
